Ms [redacted] was a client of our firm from the end of until the Spring of this yearWe have thoroughly addressed Ms [redacted] ’s complaints with her previouslyIn response, Ms [redacted] proceeded to make a number of slanderous comments on our firm’s Facebook page which we have referred to our attorneys for review and possible actionAt this point Ms [redacted] has caused us to waste a substantial amount of time and effort in addressing her baseless allegationsIn order to put a stop to more wasted time on our part, we are willing to pay her the $she is requesting as a nuisance payment subject to the execution of a settlement, release and non-disparagement agreement that contains a liquidated damages provision of ten times the nuisance payment in the event she violates the agreementThe following are the facts of this matterMs [redacted] is correct that she met with [redacted] on October 27, for the delivery an annuity contract that she had purchased at the end of This meeting was after nearly nine months of our multiple attempts to have her attend such a meeting, which attempts she refusedThis is highly unusual for us as in order to help a client with their retirement planning it is necessary to meet with the client regularlyThe fact is we should have terminated Ms [redacted] as a client when her non-cooperation became apparent to us At this meeting, Ms [redacted] inquired if she could add another $100,to her existing annuity policy [redacted] advised that he would need to look into this possibility but also that he believed it would be in her best interest to purchase a new annuity instead of add to the existing oneIt should be noted that [redacted] could not simply move funds from her investment accounts to her existing annuity contract or a new annuity contractThis would require action on the part of Ms [redacted] to execute documentation both to transfer funds from her investment accounts and to add funds to her existing annuity or complete an application for a new annuitySubsequent to the October 27, meeting, [redacted] became ill and was not able to return to work for approximately weeksTowards the end of this illness, his mother died on December 8th With the sudden turn, [redacted] spent time in California assisting his aging and ill father through the transition and returned home after the Christmas holidaysFrom that time until March of 2016, the client had been in contact with our office regarding a tax matter but never followed up with our office concerning the annuity discussion The client states that there were significant losses from the end of October through April The net decrease of her account including quarters of fees was 2.63% which was an acceptable loss considering the markets had pulled back substantially during that period of time To clarify the client’s concern about fees, all fees were fully disclosed and acknowledged by the client when she opened her accounts and well within industry standardsPlease let us know if the client wishes to accept our nuisance payment offerThank YouPlease note the correct e-mail address for [redacted] is ***@apofinancial.com
