Landscape design/installation project, hardscape project and mulch service in early April 2013. During this project the homeowner decided to substitute/add multiple plants from the original proposal, purchase a few of his own plants for us to instal and simply delete other plants. Upon completion we took into account ALL of the changes and our labor to complete (including the (6) Gaillardia deletions) and issued him a credit in the amount of $271.96 (invoiced as Credit for Cryptomeria & Azalea) as a final invoice towards all the work and plant substitutions initiated by the homeowner. He withheld payment and finally issued us payment on 5/7/3 after making at least (1) warranty claim for plant; which were for the (4) Hino azaleas. As you can see from the contract provided: our warranty states a 12 month; one time replacement of woody plant materials supplied by our company. We have provided a string of emails showing that we honored all claims, kept in full contact with regards to any issues and ultimately agreed to credit for the Gaillardia a second time with the expected mulch installation to happen in 2015, which was never implemented by the homeowner. We explained that (4) Hino azaleas were already replaced and as a gesture we even dropped off an additional Hino azalea in September of 2013 for him to plant himself as suggested in his e-mail. Also. as you can see he was never billed for any Shasta daisies and only supplied him with (6) Gaillardia (blanket flowers). Again, as a gesture we issued him a check in the amount of $39.85 on 5/2/16 to close any remaining issues regarding the perennials which were already credited on 4/22/13 and addressed in the e-mail dated 5/5/15.In our opinion we have properly handled all claims with this customer and find his accusations unwarranted as all issues were resolved.Sincerely,Steve B., President

Customer was provided with all services as per contract which was signed by homeowner.  If any item was not installed it was at the homeowners request and credit was issued for any deleted items by homeowner.  All installations were completed as per industry specifications and...

recommendations at locations approved by homeowner.  To date homeowner has not paid for the services provided even though credits were issued and this has become a legal matter and cannot be discussed further.
