This shop was contacted to provide diagnose on our truck repairs. The shop did not provide a diagnose with projected estimated costs on the truck. Instead, the shop contact person Brian C. decided to proceed with repairs done on the truck without giving formal notification to me as the Owner and decided to proceed with repairs. He provided an invoice for total cost of repairs when they have already been done and demanded full payment. Jr. the technician was put on the phone to explain the issues on the truck and said the truck was drivable be he said he could not confirm if the truck was functional because he said other major issues were found on the truck. We asked for them to allow us to put partial payment towards the bill and allow us to ensure the vehicle was functional by allowing us to load the truck with material in the dump so that we could see if the truck was functional again.And we would pay the remaining balance if they were to put in writing the warranty of the functionality of the repairs that were done. They seemed to have a problem standing behind warranty on the repairs and demanded full payment for the truck and could not guanratee the truck would be functional after leaving the shop but they wanted full payment without standing behind the warranty on the repairs they did. They decided to proceed with repairs without first giving us formal notice on the cost for said repairs and they are now making proceedings to execute mechanic's lien instead of trying to make things right on their end.

I am responding to your letter dated March 24, 2020. Unfortunately, we did not receive the original letter that you referenced in your call last week.

On January 22, 2020 at 10:35 am we received a call from *** & *** from *** regarding their 2008 *** dump truck. The vehicle would not start and would not run and they both expressed extreme frustration with the service she received from a previous shop that recently charged her over $5,000.000 for the replacement of fuel injectors.

After she and her husband explained the issues they were having with the truck and after they made it clear they were not taking it back to the shop because they felt the other shop didn't know what they were doing we discussed towing the vehicle to our shop and our recommended steps to properly repairing her truck:. It was nice meeting you and *** by phone this morning.

As promised, we have dispatched our tow company (Past & Present Towing Company) to pick up your truck. As previously discussed, I recommend the following approach: 1) Check all fluid levels & leaks

2) Top off all fluids

3) Steam Clean Engine

4) Pressure Test Cooling System - determine source of the loss of antifreeze

5) Scan the Engine for Codes (Active & History Codes)

6) Fluid Samples - take engine oil sample & send to lab (recommend sending transmission & rear differential at same time)

7) Troubleshoot Loss of Power Issue & advise customer with recommendations

8) PM Service - change oil, filters, fuel filters, heavy lubrication, visual inspection (see attached PM Inspection Form for details)

Once we have the above information, we will propose next steps & recommendations,

Please send over any and all recent maintenance & repair history so that we can see what has been done. I have attached a form for you to fill out and return to my attention as well as a brief PDF with information about our company. On January 23rd, we received a completed Customer information Form (see attached) as well as a copy of the recent repairs performed by *** in Bladensburg Maryland. We explained that we would not be able to properly evaluate the issue with her vehicle until the (8) items outlined in the previous email were complete. The vehicle showed signs of lacking basic maintenance (fluid leaks - oil and coolant had been leaking for a long time, confirmed with customer that oil & filters were overdue for changing, coolant was leaking on the ground, check engine light was ON etc.) We discussed (via speakerphone with my technician & service advisor on the calls) the importance of taking care of the overdue maintenance & basic items identified prior to diagnosing the loss of power issue. The anticipated costs to perform the above repairs (including the towing of the vehicle which we paid to our outside vendor) were approximately $2,000.00 - *** and *** agreed with this approach and expressed her urgent need to get the truck back ASAP because they had to rent a replacement vehicle.

After discussing the approach and receiving verbal approval we moved forward. During the basic servicing of the vehicle we found several more safety issues as well as items related to lack of maintenance. We brought these items to their attention, but *** & *** said they did not want to fix any of the safety or maintenance items we recommended and that they only wanted the check engine & power loss issue repaired.

We were able to perform the basic services, troubleshoot the power loss issue and restore the power to the engine (which was the original problem), repaired the Check Engine light Issue but we explained that if she did not take care of the other safety & maintenance issues we previously identified that we could not guarantee how long the truck would continue to perform with full power.

When the final invoice was sent *** immediately said she was not going to pay the amount billed and threatened legal action. She insisted on being able to "test drive the truck for several days to see if it was OK" prior to paying for it...this was a strange request that I have not encountered in 25+ years. I offered to let them test drive it with the technician that repaired the truck but she refused and again threatened legal action.

I patiently tried to explain & work with ***. I even offered her a payment plan (which we do not normally offer) and fortunately she did not take me up on the offer.

Prior to sending you this letter I reached out to *** and spoke with the owner. *** shared with me that G&D not only owed them money but they took the vehicle for a "test drive" and never came back to pay the bill!

*** had to file a Police report with the Bladensburg Police Dept (Report #***) in an attempt to collect their money. After the Police report was filed, they received a check for 60% of the amount that was actually owed. The owner of *** met with an attorney and decided that it was not going to be worth spending another $2,500 in legal fees trying to collect the remaining balance. After speaking with *** and recalling my conversation with *** it appears to me that this is a pattern of behavior and their "non-payment" to vendors that should be reported & reflected negatively on their Revdex.com rating, not our company.

I am rejecting this response because:

ATEL Bus company is trying to imply that I just did not want to make a payment to them. I want to show you via the attached documents that there is a basis for my company not to execute payment until we both come up to a mutual agreement as I was not informed of any costs associated with the repairs until the repairs had already been performed. Atel is rejecting to provide warranty on repairs as JR his technician is claiming that he does not feel my truck is functional .
