Good Afternoon,*** *** joined Assembly Sports Club online on June 29, 2017. *** then came into Assembly Sports and signed all the paperwork for this membership. I have attached the signed membership agreement with all cancellation policies also attached. ***
payments went thru in July and August, but declined for September and her Annual Fee for insufficient funds. *** then came into the club on Oct13th to cancel her membership and it was explained to her that she had to pay her balance due prior to cancellingAssembly Sports had spoken to *** over the phone on Septand Octtelling her about the balance due. She stated she'd be into to pay and cancel. Assembly has a very simple cancel policy, a one week notice prior to the draft date. She also agreed to the Oct1st Annual Fee of $49.99. Please see attached documents for verification of terms. On the last page of my scanned documents I have scanned the bottom of the legal size agreement, so it comes up as upside down. I feel like the situation was no resolved I called in September when my accident happened and let them know they told me I had to come in but they didn't explain that I had a balance due over the phone. Also when I walked in there recently before I walked in to there facility I spoke to the manager letting her know that I couldn't walk due to my car accident and she explained that I could have it in writing as a manager or a general manager if you know a customer has money they owe why wouldn't you explain that over the phone instead of letting them go out there way to come there or write a letter knowing that there is money due. I am sorry but I believe that it should be waived. It is not fair if someone is not using ther facility that they keep charging them for 3 months again it clearly states on there policy if  you can't attend there facility due to your doctor telling you you can't then they cancel your policy but there stating that I can't do that because I owe money that's no fair the policy states it so they should cancel it without putting more money to the account it does. It state that in the back of the contract you can see that it doesn't say you can't cancel if you have a balance in your account. So I think this company is being unfair totally unfair. They told me that I would be charged 130 till November and they will cancel it that's three months of continuing payments that's shouldn't be on my account. so I believe they need to resolve the issue better
