The customers money was refunded and the agreement was that he would take this downHe put a deposit on a car, signed saying he agreed to purchase the vehicle, it got approved at the bank and he also approved the payment arrangementWe did all the DMV paperwork, did all agreed mechanical repairs to the car and cleaned it and put the plates on it for himAt the last minute he decided to purchase a different vehicleI have a signed legal binding agreement between him and myself saying that if he approved the payment his deposit would NOT be refundableWe told him that even though we did our part we would not keep the deposit and would start the refund processHe did part of it on a credit card and part in cash totaling $dollarsIn our company the process is we submit the deal to the owner for the refundThen when he approves it, it can take hours for the accounting department to issue the check for the cash portion of the depositThe credit card company can take 2-business days to process that portionThis customer was told how the process works and we explained to him that we legally don't HAVE to refund his moneyHe called literally times per day, did not leave any voice mails (he would call, hang up, call back, hang up, etc) and then would just show up and say "ok I'll wait here for it"Wait here for what? The 2-days it takes to process? The whole process was absurd to meWe told him how long it would take, explained to him that we would be gentlemen and refund the deposit even though he approved the entire deal and didn't have too, and he was still completely unreasonable and pushyHe agreed that when the resin went through he would delete this complaint and just as he was intolerable, he also isn't a man of his wordI am highly distraught that the Revdex.com would even help people slam small businesses for being honorable no matter what the situation and was told that this will be displayed for years before being deletedI am disgusted with this rule

I must say I am very surprised by this complaintThe customer had an emissions code that came on after picking up the vehicle and we immediately scheduled and appointment to get it in and look at itWe explained that the check engine light code has numerous possibilities on which parts to change
The procedure is to replace one part at a time and see which was the remedyWe already warrantied and changed out the first part without charging any money to do soWhen the customer called back we explained this again that we will once again schedule the car for an appointment and warranty the next part as wellAt no point in this entire process has our company tried to charge for these repairs even though nothing is covered under warranty, and the customer is well aware she declined any additional extended warranty optionsIt is very frustrating that we are paying to fix a minor repair out of our own pockets and go the extra mile and she is filing a complaintThis is a very simple thing to fix but you have to follow the procedures put in place by the cars manufacturer, which we are doing to the letterAs I stated this is a very minor repair being only an air/evaporative issue and the parts have all been replaced for FREE throughout the whole processWhen we warranty such a small item we dont usually have a process that requires a bill being generated so we dont generally have a receipt to give to the customerThe parts for this repair are in stock at all times, and they cost under dollarsI also told the customer that if she requires a receipt then I am more than willing to make one for herUnfortunately we do not let people return cars because they have a check engine light that could be repaired for something as simple as a replacement gas capI have done everything in my power to make the customer happy by giving all free parts and free labor for something that once again is not even covered by a NYS lemon law warrantyWe do this out of respect for our customers and it is very hurtful that they decide to take such drastic action on something so simple

I Finally received a call back on 12/5/around 1pm from Shaun after a whole week of the *** being in the shopI went to pick up the car with my father around 4:after I got off work, my father drove the car off the lot then called me immediately after stating we had to go right back because my TCS/AirBag/Exclamation Mark(inside triangle) lights came onSo we went back and Shaun and Eric came out telling us they did a tune up and the car should run fine if not bring it backLiterally just a week later on 12/12/my check engine light came right back on around 4:30pm, I called Shaun back immediately and he told me I had to go somewhere else to get the code then call him back with the resultsWhen I finally got the time to go to *** *** to get the code pulled it read back P0430, so I called Shaun to update himHis exact words were "the code is not anything major & to fill my gas tank up with premium/plus gas then that should fix the problem"I did exactly what I was told but that did not fix the problem because the check engine light keeps coming on and off ever since It came back on 12/12/17, a week after supposedly being "repaired"Today 1/11/the light is currently on also 1/9/my car would not start at all, I had to get a jump from my fatherThe point of me getting a car, like any other person is because I needed a vehicle to get to & from work as well as other responsibilities I need to tend toWhy do I have to keep stopping my life and responsibilities to keep taking the car to & from a dealership when I just purchased it, should not have these problems at allThat is me loosing money again and again for the same reason I been dealing with since I got this car the beginning of November! The attached document is proof that I was deceived believing the car I purchased had around 154,miles on itShaun is trying to make himself believe I bought the car "knowing" it had over 166,miles on it & in his response he stated I bought the car with 177,milesThe car haven't even reached that yet! So here is the picture I had BEFORE I bought the car thinking that was the accurate mileage on the carIf I would have known it was more, I would have NEVER purchased the car with over 160,miles

In our company the process is we submit the deal to the owner for the refund. Then when he approves it, it can take 24 hours for the accounting department to issue the check for the cash portion of the deposit. The credit card company can take 2-3 business days to process that portion. This customer was told how the process works and we explained to him that we legally don't HAVE to refund his money. He called literally 35 times per day, did not leave any voice mails (he would call, hang up, call back, hang up, etc) and then would just show up and say "ok I'll wait here for it". Wait here for what? The 2-3 days it takes to process? The whole process was absurd to me. We told him how long it would take, explained to him that we would be gentlemen and refund the deposit even though he approved  the entire deal and didn't have too, and he was still completely unreasonable and pushy. He agreed that when the resin went through he would delete this complaint and just as he was intolerable, he also isn't a man of his word. I am highly distraught that the Revdex.com would even help people slam small businesses for being honorable no matter what the situation and was told that this will be displayed for 3 years before being deleted. I am disgusted with this rule.

If your mechanic looked at the vehicle regarding the check engine light and can not see the part that was replaced, I would highly suggest looking for a new mechanic. Rear stabilizer links are rusted on every used car on the road and that does not warrant them needing to be replaced. Let me remind you that you purchased a USED vehicle, not a new one. Rear drums do tend to make noise because they are a sealed unit, meaning that the dust created while braking has nowhere to go and they can be cleaned and adjusted. It is very common and also why most newer cars have switched to rotors instead of drums. As far as the rubber axle boot being ripped that is also normal wear and tear and common in any used car. I can assure you that it was not ripped at the time of sale, and would have also been something I could have covered under warranty had you been willing to work with us. I do not understand why things have come this far. Every single time you brought your car in with a concern, the concern was address at absolutely no charge to you at all. While Im sure it was not of great convenience to have to bring the car back more than once, it was also taken care of immediately and we paid our mechanics to fix them and purchased all the parts as well. Unfortunately we do not return cars. The only offer I have is for this claim to be completely deleted and I will resume our original agreement of we make the repairs for free. I would like to also state once again that the New York State Lemon Law is a basic agreement that covers major components ie. Engine and Transmission. The repairs that were made on this car after the sale were done so in house because we extend the courtesy to do so.
