To Whom It May Concern: RE: Response to Complaint No*** by Aspire Auctions, Inc. Mr*** complains that he won an antique English Open Face 18k Gold Pocket Watch during our February 12-auction and we refused to deliver it to him. Specifically, he
alleges that we forgot to place a reserve (minimum sale price) on the watch and because he won it very cheaply (approximately 200$), we decided not to loose money and refused to deliver Mr.*** is incorrect in his understanding of the situation. First, we regret that Mr*** had less then excellent experience with our auction. Second, by the way of background we submit the following: During our February auction we listed the subject watch (see exhibit 1) as lot 326. Unfortunately, we did so mistakenly, not realizing that this watch was already sold during our September auction to Bidder No12438. Please see the Invoice fully paid by Bidder 12438, which reflects that the item was packed and shipped to him on or about September 20, (see attached as exhibit 2). Upon realizing that the watch was mistakenly listed, we pooled it (lot 326) out of the auction on or about February 18, way before the closing of this lot. Please see the snapshot of the webpage which lists the lots in order (see exhibit 3). There you will observe that after lot goes lot (see id.). After removal of lot 326, its absence was reflected on the website for the bidders who used desktop or laptop computers. Unfortunately, due to technical glitch, lot was still showing on mobile devices such as smart phones and iPads. That is why Mr***, who apparently was placing bids on a mobile device, was still able to see lot and place bids. When auction closed and Mr*** did not receive the “Winning Bidder” notification, he called us to inquire about his wining. We explained the situation, apologized for the technical glitch, informed him that it was fixed, and inquired regarding a possibility of resolution. Unfortunately, Mr*** was not satisfied and filed the complaint with Revdex.com. Finally, and more importantly, pursuant to our Bidder Agreement, which every Bidder must accept during registration process if he wishes to participate in our auction, we have a discretion to withdraw any lot from the auction or cancel the sale to the winning bidder (please see copy of the relevant part of the Bidder Agreement attached hereto as Exhibit 4)This provision was included into the Bidder Agreement specifically to protect Aspire Auctions in similar or in situations like this.
