Re: ID [redacted] Complaint [redacted] ***, I received your letter regarding the complaint filed by a [redacted] ***In regards to her vehicle being towed, from a parking lot in downtown Cincinnati area, that was either a meter lot or private parkingAil parking lots downtown Cincinnati, Ohio are paid parking, Metered Lots, Private Parking and/or Parking Meters on the streetThis is an unfortunate situation and in our industry, our customers aren't very pleased with our BusinessI can assure this, our Tow Truck Driver's do not just randomly impound vehicles, our drivers are highly trained, skilled, licensed, insured and they do take precautionary measures, to protect themselves and the Company, such as photo's, recordings , along with a complaint sheet filed internally with the companyAny documents, recordings, and/or photosAt no time will these be dispersed to any person/persons, unless on the advice of our Attorney'sWith that being said in this particular situation, if the above person parked in a meter lot or private parking, our drivers are called in to remove all parking violatorsAYS drivers impound all contracted lots everyday of every shift, and unfortunely a customer may have to wait their turn in line, which can take up to an hour or moreDepending upon how many person/persons are in request of their vehicleAll impound releases are done in the manner at which they are called inSo it is unfortunate this particular individual had to wait or so minutes to redeem their vehicle, AYS strives very hard to be as quick and prompt as possible [redacted] Office Manager At Your Service Towing [redacted]

However, when I requested said photos or recordings (in accordance with Ohio law), the driver not only refused to produce them to me, he refused to confirm whether he had taken them at all, and repeatedly told me that he is not required to(Again, Ohio law is clear that the photos should be taken, and must be turned over upon request) The business's response goes on in a similarly indecipherable manner - "Any documents, recordings and/or photosAt no time will these be dispersed to any person/persons, unless on the advice of our Attorney'sWith that being said in this particular situation, if the person parked in a meter lot or private parking, our drivers are called in to remove all parking violators." Again, not only does this make NO SENSE, it completely fails to comply with Ohio law The last paragraph of the "response" fails to address the rest of my complaint at allI did complain that the wait was long, but I was far more concerned that the driver refused to answer my calls or give me an estimated time of arrivalAs a young female alone on the streets of downtown Cincinnati with a dying cell phone battery, I did not feel safe, and was simply trying to find out how long it would be before I could be safely back in my carI absolutely dispute that anyone within the company could be considered "highly trained" or professional in any wayWhen the driver finally DID show up, I was given access to my car without any more identification than my driver's license, which the driver did not even bother to look atOhio law requires “presentation of proof of ownership, which may be evidenced by a certificate of title to the vehicle, a certificate of registration for the motor vehicle, or a lease agreement.” ORC 4513.601(G)(1)a)Your company did not require or even request any proof of ownershipThe owner of any towing service or storage facility or property owner that violates the above referenced statute is guilty of a minor misdemeanorORC 4513.601(J) The driver blew smoke in my face, was rude to me, and released my car to me after overcharging me and in violation of the lawI paid $in fees to retrieve the vehicle that the company improperly towedPer Ohio law, the maximum allowed to be charged was $“The owner or lienholder of a vehicle that is removed may reclaim it upon payment of the following fees: not more than ninety dollars for the removal of the vehicle; and not more than twelve dollars per twenty-four-hour period for the storage of the vehicle.” ORC 4513.601(G)(1)(b)Regards, [redacted] ***

I am responding to a complaint filed by *** *** on 10-21-15. He was upset with a time frame of picking his impounded vehicle.I personally ( *** *** Office Manager spoke with this gentleman on this dateHe did indeed call and leave a voicemail message at10am, and I did return
his call at 2pm that same day, I came into the office at that timeI called *** to let him know our address andthe fee's*** wanted me to take our payment in Pizza's, I explained not possibleI also told him I would be in the office until5pm, But if he needed a different time all he had to do was call our number and our night driver would meet him at the lot to recover hisvehicle, that our company is open 24/for impounds*** wasn't very happy at all, one that I wouldn't take pizza's for payment, Hewas very nasty with meI had to tell him several times, that he could come when he could, but he would have to call our main number, for ourdriver to meet himI told him to have a nice day and his Fee's.There is no action I can take, I will not ever take food for payment, Our company is open 24/for impounded vehicles

Depending upon how many person/persons are in request of their vehicle. All impound releases are done in the manner at which they are called in. I paid $109.00 in fees to retrieve the vehicle that the company improperly towed. Per Ohio law, the maximum allowed to be charged was $102.00. “The owner or lienholder of a vehicle that is removed…may reclaim it upon…payment of the following fees: not more than ninety dollars for the removal of the vehicle; and not more than twelve dollars per twenty-four-hour period for the storage of the vehicle.” ORC 4513.601(G)(1)(b).
