Fraudulent taking of escrow funds for an insurance policy taken for a time period in the past.
On August 4, 2017 I purchased a home financed by Assurance Financial. I obtained homeowner's insurance through a company that Assurance obtained a quote from. In late September I was notified that the insurance company was cancelling my policy effective October 2017. At that point I contacted my personal insurance agent and she started looking and obtaining quotes for me on a new policy. As our home is undergoing repairs finding an insurance company willing to insure the home "as is" was a little challenging. On October 31, 2017 Assurance sent out a letter to me advising me that my homeowner's insurance had "expired" (it was cancelled not expired) and that I needed to provide proof of coverage or they plan to buy coverage at my expense. On November 9, 2017 I called Assurance to find out how the process of getting a new insurance company set up with them would work, at which time I gave the name of my proposed new insurance company so they could authorize them in their system and was told to send them a copy of the declarations page when I obtained it. On November 30, 2017 Assurance sent out a "Second and final notice - please provide insurance information," and again stated that they plan to buy coverage and to send in my insurance information. On December 1, 2017, obviously before I even received their "second notice" in the mail, I faxed over proof of my new homeowner's insurance coverage. On January 8, 2018, Assurance sent out another letter entitled "Hazard Insurance Policy Courtesy Notice" advising me that they have purchased a back dated insurance policy for a time period that had already passed and took the money to pay for it out of my escrow account. They attached a copy of the insurance policy that was issued on January 8, 2018 for policy period 10/28/17 until 12/01/17. So on January 8, 2018 they purchased an absolutely useless insurance policy at my cost, despite the fact that I sent proper proof prior to even receipt of their "Second and Final Notice." I sent them a detailed letter on January 24, 2018 outlining my grievance as well as several e-mails to their company, and all I got was a canned response that they can purchase insurance if I do not maintain my insurance. Their warning letters to me were fraudulent because I complied and still was penalized and they took proceeds from my escrow account to pay for useless insurance after the fact. I believe they owe money back to my escrow because they took it fraudulently.

Thank you for the opportunity to respond to your complaint filed through the Revdex.com (CFPB) dated March 16, 2018. You expressed your frustration with having lender-placed hazard insurance purchased on your behalf as well as the letters we sent dated October 31, 2017, and January 8, 2018, regarding the hazard insurance for your property. You stated you believe lender-placed hazard insurance was purchased fraudulently and would like to have the funds purchased for your policy placed back into your escrow account. We have completed our review and our response is indicated below.

Our records indicate your purchased policy with Federal National Insurance Company to be effective from August 7, 2017, through August 7, 2018. However, on September 27, 2017, Federal National Insurance Company generated a letter stating your policy with them would be cancelled effective October 28, 2018 as there was an, "increase in property hazards beyond what is normally accepted." Please contact Federal National Insurance Company directly at 1-337-706-8266 if you have further questions, comments, or concerns regarding the cancellation of your policy. Our records indicate that your current hazard insurance policy is with Anchor Specialty Insurance Company, and this policy is effective from December 1, 2017, through December 1, 2018.

According to Section 5 of your Mortgage, "If Borrower fails to maintain any of the coverages described above including hazard insurance, Lender may obtain insurance coverage, at Lender's option and Borrower's expense, Lender is under no obligation to purchase any particular type or amount of coverage." Please refer to your Mortgage that was signed at closing. Our records do not indicate that you had a valid privately-purchased hazard insurance policy effective from October 28, 2017, through December 1, 2017; therefore, on January 4, 2018, $305.51 was disbursed from your escrow account for payment of a lender-placed hazard insurance policy from October 28, 2017, through December 1, 2017. On October 31, 2017, we generated a letter and sent it to the mailing address on file asking you to provide us with a privately-purchased hazard insurance policy; otherwise, we would purchase a lender-placed hazard insurance policy on your behalf. Since we did not receive this documentation, on January 8, 2018, we generated a letter and sent it to the mailing address on file advising you that the lender-placed policy from October 28, 2017, through December 1, 2018, was purchased on your behalf to protect our mutual interest in the property. We will cancel this lender-placed policy if you can provide us with proof and documentation that you had a privately-purchased hazard insurance policy during this time frame. Please send this documentation to us at one of the following:

Once again this response is a canned quote from the mortgage. Quoting from it and the letters sent "Lender may obtain insurance coverage, at Lender's option and Borrower's expense, Lender is under no obligation to purchase any particular type or amount of coverage." The letter gave First and Second Notices that it "may" place coverage. I was working diligently to find suitable coverage under the impression given by their letters as "warnings" that they would place coverage if I failed to obtain such. Due to the reasons my previous,lender quoted, insurance dropped, I took the time with my insurance agent to find suitable coverage from an insurance company that would not drop me. Nowhere in Assurance's letters did it state they are going to purchase back dated insurance coverage. Only after I obtained new coverage did they send me a courtesy notice of such. This is misleading and a bad faith business practice. My issue has not been resolved.
