September 12, To whom it may concern, My name is Hector R***, the proud owner of Atiles Mechanical Corplocated at [redacted] ***We are a dedicated family run Business operating in the fields of Plumbing, Heating, Air Conditioning, & Refrigeration for the past plus yearsOur goal is to meet customer’s needs in the scope of establishing a relationship while meeting their mechanical needsIt is with much dismay that Atiles Mechanical Corp is being pronounced responsible without due cause or process for the death of [redacted] We extend again our deepest sympathy & wish the family members consolation during this timeAtiles Mechanical Corp was dispatched a service call of an Air Conditioning unit not operating sufficientlyThis call came from Company lead provider Home Advisor Pro & we responded quickly to a [redacted] Upon arrival Atiles Mechanical Corp diagnosed the unit & reached a conclusion that it had to be replaced [redacted] expressed in tears that she didn’t have the money to replace the unit and asked if there was a cheaper resolution for Air ConditioningAtiles Mechanical Corp suggested a preventive maintenance method could provide a quick fix but shouldn’t be relied upon as an ultimate solution to a failing HVAC SystemOn June ***, 2016, we spent hours clearing the Hair from the Evaporator coil that had never been serviced (“ please note that the Existing HVAC unit never had a filter to catch the soiled airAt this residence/Houseboat, persons and domestic cats occupy the space.”) [redacted] paid Atiles mechanical $for the Preventive maintenance & we left with the air conditioning unit cooling sufficientlyThe following service call from [redacted] came on July ***, stating that the unit wasn’t cooling enoughAtiles Mechanical Corp again suggested that the unit be replaced due to its blower section operating at 25%, which is not enough to move the required air [redacted] expressed again that she did not have sufficient funds to purchase a new HVAC unit and asked if there were any other options at a low costAtiles Mechanical diagnosed that the furnace section of the HVAC unit can be replaced and provide cooling for a provisional time period(Please note that the existing air conditioning system had never been maintenanced until we (Atiles Mechanical) maintenanced it on June **, (as mentioned above) [redacted] was given a quote for $1,to replace a furnace, propane conversion kit, thermostat, new wiring, and damaged evaporator coil pan [redacted] issued Atiles Mechanical a check in the amount $1,as a deposit toward the estimated repairsOn July **, Atiles Mechanical Corpmade a purchase at Johnstone Supple in Bronx, New York for a 70,BTU Furnace Propane Coleman unitJohnstone Supply issued a delivery date of July **, at 3:00pm to be picked up by Atiles MechanicalWe notified [redacted] on July [redacted] that the unit would be delivered on July [redacted] and the installation would begin then [redacted] agreed to the installation dateUpon delivery Atiles Mechanical expressed that the unit would be working by the end of the day, only to be confronted by the removal of one hot water heater and the removal of a dishwasher and dryer unitAtiles Mechanical provided the client [redacted] with cooling on the *** of July Upon finishing the installation the client was left with cold air cooling the Houseboat but still owed a balance of $which was never paidAtiles Mechanical expressed that the installation would only be COD and that no other work would be performed except for the work that was approved [redacted] expressed that she did not have the funds and couldn’t make the payment to complete the installationAtiles Mechanical had given her week to complete payment for the completed installationBefore the week ended [redacted] air conditioning unit (please note it is separate from the furnace) had showed signs of a failing unitAtiles Mechanical again expressed that the failing air conditioning section should be replacedAtiles Mechanical diagnosed the compressor unit was working at half capacity and needed to be replacedOn July **, [redacted] could not afford to replace the entire air conditioning system because it was too costly and asked again if there was a cheaper wayAtiles Mechanical expressed that we could supply her with a compressor unit at a discounted price [redacted] agreed to a new quote of $1,to replace the compressor unit onlyAtiles Mechanical received a deposit in the form of a check for $on July **, from [redacted] Please note that [redacted] still owed a balance of $from previous installation [redacted] on the same day issued a stop payment on the deposit check for $stating again she did not have the funds to pay Atiles Mechanical for the installationWe expressed that no work would continue until payment was madeOn July **, we re-invoiced [redacted] again in an attempt to move forward on the installation by the form of a deposit that was never madeIt is with a heavy heart that Atiles Mechanical is being wrongfully accused of the death of [redacted] ( [redacted] husband) As a result our company has suffered slanderous reviews, accusations, work loss and vital contracts have been postponed to deal with these issuesAll stemming from a result of [redacted] inability to make paymentPlease understand that we at Atiles Mechanical Corpwill provide evidence indicating that [redacted] did not suffer a heat stroke due to the incomplete installationAfter constant disputes over what needed to be done to provide air conditioning, [redacted] refused to give Atiles Mechanical a deposit for work that had already begun which also ceased on July **, [redacted] had enough money to rent a hotel room on August **, for nights to cool herself off while abandoning her husband [redacted] and her catsThis houseboat was also provided with a window air conditioning unit purchased by [redacted] [redacted] bragged and boasted on [redacted] about being in an air condition hotel room claiming, “She needed this” and making comments about being a mean wife because she abandoned her husband who suffers from a variety of serious health issuesAtiles Mechanical Corphas receipts, photos, invoices and other documentation to support everything we have just stated in this responsePlease allow us the opportunity to submit theses Hector R[redacted] of ATILES Mechanical Corp is not to be trusted..He came and cleaned my aging HVAC unit which did nothing.I then called him back and he said the furnace needed to be replaced. I paid him $1100.  by check.He came several days later and installed the furnace, requiring the washerz/dryer and water heater to be removed due to spacial issues.Onice the furnace was working, he was too powerful for the old compressor which gave out and again we were without AC.I called Hector back and he brought me a used compressor and tried for over 2 weeks to get it to work.On Friday August 12, I gave him $40 to go buy pizza because he said he was so close to  being finished with the job. Then it started to rain and he left.Te next morning my husband [redacted] Corwin had heat stroke and was taken to Jacobi Medical Center where he died.Hector R[redacted] is a liar. I gave him a total of $2265 and he says I paid him nothing.On that Saturday I hired a new company. Within 3 days I had a functioning HVAC system.They stated that the compressor Hector R[redacted] brought would never have worked due to missing parts.Te morning after my husband died, Hector R[redacted] was more interested in retrieving his tools and brought the Police here to get themail.His used furnace that I paid for as well as the used compressor are still here, not being used as they are not functioning.I paid a total of $2265 to this company, never did get it to work and my husband is gone. Mr R[redacted] tries to sound like a professional, but he is anything but that.He never once expressed his condolences to me at the time and also stated that I abused my husband... all lies to make himself less responsible.If this job had been completed in a timely manner my husband would be here now. None of the equipment he brought, that I paid for, are in use at this time.I would like a full refund and thsee units be removed by Atiles Mechanical as stated in the original contract.No one should have to go through what I did. He would promise to be here in the morning but claimed to have insomnia so could never show up for work till late in the afternoon, all the while we were here dying from the heat... literally.I never said I COULDN'T pay, just that I'd rather not spend any more than necessary. It is with much dismay that Atiles Mechanical Corp is being pronounced responsible without due cause or process for the death of [redacted]. Atiles Mechanical Corp again suggested that the unit be replaced due to its blower section operating at 25%, which is not enough to move the required air. [redacted] expressed again that she did not have sufficient funds to purchase a new HVAC unit and asked if there were any other options at a low cost. Atiles Mechanical diagnosed that the furnace section of the HVAC unit can be replaced and provide cooling for a provisional time period. On July **, 2016 Atiles Mechanical Corp. made a purchase at Johnstone Supple in Bronx, New York for a 70,000 BTU Furnace Propane Coleman unit. Johnstone Supply issued a delivery date of July **, 2016 at 3:00pm to be picked up by Atiles Mechanical. We notified [redacted] on July [redacted] 2016 that the unit would be delivered on July [redacted] 2016 and the installation would begin then. [redacted] agreed to the installation date. Upon delivery Atiles Mechanical expressed that the unit would be working by the end of the day, only to be confronted by the removal of one hot water heater and the removal of a dishwasher and dryer unit. Atiles Mechanical provided the client [redacted] with cooling on the [redacted] of July 2016. Atiles Mechanical again expressed that the failing air conditioning section should be replaced. Atiles Mechanical diagnosed the compressor unit was working at half capacity and needed to be replaced. On July **, 2016 [redacted] could not afford to replace the entire air conditioning system because it was too costly and asked again if there was a cheaper way. Atiles Mechanical expressed that we could supply her with a compressor unit at a discounted price. [redacted] agreed to a new quote of $1,235.73 to replace the compressor unit only. Atiles Mechanical received a deposit in the form of a check for $500.00 on July **, 2016 from [redacted]. Please note that [redacted] still owed a balance of $383.00 from previous installation. [redacted] on the same day issued a stop payment on the deposit check for $500.00 stating again she did not have the funds to pay Atiles Mechanical for the installation. We expressed that no work would continue until payment was made.
