[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because:It is simple, the workmanship was horrific and what was agreed on was not donethe work did not correct itself, the issues I have had from the beginning did not get fixedI am not looking for an argument however I am not going to proceed with out the proper stepsI was asked to get estimates on fixing some of the issues which I did and the contractor did not like the estimateNow all of a sudden there are invoices that are attached here? invoice # [redacted] sent on 2/16/was for $11,785.05Arbitration is called for to address the issues Regards, [redacted] ***

In regard to this event- It has been and still remains our responsibility and intent to address this issueThere has been plenty back and forth in regard to the satisfaction of the workmanship over nearly a year if not a year This project has been through the hands of several employees, of which one has been let go in part to do with this instanceAston Black will make this work correct, and it is our intent to do so to the clients satisfactionThe original subcontractor that executed the tile work has fled the areaWe are struggling to find a sub contractor willing to execute a complete tear out of the bathroom in questionI will be in touch with Mr [redacted] once I have a committed contractor of which I am confident of their work, which may satisfy this responsibility Again, We will address this

In this particular instance our services have been exhausted now time after time over a matter of nearly now (6) six years. Multiple actions have been taken of which did correct Mr. [redacted] ***’s initial concern. We have deteriorated much funds in trying to satisfy this case although year after year another similar problem evolves of which we correct or find a solution, much of which is lack of user maintenance. It is our position that Aston Black cannot provide lifetime workmanship or warranties on work. Hence we do have a (1) One year limited workmanship warranty, and also a product warranty both of which Mr. [redacted] has signed. I am rejecting this response because: The actions taken by Aston Black and its agents never corrected the original defect (recurrent leakage thru the ceiling directly underneath the shower) The leakage was noted and the original attempt at repair was within one year, however the leakage has always recurred in the same location after each attempt by Aston Black and/or its agents to repair the original leakThe shower subfloor and the drain have never been inspected by Aston Black or its agentsThis is the first time maintenance has been raised as an issuePrior inspection and repair by Aston Black's agents have never raised concerns about maintenance, and I am unaware of any maintenance that has been neglected I would appreciate learning of the nature of my negligence in this respect We have never had any leakage from any of our other five second floor bathrooms I would be satisfied if the shower subfloor (especially at the impermeable liner seam) could be ascertained to be continent and that the drainage pipe fittings are secure Aston Black and/or its agents have allegedly ascertained that the intake fittings are secureThe damaged ceiling in the underlying living room would also need to be repaired

To Whom It May Concern;Aston Black is currently ready to obtain counsel, for no solution but constant back and forth is leading no whereAge old arguments, that seem to start over at every cornerMultiple trips for multiple
issues have been madeHence then AB was not allowed to address issues, and an estimate was given on behalf of the client to address said issues of which the estimate oddly enough was near the same amount as the final bill. Then we circle back around again and the client wants to start over and look at issues again and re construct the wheelThe work is not sub par, code enforcement passed the job.I have attached the final invoice per contract that is dueThis is an extensive amount of money for a client to hold, or not pay for reasons beyond reasonableIt would deem acceptable if no attempts to satisfy the client were made, to include multiple punch list that were addressed, then added to on multiple occasions. It is also not clear if pictures provided were prior to multiple trips to address issues or notSignificant documentation has been provided that all attempts within reason have been exhausted in order to up hold the contract in place.Thank you

Attached is the time line for Dr***'s service calls on the showerAston Black stands behind their work and have addressed each issue to the customers satisfaction, I'm sorry it had to come to where we are now The comments that were communicated to me concerning Aston Black not installing the the shower floor membrane correctly is disturbing news to me and it sounds like now that insurance companies are involved it will be a waiting gameBest Regards, Mark ABlackFounder/President
