Atlantic Auto Sales sold me a car knowing it needed thousands of dollars in repairs and never told us about it. We recently purchased a 2003 Subaru Outback from Atlantic Auto Sales on 03/05/2016. We were told there were no known problems with the vehicle. The next day the vehicle began overheating. We had to have the vehicle towed to our local mechanic and what he had to tell us blew me away. He stated that the Vehicle needed over 3,000 dollars in repairs just to make it road worthy. He said that "someone" had made the car road worthy just long enough so that it could be sold and then immediately break down. The radiator was full of stop leak which is a substance that is added when someone knows that there are major issues. The power steering pump went out, the car was full of engine and undercarriage rust, the shocks were leaking, all four breaks needed replacing, and the list goes on. NONE of this was brought to our attention at the time of purchase. There is absolutely no way that they did not know about all of these problems before they sold us the vehicle yet they neglected to tell us about any of this. The repairs that we have to make to the vehicle to get it running again are going to cost us almost as much as we paid for the vehicle itself. Desired SettlementThe resolution I am seeking is a full refund of the purchase of the vehicle and a full report made on these peoples shady business practices.

Transmission failed 5 days after purchase of used vehicle. 90 day warranty not submitted by dealer and now refuses to cover cost of repair.11/01/14 - test drove a[redacted]. A sticker on passenger window indicated that a warranty was included. 11/03/14 - purchased the vehicle and was told that the price was inclusive of a warranty from a third party. [redacted] stated that the warranty would be mailed when he received the registration and license plate from [redacted], along with the second key fob, and that the sales documents included "as is" since the warranty wasn't with Atlantic Auto Sales. 11/08/14 - the check engine light came on. We had the code checked and was told it was a code for the 3rd gear. 11/10/14 - Four repair shops stated that it would cost ~$4000, before taxes, to rebuild the transmission.. We also received a quote of ~$3500 to replace it with a 5-speed manual. 11/11/14 - I called Atlantic Auto Sales. [redacted] said the quotes seemed high and that we should have it towed to their mechanic. I then spoke with [redacted] and was informed that since we had a 90 day warranty, we could have the work done anywhere and it would be covered in full. We asked about having the automatic transmission replaced with a manual transmission. He said he didn't think it would be a problem and would confirm with [redacted]. However, he hadn't received email confirmation, from [redacted], that the check he sent in had cleared and that the policy was active. 11/12/14 - Spoke with [redacted]. He gave me the warranty number and said it was ok to have manual transmission installed, but he is still waiting on the check confirmation email. I had the car towed to [redacted], as the towing was supposed to be included under the warranty. 11/13/14 - I received an email with the warranty. I contacted [redacted] and [redacted] verified that they had received the 90 day warranty documents and stated that a claim would have to be filed by the repair shop first, and for them to include that we had the car towed to their location.. I contacted [redacted] and had them submit the claim, along with the towing confirmation. [redacted] informed us that they were concerned about the warranty being processed. I contacted [redacted] and spoke with [redacted]. He stated that the warranty had been reviewed, however, because it had not been faxed until 10:53 am on 11/12/14, after the car ran the transmission code, and because it did not have any signatures, the warranty would not be honored. Had it been faxed on 11/03/14, with the signatures, they could have waited for the payment. I called [redacted], who said he was still waiting to hear back from "their" representative a [redacted]. I shared what [redacted] had told me, and that the warranty doesn't exist. [redacted] admitted that he had never spoken with anyone at [redacted] regarding installing the manual transmission before giving us the ok to have the work done. [redacted] later sent me an email stating that [redacted]'s policy had changed and that there isn't a warranty. He refused to cover the cost if we have a mechanic do the repair work. He would only agree to having me pay to tow the car to his mechanic, and then negotiate an offer based on their estimate. I refused to pay for towing or to have his mechanic do work that I could not guarantee would be done correctly. 11/15/14 - I borrowed a car to go to Atlantic Auto Sales and speak directly with [redacted]. [redacted] refused to be accountable for failing to obtain the warranty, refused to pay for the repair by our mechanic, and refused to buy the car back (we had already changed the oil and replaced the air filter, washed and waxed the car, and applied[redacted]). [redacted] said that he would negotiate only after hearing what his mechanic said, but would not commit to any amount. He wanted us to sign a statement saying we bought the car without any type of warranty. We declined. We then drove to [redacted] to discuss their arrangement with Atlantic Auto Sales andspoke with [redacted]. He confirmed that the cost to rebuild the transmission would be approximately $4000. Desired SettlementThe dealer failed to submit the warranty documents according to [redacted] requirements, thereby not honoring the statements made to us at the time of the sale. The transmission failed 5 days after purchase, and would have been covered if the warranty existed. We also do not have coverage on other major repairs listed in the warranty, should they arise within 90 days of purchase (such as the engine), since the warranty does not exist.As we do not have the warranty coverage indicated with the purchase, and for which we have received the documentation, we expect full reimbursement in the amount of $3735.43. Business Response This car was sold as is with no warranty included. This car was inspected off property by their mechanic before purchase. After I received the complaint from the customer I tried to help her out but we do not deal with mechanics that we do not know. Consumer Response The window sticker on the vehicle indicated a warranty was included. When I called [redacted] regarding the transmission problem, I was assured that a warranty was in place and that he was waiting for an email confirming that their check had cleared. According to [redacted], the dealer faxed the documents on 11/12/14 at 10:53 am. [redacted] also emailed the documents to me. The dealership neglected to obtain the warranty when the vehicle was purchased, and should be held responsible for the repairs.Whether or not the car had been inspected prior to the sale, the transmission would have been covered under the warranty. Final Business Response The window sticker on all our cars and on our website states that a warranty is available for PURCHASE. No warranty was purchased.

Tiny rust spots visible on window frame but told NO rust problems elsewhere. 3 weeks later found huge rust damage under car & will get no compensationMay 10 2014 I was looking at a Black Nissan Altima at Atlantic Auto Sales in Garner. Automatically drawn to it but noticed small rust patches on the window frame. I asked the dealer if it was a flood car or if there were any other rust problems and he said no and assured me the car was great. After leaving to look more then coming back to this car, I decided to buy it. Still weary about the rust I asked again and was again assured it was fine and there was no further damage. The day I needed to get an oil change was May 27 and when my mechanic put the car on the lift I was speechless at what I saw. Horrible rust rotting out my floorboards. Just touching it would get pieces of rust flaking off. I waited one week until I could get an estimate to replace the floor pans and was told it would be $1,800. I knew Atlantic Auto had to know about this problem because their website says all their vehicles go through an inspection before sold. I emailed them and received a call back quickly on June 9 2014. I told [redacted] about the problem and his main concern was if the car still ran fine. I said yes but there is a huge amount of damage that needs to be fixed that you told me wasn't there. He said he would talk to his boss and get back to me. After 4 1/2 hours of waiting I called again. He said his boss still hadn't arrived and he would call me back around 6, their time of closing. I did not get a call. June 10 2014 I emailed again saying I was supposed to get a call the day before and didn't and that I expected one that day. He left me a voicemail 5 minutes after they opened saying they could not help me because it had been so long since I bought the car. It has been one month since I bought it, and the car did not need mechanical service until 2 weeks ago when I found the problem. I wanted to get an estimate myself before contacting them and when I found it would be that much I was hoping they would compensate me for not disclosing that information when asked about it more than once. I emailed again June 11 saying I did not want a call back but telling them I knew they knew about it and I was shocked they would not assist in covering this damage that was there way before I bought the car and did not receive an email back.Desired SettlementI would like Atlantic Auto to pay for the correct repair of the rust damage underneath the car that was not disclosed when I bought the car.Business Response This car was sold to the customer as is after they test drove the car and checked over it. This car was not in a flood and an estimate of $1,800 is very high. This car is a 2006 and they saw a complete [redacted] report before purchase.Consumer Response Yes I saw a [redacted] and looked over the exterior and interior of the car. Yes I also drove it. It runs fine. The fact is that I have never in my life thought I would have to physically lie on the ground and look underneath a car to see if there is additional damage. Especially when the dealer was comfortable looking me in the eye and lying to me about there not being any. I agree $1,800 is a high estimate and if I would have been told the truth about these damages I would not have to be dealing with it because I would not have bought the car. I feel if you will not cover the whole $1,800 for me to fix it I would respectfully take a reasonable amount and pay the rest myself. If I could return the car to this dealership for just the flat out sale price the car was- I would in a heartbeat. I once again want to point out on their website it says "We have a full service maintenance center and our entire vehicles undergo a multi-point inspection." making it almost impossible to think they did not know about this problem. It is unbelievable to me that I was told a flat out lie to my face when asking the dealer about additional rust damage at least twice. My main concern is wanting Atlantic Auto Sales and the specific dealer I had to acknowledge their fault on not disclosing this huge expense to me and taking responsibility for it. I have a saved voicemail from the dealer saying it was just too far off since I bought the car to get any compensation, with it only being a month off; making it seem as though I could've received help if I would have found the problem earlier, even though I probably would've gotten the same excuse. It's concerning because this greatly impacts the safety and stability of my vehicle as my mechanic told me not to allow a great deal of weight on the front floorboards. I also have a copy of my $1,800 estimate and pictures of the damage that was not disclosed that I am willing to forward if possible.

The car we purchased was sold some one else when we went to pick up delivery.Problem and Purchase Date: 06/18/15Model Number: [redacted], VIN[redacted]Sales representative: [redacted]Payment was under process with finance company. We purchased the car and signed bill of sale (contract) and payment was to be made by Finance company two days after. However the dealer informed us to give them a personal cheque which they will not deposit and will return us on receipt of cheque from our finance company. We agreed and went with a cheque to pick up a car and on arrival he came outside his office to tell that he has sold the car the customer is sitting inside. He concluded with conversation with a SORRY. Desired Settlement I have wasted one complete day with payment of rental car and compromising my routine work. I have looked 6 other car chose to finalize with this dealer. I paid my insurance money which will not be used at all.Again I have to search for substituting car on put efforts all over again which went vain with Atlantic Car Sales. The least resolution I want is discount of 1000$ or cash transfer in my account as my expense for rental car insurance, rental car, reapplying loan which will affect my credit, wasting one more day for exploring new dealer, actual insurance bought and to put all efforts again.Business Response Customer did not leave a deposit to hold the car for them. We can not hold a car without a deposit. The car was still offered to them the same day and they refused. We did not know this was a valid sale as the finance company was one we have never dealt with in California.
