FRAUD & BREACH OF CONTRACT ON BEHALF OF ASPIRE LENDING RENDERED A SINGLE MOM & HER DAUGHTER HOMELESS OUT OF BOTH OF THEIR HOMES!!
This is not THE Demand Letter YET, this is all the case pretty much put together, including the monetary losses estimate at the bottomNot sure still how to organize this info properly into a Demand Letter format, plus if my "Math" is sufficient and acceptable? The Math does not include a total for our suffering we have endured all this time
Just wondering what you think?
Thank you SO Much!
Claim against : ASPIRE LENDING Company, (Multi-State Company with offices in ***)
CEO & Founder Kevin M***, President & CFO Michael J***,
Vice President Stephen B***, and Corporate Attorney Diane J***,
Action Taken So Far: I *** state I have reported my case to the TDM&L, who did a full investigation and found Aspire Lending at Fault, and initiated Formal Disciplinary Action against Aspire Lending
I also have a taped conversation with the vice-president of Aspire Lending Co., Stephen B*** ,admitting Times Aspire Lending made a "Big Mistake": http://youtu.be/-SkslVmUs0w
FACTS:
2013: My daughter & I were living in our home in ***, but planned to move to ***, *** where our family livesI have always ran my business out of my home
February, 1, I made application for a loan with Aspire Lending Coto buy a house in ***;
I was pre-qualified and then approved by Aspire Lending cofor a $100,loan to buy a house;
2AAlthough I was approved for the loan by Aspire, I in fact should not have been due to an existing banking law which disallowed child support as being considered as a source of income, if the child would turn within years of the loan application dateMy daughter was going to be in less than years
After being approved for the loan, in discussion with Aspire, Aspire first considered me being able to qualify for a second mortgage in order to keep my *** home as a rental, but the lender determined my income was not sufficient to support mortgages, and advised me to sell my *** homeRelying on Aspire's advice and recommendation in order for me to get the loan to buy a house in ***, I listed my *** home in March of and it was sold April 9,
Gross amount of *** Home Sale: $188,($30,Net equity to Myself.)
My daughter *** & I, after selling our *** home, moved to ***, *** and began looking for another homeSoon I found another home in *** County, in May of 2013, which would suit my needs and allow me to run my business out ofOn May 13, 2013, Fannie Mae agreed to sell the said home for $92,120.00,I signed a contract on the home and put $1,Earnest money downI notified Aspire of this fact as well
Upon closing date, Aspire notified Me that I could no longer qualify for the loan due to the child support law
But for Aspire's incompetence and negligence in failing to know the child support law and advising me to sell my *** home, My daughter, our pets, and I were put in a very bad positionI, in relying on Aspire, and now not having the loan approval could in no way buy another house and could not get our old house in *** back
Aspire should have know what the banking laws were regarding child support being used as a source of incomeAspire should not have advised me to sell my *** home
I acted on the advice of Aspire Lending Co., in selling my *** Home, thinking I would be able to buy another home in *** with the loan for $100,However, after finding the home in ***, signing a contract on it, Aspire then told me the loan no longer existed
Losses to Myself: Besides the emotional distress, and not able to work our of my own home, I lost my *** home and have been homeless since
Not being able to work from my home, has destroyed my source of employment income also
In conclusion, My daughter was weeks away from turning when the loan got killed on 6/17/
In a nutshell here are the dates:
February 1, I was pre-qualified for loan up to $100,by Aspire Lending Co
March of 2013, Aspire told me to sell my home in *** which sold on
April 9, 2013, Home in *** sold for gross amtof $188,($30,Net to Myself)
May 13, Fannie Mae agreed to sell me a house in *** County for $92,120.00, contract signed, I put $1,Earnest money down
June 1, Loan Codenied the Loan
Final Notes: It took Aspire Lending that long to discover my daughter's child support obligations expiration! I notified them her child support would be extended for college, but that did not matterThe VP (Stephen B***) was the last one who promised a written resolution offer, which he failed to doI have a wiretapped conversation of the VP admitting their Big Mistake:http://youtu.be/-SkslVmUs0w
"The Math" for our Losses:
$100K = am
