In following Hawaii’s Landlord Tenant Code – Section 70(e) Tenant Quits Before Occupancy - Section 70(e)If the tenant changes his or her mind about taking the unit before moving in, the tenant shall be liable to the landlord for the lesser of the following amounts: A All monies deposited with the landlord;B One month's rent at the rate agreed upon in the rental agreement;C The daily rent for the period necessary to re-rent the dwelling, plus the difference between the rent agreed to in the rental agreement and the fair rental value, plus reasonable cost and commission Due to all the communication via text and email with [redacted] **, we never doubted his sincere intention to rent the unitIn fact, we informed others that were interested that we had taken a depositFor us, this is not personal – we are not upset about this – it’s just business for usWe are doing our job for the homeowners and following the landlord-tenant code to be fair to both partiesWe have diligently called back people who expressed interest in the unit and were able to show the unit Sunday May to six rental prospectsWe are are showing the unit again today, June 1stWe work very hard and hope to find a qualified tenant soon – for both [redacted] and for our homeowner’s sakeWe are very good at what we do and I expect that we will have this unit rented soon [redacted] Principal Broker At Home Hawaii

I was alerted to yet another Revdex.com comment after I called you
this morning on June 2nd
I want to note that I find it unreasonable that you filed this original
complaint at 3:a.mon May before
even checking with us June 1st to see if we possibly rented the unit to an
applicant, in which case you would have gotten a full refund with no problem
You are demanding an immediate refund or you threaten to
take up this issue with multiple agencies in hopes that it will resolve in your
favorYou clearly misunderstand how a
deposit for a rental unit is handled or you
hope to resolve the issue by threatening our livlihood So despite
our efforts to be fair to you - you wish to
cause harm
This morning I explained to you that this is not my money to refund
to you - this is money that would be dispersed to the condo ownerWe must
hold it until the unit is re-rented, because a portion is likely to be refunded
back to youCurrently the money sits in our client-trust account - we
cannot even consider refunding it without written permission from our ownersThey do have
every right to hold the deposit until the unit is re-rented and they have the
right to charge you a daily rate for the days that it sits unrented from June
1st until we are able to place a tenantPlease, bear in mind - it is only June
2ndYou have not given us much time to re-rent the unit to see what your actual
loss would beI find this behavior to be beyond unreasonable
I consulted a Real Estate Attorney and with the Landlord Tenant
Code office and both agree you should not expect to get your entire deposit
back (if any)You'll note that the Landlord Tenant code does NOT specify
anything must be signed regarding a deposit - that is our policy of EXTRA
diligence to ensure people understandWhether our holding deposit form was signed or not -
your intentions were made clear to us by your communication and by your action
of providing a deposit to usAs the saying goes,
"Money Talks."

very quicklyWe have it in writing via text that you wanted to start the lease
June 1st & that you were scheduling your movers And then you simply
changed your mindYou are entitled to change your mind, but what exactly did
you think a "holding deposit" was for? Why would we hold the unit if
someone can change their mind and get the deposit returned? That doesn't make sense
Although your change of heart came quickly - it came at a crucial time when
people are scrambling to rent by the 1st of the month, making decisions and
putting down deposits - just as you wereWe actually had a flurry of people
who wanted to see the unit at the end of the month and once your deposit was
received, we told several callers that we had taken a deposit Now we are
left without a renter on the 1st of June and we are working extra hard to find
someone who is looking to move mid-month
The fact that you reported us to the Revdex.com before even checking on
the status of the rental and now are threatening us with bad reports to RICO
and HBR, has made us question if we should make any efforts to resolve this
as you wishYou hopefully understand that our actions are on behalf of our
owner and not for our own gainThey feel quite bad about your threatening our
professional reputation when we are simply following the landlord-tenant code
on their behalfAt this point, we are concerned that you
will continue to disparage our business further - even if we give your
deposit back in fullOur attorney advises us that if we are to consider making
this refund to you (simply to stop you from tying up our time defending our
business actions and harming our reputation) that we should have you sign some
kind of agreement he can draw up in which you would agree to rescind your Revdex.com
complaint (if that is possible) along
with an understanding that you would not disparage our company name further in
any way via any medium
As I explained to you this morning, the owners of the condo unit are quite
sympathetic to us, so they may in fact agree to a full refund, if you are
willing to sign such a documentWe have
asked a real estate attorney to draw up something for us and if it is
acceptable to you and our owners are in agreement, we would like to resolve
this with you by the end of the weekAlthough we do not appreciate in any way
your heavy handed & threatening tactics to get your deposit back, after you
simply changed your mind about wanting the rent the unit

We work very hard and hope to find a qualified tenant soon – for both [redacted] and for our homeowner’s sake. We are very good at what we do and I expect that we will have this unit rented soon.
