12:AMTo: ***Subject: Complaint ID against Athena GrandDear *** *** ***,I have received your letter noting the response of the Athena Grand in regards to my original complaint.There are a few points I would like clarify if you would.I would like to point out that ** *** ***, the owner of the Athena Grand, was directly informed by myself, during our phone conversation, that the tickets in question were not purchased online but were paid for in person at the counterThis was made clear to, and acknowledged by, ** ***.There were three of us present at the time of purchaseAt no time did we visit ** ***s website prior to, or during this timeNor was any such policy brought up during our purchaseAt no time was it possible for any of us to be aware of ** ***s rather strict policy on sales.There is nothing posted anywhere in ** ***s establishment regarding refunds or to suggest, directly or indirectly, that sales are finalThere were, in point of fact, no such postings or notices displayed at all mentioning refunds.As my phone autorecords all conversations, ** *** is on recording admitting both that he had no notices posted and does not personally understand the legalities regarding the display and enforcement of policies.** ***, on the same recorded conversation, did acknowledg the fact that we purchased the disputed ticket in his business, not online.Furthermore, ** *** directly and specifically, on record, attributed *** as his primary reasoning for refusing to issue a refund.My request for a simple refund of the price of the ticket ($5) stands on the grounds that ** *** failed to publicly display notice or policy of any kind in his business limiting or excluding the refund of tickets, unused or otherwise, for walk in customers to be aware.If ** ***s memory of the conversation remains contested, I am able to provide the recordings of the two phone conversations to a Revdex.com representative for verification of my testimony.
