Please see the attached letter from the Board at [redacted] HOA. Please note that this homeowner has painted what appears to be a pumpkin face on his garage door that is in violation of the restrictive covenants. I received the complaint from the board as well as other homeowners in the community....

Dear  Ms. [redacted]:     Certainly  Revdex.com  has experience and knows that in times of dispute some persons may slant the truth to try to present  "non-facts"  as factual.  Persons with honesty and integrity do not do this!  Several statements (labeled with  "STMT:",  below) made in reply to my complaint are non-factual.  They are itemized below followed by true "FACT:"  for, first, a reply from a  [redacted] HOA (WHOA) member, and second, from  "Association Management Group SC, Inc.(AMG)".     None of letters nor e-mails received have addressed anything cited in my original complaint.  No WHOA member, nor has AMG :   - answered my questions and provided requested     information to me, a paying customer; nor,   - withdrawn their allegation of violation, and     refunded dues I paid for their services  ... Additional background information is given in Appendix 1a.     All should be aware of a newly received (21 March) paper mail letter received from AMG, shown in Appendix 1b. Since there are many garage doors in the [redacted] neighborhood that are  _not_  "all white",  this letter from  AMG stating that my garage door  _must_  be "all white"  is inappropriate.     Clearly a judgement about  "acceptable paint on my garage door"  is needed from an impartial arbitrator (such as the Revdex.com).  I invite all to  agree  to  abide  by  a Revdex.com  "binding arbitration"  decision.  This suggestion was made on 01 March; see Appendix 3.  My opinion for my garage door paint is that the  "only option"  is  _not_ "all white".  Until every garage door in the [redacted] neighborhood is made  "all white",  any suggestion that my garage door must be  "all white"  is unfounded.     This section addresses a sole, one and only letter from a  WHOA  member [redacted]) replied to my complaint, which is not completely factual. STMT:  "Mr. [redacted] has received responses to his emails         and voice mails from AMG." FACT:  As shown in  Appendix 2, AMG has not responded        to most questions and requests for information. Effectively none of my e-mails received replies that answered my questions, nor conveyed requested information. No voice mails from AMG have ever been received.  Any and all items in  Appendix 2  can be made available on request - several are here in other appendices. STMT:  "... it appears that Mr. [redacted] doesn’t want        to correct what we feel is a violation of        the covenants." FACT:  Since the start of allegation of violation, I        have indicated cooperation.  As reiterated as shown in Appendix 4,  on  21 February,  it was said:     "If anyone may have specific objections to     my work of art, let them come forward with     suggestions for improvement . . . " No responses about objections nor complaints have ever been received.  No suggestions for improvement were made before  21 March  when a new paper letter was received from AMG. STMT:  "[redacted]    [redacted] Board Member ..." FACT:  Mrs. [redacted] is  _not_  a [redacted] Board Member.        All those who  "pretend"  to represent the Board have not been elected to serve in  2016.  See Appendix 1a and also  Appendix 3.     This section addresses a response from  AMG ([redacted]) per my complaint, which is not completely factual. STMT:  "At AMG, we welcome the opportunity to work to        assist community members ... " FACT:  To date, AMG has not acted to facilitate any        assistance to this community member.  Their bullying and threatening actions have not been appreciated.  AMG needs to act to answer my questions, and respond to my requests for information! STMT:  "... role of the community's elected board        members, who are also community members, to make        a determination if a violation exists." FACT:  WHOA has  _no_  elected board members in 2016.        See  Appendix 1a  and also  Appendix 3. STMT:  "AMG's policy is not to share the names of        persons who report a violation ..." FACT:  Names of persons were not asked to be shared.        However, extrapolating this policy to withhold all information about complaints received is incorrect. Appendix 7  clarified that:      '... no  "strictly confidential"  nor       personal information is being requested ...' AMG continues to ignore my request for information about  _content_  of complaints received. STMT:  "...  Because this is potentially a legal matter        (in the event the door is not brought into        compliance) ..." FACT:  Paint on my garage door has caused no monetary        nor other  damages  to WHOA, AMG, nor to any member of WHOA.  Thus, it is not legitimately a candidate for litigation.  This is another sample of continued bullying and threatening tactics on the part of  AMG  which is not appreciated.  As stated above, I stand ready to comply with an impartial, independent "binding arbitration"  decision that may be forthcoming from the Revdex.com. Cheers     . . . . . .     [redacted].com Support   "wilderness"  -   conserve  nature ! Be  American    -    buy   "Made  in  USA"  !! Stop  organized  crime.    Re-elect  no  one !   -------    Appendix  1a    --------     Other and Additional Background Information     Paint on my garage door paint was applied last summer (Aug 2015), and for about  six  months  was not alleged to be a  "violation".  Existing door paint is wonderful, very tasteful, and matches other trim/accent paint on the rest of my home.  It  _adds_  value to my home, and to the [redacted] neighborhood.  Allegation of violation stems fully from perception of  "dislike"  only in the  _minds_ of those who  "don't like it".  This is a very subjective, personal preference judgement, which any group of persons will view differently.  My personal preference judgement tells me that  "no violation"  exists!  I understand that other members of  WHOA  may have different opinions.  But, no feedback containing any substantive information to help resolve this difference of opinion has been received.     Furthermore, allegation of violation has been made by WHOA members who only  "pretend"  to represent the Board of Directors of WHOA.  All persons who currently  _presume_ to act as the Board have  _not_  been elected to the Board in 2016.  These  "Board Pretenders(BP)"  therefore have no standing to make allegation of violation!  Additionally, all BP are  _ineligible_  for nomination to the Board in 2016, since their consecutive years of service exceed the maximum allowed by the  "BY-LAWS OF [redacted] HOMEOWNERS ASSOCIATION, INC.".   Appendix 3 highlighted to all concerned both of these  direct  violations  of  "BY-LAWS",  but no reply nor comments were ever received.  Being informed of BP violations of  "BY-LAWS",  I am both  dismayed  and  appalled that  AMG  continues to champion allegation that paint on my garage door is a violation of Covenants, since allegation was  _not_  made by anyone who legitimately represents the Board of Directors of WHOA!   -------    Appendix  1b    --------     Text of  AMG  Paper  Letter  dated  March 16, 2016 (this letter was received on  21 Mar 2016) "This letter is to inform you that the architectural committee did review your request to paint the garage door tiles red and the request has been denied.  Please note the architectural committee and the board of directors has reviewed different options and the only approved option would be to paint over the art work with white paint thus restoring the door to its original paint color.  If you have any questions or concerns, please call our office."   -------    Appendix  2    --------     List of Correspondence   -  Paper Mail    Date        Author           Description -----------  ------------   ------------------------------- 08 Feb 2016  [redacted], AMG   Remove  "Halloween Decorations" 23 Feb 2016  [redacted], AMG   Covenants for [redacted] HOA violated 16 Mar 2016  [redacted], AMG   Request denied - Ms. [redacted]:     Thank you for your comments.  I will hope from the tone of your reply that  "cooperation"  is being realized.     You continue to  _allege_  my garage door is a violation of the Covenants.  I will continue to  _allege_  my garage door violates no known Covenant.  This can go on forever! Can we agree to constructively and cooperatively focus on paint on my garage door from now on?     Would you allow me to try to appreciate, and understand, your position?  This can happen if items which were previously posed are given responses.  Excerpted quotes from previous correspondence are listed, one by one, below.     On  21 February,  it was said:       "If anyone may have specific objections to       my work of art, let them come forward with       suggestions for improvement . . . " Would you be so kind, please, to tell me what objections exist, and what are suggestions for improvement?     After  21 February, with no objections being heard and without any suggestions for improvement having been made, do I  now  understand properly that no objections to garage door paint color, or pattern, exist?  Rather, is  allegation  of violation based upon a desired _process_  that was not followed?  Would you be so kind, please, to answer these questions?     On  01 March,  it was stated:       "All those who  _allege_  this Covenant       applies to paint need to justify, and       explain, their reasoning." Would you be so kind, please, to give explanation?     On  01 March,  it was also indicated:       "I am convinced if we all cooperate with        one another, that this matter can be        resolved to everyone's satisfaction . . . Thank you for contacting Association Management Group SC, Inc. (AMG) in reference to the above complaint. At AMG, we welcome the opportunity to work to assist community members. In this case, there is an alleged violation of the subdivision's recorded Covenants. AMG's role is limited to notifying the parties of the alleged violation. It is the role of the community's elected board members, who are also community members, to make a determination if a violation exists. 
 
AMG's policy is not to share the names of persons who report a violation. In many cases we do not record such information, since it is not a relevant fact and in many cases violations are reported to us anonymously. 
 
In this case, AMG has communicated to the homeowner that his Association's board determined his garage door is in violation of the community's Covenants. His Association has asked that he bring the garage door into compliance with the Covenants.
 
AMG is an administrator for the Association. AMG does not decide what is or is not a violation. Because this is potentially a legal matter (in the event the door is not brought into compliance), AMG is not at liberty to discuss any further details.
