ATC Fitness should be sued for false advertisement. They run ads on the radio stating that there is no contract... No commitment they say. I quit going back in November and dang if I don't start receiving letters and phone calls saying I owe them money. Luckily I had changed my checking account before I quit going. After reading reviews looks like I'm not the only one that is getting this harassment. ATC should be more specific in their details. False advertisement I say!!!

False advertisement I say!!!

I canceled my membership in March of this year. I have still been charged 27.84 per month since then. I want to be reimbursed. I moved from [redacted] in March of 2015. I was paying 27.84 per month for a gym membership at ATC Fitness. I faxed in the information as requested in order to cancel, but I have apparently been charged every month since then. The last time I used the facility was March 14, the automatic deduction pulled from my account on the 15th of every month, so a total of 139.20 has been takentered from my account for services that I have not used as I am three hours away from that facility now. I did my part and faxed the I formation they needed to cancel my account, I just want to be reimbursed and have no more deductions made from my account. Desired SettlementI just want to be refunded 139.20 for services that were not used after they were canceled. Business Response Our cancellation policy clearly states that the member must send an email in to cancel the membership. The email needs to be sent to [redacted]@abc[redacted].com . At this time we do not have a recorded email from Mr. [redacted]. If he can present that email to us that he sent in March then we will be able to move forward. If he would like to speak to someone at abc [redacted] directly on the issue, he can. Their number is XXXX-XXX-XXXX. They handle all of our cancellations. Consumer Response This company has continually deducted funds from my account illegally for a year now totaling $334.08This is my SECOND complaint against this company! I cancelled my gym membership with them LAST March when I moved 300 miles away from them. They continued to deduct $27.84 from my account monthly. I caught this several months later and filed a complaint wanting my money back and it was never resolved. Now, exactly a year later, I have found that they have STILL been taking money from my account! They have now stolen $334.08 from me and this is the LAST effort I am making to make them STOP and issue me a REFUND before I bring an attorney into the situation. STOP TAKING MONEY FROM MY ACCOUNT I CANCELLED MY MEMBERSHIP WITH YOU IS A YEAR AGO AND I HAVEN'T USED YOUR SERVICES SINCE! The response was derived directly from the billing companies notes. I was able to go back and look at Mr. [redacted]'s response to the Revdex.com filing. He has shown scans and or pictures where he had correspondence with [redacted]. Please refer Mr. [redacted] directly to [redacted]. In no way should a Revdex.com complaint of this matter be directed at ATC fitness at this point. If he has that correspondence showing where [redacted] was to cancel his account, and they did not, then this is a situation between Mr. [redacted] and [redacted]. Not a Revdex.com involving ATC fitness.

I purchased an Elliptical machine on 12-11-2014 from ATC fitness for 500.00. The machine comes with a HD TV. [redacted] was very kind to send their maintenance person to my home to fix it. He did not have the right tools to fix the machine and was supposed to return the next day. Well, it is going on 2 months and he has never been back to my house to fix the machine. I have been in contact with [redacted] and she states that they are trying to get a remote from the manufacturer. As a consumer, I don't think it would take 2 months to get this piece in to fix the machine. I am very disappointed because I was looking forward to using this machine. I paid a moving company $150.00 to get this home- money wasted!Desired SettlementI am asking for a refund of $500.00 cash and for them to pick up the machine as soon as possible.Business Response Revdex.com, Thank you for notifying me on this case. However, I do not feel that the Revdex.com website is the forum for this situation. I feel that Mrs. [redacted] should have followed up again with either Ms. [redacted] or the (third party) maintenance man to get a second update on the situation. I called and left him a message and still have not heard from him. So, I have tried contacting everyone involved several times. I did not want to use this option but how many times is a no call no show acceptable?Final Business Response To my knowledge, a new appointment has been made for this week. Due to the weather we experienced early last week the transaction was not able to take place. We should all be on the same page now.

I can't use ATC because of health issuesI joined ATC Fitness and know they told me it had to be a 30 notice to quit. I can understand someone having to pay the extra month just because they don't want to go there anymore but I went to ATC Fitness on [redacted] Road today and spoke with the manager [redacted] I explained I need to stop now without the 30 day notice because my health will not allow it and I have only used the place like 2 times. He refused and said my 30 notice to stop would have to start today and I would still be charged one more month. he didn't care one bit, nor did he have a big enough heart to help someone with bad medical conditions out. I asked how to contact the owner and he only gave me his name. [redacted] but no way to contact him. He gave me the district managers name and number who is [redacted] but never got a call back from himDesired SettlementPlease do not charge me the last month because I am not medically able to use your facilityBusiness Response Revdex.com, Mr. [redacted] was contacted during the midst of his post to your site. As stated in other Revdex.com cases involving cancellation, we get multiple cancellations per month; Mr. [redacted] feels that because of his medical condition that his cancellation should be handled differently. He makes this statement though he states, "I can understand someone having to pay the extra month just because they don't want to go there anymore". At that point, there are no buts. We stated the cancellation policy to him at the time of signing as well as the time of cancellation. When we reached Mr. [redacted], we also explained that many of the cancellations we receive each month include members that could be in a very similar situation but that they understand the policy. He stated that he did not care about anyone else and that we are just in it for the money. ATC is here to provide a service, and when you do not want that service any longer, you may cancel it using our policy. We were then hung up on to end the phone call. I would like to add that Mr. [redacted] did an excellent job of following direction on "how" to cancel. I was also told $10 was being knocked off that never was. Like I said before, these people DO NOT CARE if you have a medical condition. They only want your money. They would not cared if you died, they would still go after your last payment. I have made my comments all over the internet and will continue to do so on a daily basisFinal Business Response Revdex.com, I'm sure that Mr. [redacted] could go on and on about the 20 other past members we had that did not simply want to follow the cancellation policy like himself. The ATC Fitness cancellation policy IS the most transparent and easy to perform cancellation in the industry. He stated in his first statement that he understood that it was in fact that easy. The $10 he claims he should have had off of his last payment was just a suggestion of a way we could help him by lowering his membership down to the basic type membership which would be $10 less on his last payment. When we suggested to him that we could help him in that way, he seemed to refused the good gesture due to the attitude he displayed. We now know that he wasn't even listening since he seems to have mis-heard what we said. I have since noticed that Mr. [redacted]'s last payment of $27.71 in fact did NOT get drafted out of his account because it seems that he removed his billing info so the last draft could not take place. So at this point there is no money to even return to Mr. [redacted]. I would like to add that since his account could not collect the last payment, his cancellation is still pending. While it is pending he is accruing late fees and service charges that I do not control. After 90 days, his account will be turned over to collections and at that point, the entire situation is out of my hands. The only solution I have is for Mr. [redacted] to contact [redacted] and make his final payment so he does not go into collections. They can be reached at X-XXX-XXX-XXXX

ATC fitness falsely advertised that they would be opening a new location close to me. I enrolled and was then informed that no such location existed. It was advertised that ATC fitness would be putting a new facility in my hometown of Oakland. I went to the facility in Bartlett to enroll and asked if when the Oakland location opened if I could move my membership there. I was told that the movement wouldnt be a problem. After four months I later learned that ATC wouldnt be opening in Oakland. I then cancelled my membership and stopped going. They continued to attempt to bill me after that fact, and have since as ent my account to a collection agency. ATC fitness falsely advertised their "new Oakland" location to increase their memberships but had no actual intention of opening said location. Desired SettlementTake my "account" out of collections close the account with a zero balance.Business Response Revdex.com, When ATC advertised that we would be opening in Oakland Tn, we were actively persuing a piece of real estate in the town of Oakland. We were confident that the space we had picked out as well as the aggrements that had already been made would come to fruition. Unfortunetly the agreements that we made did not come through. At that time, we ceased all marketing directed toward that location. At no time were we bluffing or trying to wrangle people into joining by using that marketing as bait. I would like to point out that ATC Fitness has one of the easiest cancellation policies in the fitness industry. We simply require an email stating that the member wants to start the 30 day cancellation notice. After those 30 days, the member will have no more payments or access to the gym. Mrs. [redacted] currently has a balance of $101.21 owed to the collection agency. I would like to point out that she was perfect pay until October of 2014. I also checked in the notes and Mrs. [redacted] was left numerous messages and sent mail to try and collect before being turned over to collections. Mrs. [redacted] is responsible for the past due amount owed to the collection agency. As far as her membership, since it is in Collections, she is considered cancelled. The number to the Collection agency is (XXX)XXX-XXXX if Mrs. [redacted] needs it. Thank you

An employee was EXTREMELY rude.On March, 22, 2016, [redacted] stormed out the side door as I was attempting to park my vehicle and was RUDE. He said I was double parked and I did not have a problem moving my vehicle. However, I did have a problem with the confrontational and combative tone in which he spoke to me. Also with the fact that he met me outside. There is a way to do ANYTHING and I'm a PAYING customer. I called Mr. [redacted], his superior, and described what happened to him and the ONLY thing he had to offer was EXCUSES; TOTALLY unacceptable. I also sent two emails to [redacted]@atc-fitness.com and never received a response.Desired SettlementI no longer feel comfortable there so I would like to cancel my membership immediately, not in 30 days.Business Response Revdex.com, Mrs. [redacted] is wanting to leave ATC Fitness on her own accord. In this case she is going to have to follow the policy of cancellation. About the above story, this isn't the first time Mrs. [redacted] has been approached about double parking in the parking lot. She seemed to not want to comply that time either. As far as speaking to Mr. [redacted], he assured Mrs. [redacted] that he would speak to [redacted] about his style of approach, which he did. The reason Mrs. [redacted] was not contacted was because anyone else that she would have been able to talk to would have said the same thing Mr. [redacted] said. She would have been told that [redacted] would be spoken to about his approach and she also would have been asked to not double park in the future. To complete cancellation, please send an email to [redacted]@abcfinancial.com . Plese include your name and your agreement number which is XXXX-XXXXX. Once this email has been sent in, you will recieve an email in return saying that it has been recieved. As far as ATC is concerned, we are sorry that you feel that cancellation is the only solution to this situation. The party that you stated you had a problem with has been sat down and talked to about the way the customer service interaction took place. We still however, feel that you should not double park in the parking lot. The city requires retail places to have these lines. First and foremost, this was the FIRST time I was approached. That is a COMPLETE and utter LIE. Secondly, Mr. [redacted] did NOT assure me that he would speak to [redacted]. That's a LIE, too. Parking slightly over the line in a Parking Space should not have caused an employee to storm out the business and rudely, combatively, confront a PAYING customer. Thanks for the info but I've already sent the cancellation notice to [redacted] and will encourage anyone who is looking for a gym to visit [redacted]. NO one should have to encounter what I did at ATC Fitness [redacted]. Then to justify the behavior with LIES is unethical.

I have spoken to both ABC and ATC and both are referring me to the previous in order to cancel my account. At this point, I am also attached the Revdex.com to this email in the hopes that they can help expedite this process. I still wish to cancel my account but I am unable to do so as no one from either company is will to work with me. Final Business Response I'm not quite sure why this complaint is still open. Mrs. [redacted] completed her cancellation correctly with an email she sent in on Dec 31st. Since the beginning there has been no desired resolution. I assume that the ultimate resolution was to be cancelled. That has been completed. Have a good summer.Final Consumer Response (The consumer indicated he/she ACCEPTED the response from the business.)I will make sure I spread the news that ATC is incredibly horrible to work with and their customer service is lacking. Whomever is on the end of this answer needs to check their attitude. At this point, I am truly disgusted by the lack of help I received. The complaint was still open due to the fact that I received NO confirmation that the cancellation was complete. I was in the middle of a [redacted] with no end as it appears ATC officials cannot read or do not care to check details within emails. How sad... The desired resolution (as can be seen above in previous emails) was to receive a CONFIRMATION EMAIL that my service at ATC had been suspended. I received no such email and instead, had to monitor my bank account to ensure no further transactions were made.Have a fantastic Spring (as this is the current season).
