Review: In July, I had submitted an application for an apartment in Aston Woods. I did not have a check for the deposit with me so I told them I would bring one to them in a couple of days when I would be back in town. I was told this was fine and a few days later brought them a deposit check for $99. I was told that I had 2 business days to get a full refund if I decided I didn't want the apartment. I called one day later and told them I wanted the refund and that I would not like the apartment. I was again told that that was fine and that they would send me a refund check in the mail. A month later I hadn't received the check and I called the apartment complex to see what had happened. I was told that someone in the office had held the apartment for me when I put in my application instead of putting me on the wait list like they were supposed to. Because that was done, the 2 day grace period for the check begun that day and not when I wrote the check. No one in the office had informed me of this or I would have never written out the check if I knew I wouldn't have been able to get my money back. Both ladies that I had dealt with assured me that I would be able to get my money back at the time I wrote the check. I have been calling them now for 2 months to speak to someone about getting my money back and no one has responded. When I do get a hold of someone, I am told that the corporate offices are dealing with it and that I will get a follow up call the following week and then I never get a response. I don't believe I should pay for someone else's mistake and would like to resolve this situation as soon as possible.Desired Settlement: I would like the $99 for the deposit check that was written and never refunded

On July 2nd 2013 **. [redacted] submitted both an application and application fee for an apartment home here at Aston Woods. The representative that worked with **. [redacted] submitted the application and asked that **. [redacted] returned with a security deposit. **. [redacted] agreed that she would return within 24hours. The application was approved on July 3rd, 2013. The representative contacted **. [redacted] and informed her that her application was approved and that her deposit was needed. **. [redacted] submitted her deposit days after her approval. A prospective resident would not be place on the wait list if we have the floor plan they desire. The floor plan was available and the apartment was taken off the market for 14 days prior to her withdrawal.

Our company application (Paragraph 7) States the following. “If You Withdraw Before Approval. You and any co-application may withdraw your application or the application deposit if you do so PRIOR to notification of approval of your application for occupancy. If you or any co-applicant withdraws an Application or notifies us that you’ve changed your mind about renting the dwelling unit, PRIOR to notification of approval, you will be entitled to a refund of your application deposits within fifteen (15) days of the date we receive notice of your withdrawal of the application, and the parties will then have no further obligation to each other.” **. [redacted] withdrew her application after notification of approval. This is why she forfeited her $99 deposit.

I have been an outstanding tenant. I have not missed one payment since I have been here (almost 3 years). My apartment was flooded by the third floor tenants washing machine provided by the apartment complex. I am on the first floor. The apartment complex took no responsibility for their equipment that was faulty. I asked the apartment complex to kindly place me in another apartment temporarily until my apartment was fixed and they refused. I had to stay in a hotel and pay out of pocket. After two weeks the apartment was not fixed and the hotel bills were adding up. I was forced under duress to sign a 12 month lease or live on the street. The apartment they moved me in has been known to be broken into and I was not informed. On the first day I moved in my apartment was attempted to get broken into. The toilet was non functional on the day I moved in and was not fixed immediately. I had no restroom for over 24 hours. The apartment appears to have mold. I asked for it to be investigated and removed but my request has been ignored. I keep breaking out into hives, I recently got a fever and also a respiratory infection.There is a beeping noise coming from the maintenance room and I asked for it to be stopped and it has been two months and my request has been ignored. During this entire time I also had the use of only one arm as I recently had surgery on the other. The management staff here are unwilling to help their tenants. This is bad business practice and inhumane to be treated this way. Please make sure to not rent here. You will regret it if you do.
