I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me

My experience with Dennis Elliott and Asset Management Directors was a rather disturbing one. After I was served with a "Summons and Complaint" by the City Of Detroit, I realized this operation was nothing but a SCAM!

For several years I had been receiving calls at my business from people wanting to purchase property from me. I would tell them that I did not own any property in the Detroit area at all. They told me the property was listed to my company! This I knew was completely false.

So when I received the "summons and complaint" I realized these events all lead to one person using MY COMPANY NAME! to buy properties. Fortunately I work in the Legal sector and have Attorneys all over the world and in Michigan. I reached out to one of my firms near Detroit and they contacted the Lawyer for the City of Detroit. The "Summons and Complaint" were promptly withdrawn and the suit re-filled against; Dennis Elliott and Asset Management Directors, LLC.

I strongly believe that Mr. Elliott and his people have also perpetrated fraud in their real estate dealings. Mr. Elliott is in need of visit very soon. I'm sure I'm not the only person he has brought undue stress to.

I am rejecting this response because: This business is running a scam and taking advantage of people.  There listings are completely false. Non of the information they provide is accurate. They ask for your card to hold for payments and I didn't see anywhere it said there was a fee. Also I requested to be canceled before the auction was over. I am not in Michigan and therefore had to have someone to check the property out for me. When they informed the information on the site was misleading, was when I requested to be removed from the bidding and my account closed, they have no way for customers to close there account, so I had to email them. They refused to remove me from the bidding and or site, because I was the only bidder and there intention was to take my money.

Regarding complaint # [redacted], a response was submitted on 4/8/14, addressing Mr. [redacted]'s complaint. As previously stated, our system will not allow individuals to register for bidder accounts without first checking a box which confirms that they have read and agree to our Terms of Service, which has a link to the Terms of Service. As stated in the Terms of Service, as well as in every auction listing on the website, A.) all properties are listed "As-Is," with no warranties or representations whatsoever, and B.) it is the bidder's responsibility to complete all due diligence (including inspections) prior to bidding. Mr. [redacted] did not inspect the property prior to bidding, and therefore breached the Terms of Service. Although we list many disclaimers throughout the website, for the purpose of informing bidders of the nature of online real estate auction sales (specifically foreclosures which are sold "as-is"), customer satisfaction is our top priority, and as such, we will pursue new terminology in the listings to help maintain a high level of customer satisfaction. At this time we will be sending Mr. [redacted] half of his money back.

and refused to pay for the property after auction close. Therefore, a "non-paying" bidder fee of $250 was assessed.Our system will not allow a user to register for a bidder account without first checking a box which says "I have read and agree to the terms of service," with a link to the terms of service page. In the terms of service page, the following is stated:"3.3 OTHER RESPONSIBILITIES OF THE BUYER(a) Non-Performing Bidders. All bidders should be aware that they have entered into a legally binding agreement if they place a winning bid on an auction on RealtyBargain.net. Please see our Terms of Service, section 3.3 (b.) “offer and acceptance – binding contract between buyer and Asset Management Directors, LLC.” Every bidder must agree to the Terms of Service before bidding. We take bidder performance very seriously and expect every winning bidder to complete their transaction. We vigorously enforce any violation of policy. A “non-performing” winning bidder will be subject to the following penalties:1. If a deposit was required to bid, your deposit will be forfeited. Bidders are required to have a credit card number on file. Non-performing bidders will be charged a fee of $250.2. For the first “non-performing” offense, you will be permanently suspended from the site."All properties listed on the website are sold "As-Is," and the following disclaimer is included in every auction listing:"The Seller offers these assets for sale in "AS IS" CONDITION AT THE TIME OF SALE OR CLOSING, INCLUDING ANY HIDDEN DEFECTS OF ANY NATURE, KNOWN OR UNKNOWN, with no representations, warranties or guarantees whatsoever, express or implied, relating to the condition of these assets. By bidding on this property, you acknowledge that all statements made by the seller about the condition or market value are subjective, and do not release you from your responsibility to perform due diligence."Although we try to provide as much information as possible for the properties listed, due to the nature of foreclosure sales, we rely on information from county records and online data providers. It is always the bidder's responsibility to complete all due diligence (including inspections) prior to bidding, and this is included in the disclaimers.

Review: The company auction properties online with false information in the description of the properties. I signed up on there website because it came up on my search from a different site and asset management required signing up on there auction site. I read the description of the property and was impressed. Here is the description; "A Gorgeous 3 Bedroom Brick Home with Great Curb Appeal! Rent this property out for $788 / month!* Zillow value of $104,000 in 2008 - with current housing prices at an All Time Low, there will never be a better time to buy than Now! Don't Miss This Opportunity!!"Unfortunately non of that info is accurate, there was no gorgeous house or great curb appeal, instead it was a house stripped down with no windows, doors and damaged walls and roofs, next to bunch of abandoned houses. The picture provided was not accurate either. I was out of town at the time of bidding and could not go verify the house. Had a friend check it out for me, who told me the description was a lie. Requested to withdraw my bid before the auction ended and cancel my account. They refused to remove me and charged me $250 for bidding. Theses people are writing false info and posting fake pictures to take advantage of people. I think they are unethical and are hiding behind legal mambo jumbo to screw people up.Desired Settlement: I would like my $250 refunded back to my account.
