[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: ***I am rejecting this response because: The last quoted purchase price with the intended buyer at the office of Astro Village was $4,500, therefore $is 1.5% which MrsM*** after refusing to give me a proper receipt for the money taken, knowing fully what it was for, refused to then give me back the money. I am taking it as a mutual consent of contract cancellation in her actions of accepting and keeping the moneyI cannot help that it is only a minor amount but I am following the stipulations in the contract regarding me not adhering to it. As of the complaints on me with breaking the contract in speaking with the proposed buyer, I DID tell him 5,and he then said he would only pay 4,Then I told him everything had to go thru Astro Village. Marci asked me on Octwhat my selling price was and I then told her that I wanted 4,and she said ok if anybody questions the price you are to tell them 5,500. which I DID. The proposed buyer was willing to pay my asking price of 4,and no more, Astro Village did not find this buyer he approached me, and I was not going to amend my contract to accept the 3,for Astro to have their profit of 1, In the contract it states anything above 4,Astro can take their commission and anything over that is split equally between usHence why they wanted me to sign an addendum to the contract price so they get their profit. December 4, 2014Dear [redacted],This letter is in response to the rejected response to complaint #[redacted] filed with your office by [redacted] is not reading and abiding by the listing contract as a whole. She is just picking out bits and pieces.Please refer to the original contact we had with her where she only wanted $2,000 - $2,500 for the home.[redacted] negotiated accepting a lower than the advertised price for the home, which is against the contract that she signed. Item 8 of the listing contract, states that if a sale or exchange is made or a purchaser procured therefore by Astro Village Listing Service or herself, at the price or upon the terms specified herein, or at any other terms and price accepted by me during the life of this contract (or within three (3) months after the termination of this contract, to anyone with whom Astro Listing Service negotiated or discussed the sale during the life of the contract and whose name was filed with [redacted] in writing. [redacted] agrees to pay Astro Village Listing Service a commission o: $1,000.If she refers to item 10 it clearly states that during the term of the contract, she would not lease, rent, sell or negotiate for the sale of said Manufactured Home, except through Astro Village Listing Service nor would she give any broker, firm or other person authority to sell, or negotiate for sale of said Manufactured Home. Also that she agrees to refer to Astro Village Listing Service all inquiries received concerning the sale of said Manufactured Home.[redacted] did in fact negotiate the price and neglected to include our commission when doing so. Since she has indicated in writing on several occasions that she was willing to reduce the price to $4,500, then her asking price should have been reduced to $3,500. She was informed that she ??! have to sign paperwork to that affect. However, when she arrived at my office to sign, she refused to sign the price reduction. Under no circumstances would I have received “a profit of $1,000.” due to the expenses involved prior to her breaching the contract but also the time and effort I have in responding to + complaint.Again, it was not mutually agreed to terminate the listing contract since we had several prospective buyers and I informed [redacted] that I was not willing to terminate the contract several times on the phone. She indicated that she would not leave my office without a receipt which is why I gave her a blank receipt indicating that the contract was not cancelled or voided.As instructed by the Revdex.com, I have not included any personal information that referred to the prospective buyer. I am rejecting this response because:  As stated, I, on several attempts came asking to cancel the contract before it really got much further in the sale process.  I was denied due to the questions being asked about the mobile home and the 1 inquire about it that seemed to be legit after the showing.  However, I followed the contract in paying the 1.5% for not adhering to the contract which to no fault of my own, is $67.50.  The gentleman in the office was going to pay $4,500, that is the last quoted sales price and 1.5% of that is $67.50.  Which was kept knowing what the intentions were, after I asked for the return due to a proper receipt not being furnished.  So on actions of the listing agent taking and keeping the 1.5% contract cancellation fee is considered by me a mutual consent.
