Review: Dear Revdex.com,My wife and I purchased our dream home on April 12, 2013. We got a phone call from Atlantic Propane gas company on April 16, 2013. and he([redacted]) told us that his company delivered propane gas to our new home on April 12, 2013 and ask us to pay the bill. We simply noted thank him and send us bill to pay. Next day, my wife and I found it out from listing real estate office, they got the same bill as ours. The Listing Broker told us that they refused to pay this bill, due to been advised Atlantic Propane no services or deliver gas, but they delivered on April 5 anyway, and omitted this last bill in the amount of $325.26 on settlement date for seller.That's why Atlantic Propane company asked us to pay, but we told them we can not help this bill due to following reasons: 1) Atlantic Propane company lied about their propane gas delivery date to April 12, 2013 instead of April 5, 2013(we provided them with an original computer working order bill).2) We purchase the home and all the appurtenances on April 12, 2013. The under Common Law of Real Property the tank is belongs to the propane company, but the propane gas belongs to a new home purchaser(s).3) Fixtures and personal Property (#7. R-10): (A) INCLUDED in this sale are all existing items permanently installed in the Property, free of liens, and other items including plumbing; heating; radiator covers;. garage door openers and transmitters; plantings and trees; any remaining heating oil and cooking fuels stored on the Property at the time of settlement;Finally, we switched to new propane gas company and Atlantic propane company took their gas tank with a little over 50 gallons of propane gas.More over, we are still getting this bill with interests to pay. They have been threted us if we don't pay then they are going file with a magistrate action. Now, they want to forward this to collections agency.Please advise.Thank you so much for your help[redacted]Desired Settlement: First, Atlantic Propane Company took their tank with our +50 gallons of gas. We would like to ask them to pay $97.50 = $1.95/ per gallon x 50 gallons.Second, Atlantic Propane company remove our names and address with this bill or their company profile forever.Thank you.

To Whom It May Concern,
Prior to **. and [redacted] purchasing this house, the gas was being handled by [redacted] at [redacted] had the account set up for “automatic” delivery; “automatic” means that when the tank is low our delivery driver will stop on his route and fill the tank for the customer.
Apparently the home was sold to **. and [redacted] without notifying our office. Our final delivery, prior to the [redacted]’s owning the property, was on April 5, 2013. According to the [redacted]’s, this date was prior to closing on the property.
**. and [redacted] have alleged that our employee [redacted] lied to them about our final delivery to the property prior to them becoming owners. This is simply untrue and quite honestly irrelevant. Both [redacted] and I spoke with [redacted] and offered to come pump out the gas if she didn’t want it, and thus, would have been able to credit her account and nobody would owe anyone anything.
However, [redacted] refused to let us on her property and insisted she planned on using our gas and not paying for it. She continued to insist that [redacted] was liable for this gas because the delivery was made prior to her and her husband purchasing the property. I advised that would be an issue she would have to take up with **. [redacted] because the account was now in her name and she was the one renting our tank and in possession of our gas. If she felt she needed to be indemnified for this transaction, she should seek that avenue with [redacted], as he is the person who had the account on automatic deliver and who drafted the contract for the sale of the property.
If the contract states that all propane on the premises at time of sale would be seller’s responsibility, then **. [redacted] likely owes [redacted] the money. But being that she is in possession of our tank and plans to used (or already used) the gas we delivered, we have every right to seek collection from her. It is her duty to bring in any alleged third parties that owe her a duty of care.

I am rejecting this response because:because according to Common Law of real property, the tank
is belongs to the propane company, but the propane gas belong to homeowner. We purchase the home and all the
appurtenances on April 12, 2013. Therefore, Atlantic Propane Company/[redacted]/**. [redacted] should know we never had a contract or agreement with them or we never had use
their propane gas, but it was in our property when we purchased home, which the Real Estate Law supports
that #7, R-10(A) “INCLUDED in this sale are all
existing items permanently installed in the Property, free of liens, and other
items including plumbing; heating; radiator covers;…….; any remaining heating
oil and cooking fuels stored on the Property at the time of settlement.”
According to [redacted], he called Atlantic Propane Company
and told Atlantic propane to stop gas delivery current our property even before
April 5, 2013. Atlantic Propane
delivered propane gas anyway and omitted this final bill to get paid from [redacted] or previous home-owner after “Settlement” date on April 12, 2013.
Of course, Atlantic Propane sent this 1st bill to
[redacted](broker/property management), but he refused to pay it, because
Atlantic Propane Company delivered gas after he notified and asked Atlantic
Propane for final bills/payments toward “Settlement” date, but Atlantic Propane
never included this bill(I found it from [redacted] and his accounting record).
As a results, Atlantic Propane Company continue sent this
bill to us to pay. My husband and I were basically no idea what was happened
before, when [redacted](Sales stuff of Atlantic Propane) called my cell phone on April
16, 2013 and [redacted] asked about our new home and [redacted] told me that they delivered
propane gas to our new property on April 12, 2013 as same date as our new home
“Settlement” date. At first time,
I was so glad that they took care propane gas for us even without our
permission or contract. I simply thanked [redacted] and requested bill to pay.
On April 18, 2013, I stopped [redacted]’s Real Estate Office
to obtain our new home’s spare keys and utilities information on our new
property. Then [redacted]
mentioned about Atlantic Propane Gas bill on our new property and he showed it
to me original ticket/bill from Atlantic Propane gas deliverer’s name, time
& date. I was so surprised when I found out it was same bill as Atlantic
Propane’s stuff [redacted] told me about it, they delivered it on April 12, 2013. I truly believed [redacted]’s words, even we
wondered that why we couldn’t find an original/printed bill they usually put it
on doors). I thought it bowled out somewhere by wind, until [redacted]e kept
it and showed it to me.
After a while, I drove back home and called Atlantic
Propane, [redacted] answered phone I asked him again about date of deliver propane gas
date, he sounded realize my voice of tone, and he dined everything he talked
about date of delivery propane gas to our new home. So I asked for manager or superior, which “[redacted]”
picked up phone and she told me we have to pay and she said “nobody gets free
gas, if you don’t pay it, I will send the gas deliver to pump out the gas.” It
was nightmare, we just brought new home, there was so many things to taking
care stuffs, we really do not need this painful experience and stressful feels
to my stomach sick and aggravations when I hear from Atlantic Propane.
I told Atlantic Propane’s Attorney **. [redacted] & CEO, this
is not about money, we want our rights and true. Is this right way to do Better Business with customer? In
our case, there is no way to trust Atlantic Propane. Period!
Furthermore, Atlantic Propane’s Attorney **. [redacted] called
me on April 18, 2013 after I spoke with [redacted] and **. [redacted], **. [redacted] Said, “you’re right and my apologies. I will advise my client to contact [redacted] or previous home owner.” Really? For a couple months later, **. [redacted] changed his mind and he
emailed me on September 17, 2013, if you don’t pay this bill, he is going to
suggest Atlantic Propane file an action with the local magistrate. I’m not an attorney, but this is
threatened.
On October 28, 2013, **. [redacted] emailed me again, his client now (Atlantic Propane Gas Company) want to
forward this bill to collection agency. Which my husband’s credit going to
hurts, and he didn’t do anything wrong. I told **. [redacted] to contact our
Attorney for several times and I provided all information about my attorney,
but **. [redacted] never had contact our attorney, and continue to sending harassment
emails and bill that we are nothing to do with it. Please be advised and help! Thank you!
