As requested, I have attached a copy of the contract between myself and Atlantic Building Contractors.
 
The status of the matter unfortunately remains unchanged.
 
As you may know, following payment of my deposit when I signed the contract in April, I did not hear from the contractor for a month. When I contacted the contractor in May, I was ready to either terminate the contract - upon refund of my deposit - or allow the contractor to do the job. Since then, the contractor has refused to refund my deposit - $9,331 - but, I am no longer willing to allow him to do the work.
 
In fact, the only time the contractor will respond to me at all is when I say that I plan to contact you, sue or pursue other legal remedies. And, most significantly, every time the contractor responds, he promises to refund my deposit, including in his response to you about a month ago. But, he still has not returned any money to me.
 
Not doing the work, and not refunding the deposit, is clearly a very profitable way for this contractor to do business. But, it is not fair and it shouldn't be legal.

This customer did in fact pay a deposit for a project with fully executed contracts..  He sent written notice of cancellation 3 weeks into the project, to which I responded to immediately and with subsequent emails and conversations in which I assured him I would refund his deposit less my time...

and expenses as our contract stipulates.  His decision to spin the documented facts and malign me and my company in this and other forums is unfortunate but more importantly unfair.

I signed a contract with this Contractor on April 26th and he promised to get started on our project "right away." I heard nothing from the Contractor for over a month and when I checked with the Building Department I also learned that he had not even filed for permits. I then contacted him to suggest that it might be best for us both to agree to tear up the contract. He had done nothing - and, I had no further interest in pursuing the contract. He took my effort to find a workable solution for us both and he has continued to twist both my words and my intentions.
 
The facts are - this Contractor has been in touch with me twice since April - once when I suggested we discuss terminating the contract, and once when I threatened to file for Arbitration. Two contacts in 3 months; both in response to my threats. On his part, no action whatsoever. That in my mind shows an intent to unfairly keep my deposit and do no work. This Contractor has now told the Revdex.com that he has "assured" me that he will return my deposit - so where's my money? And, he claims to have incurred expenses - so where are the receipts? Nothing this Contractor has said to me, or Revdex.com, is credible.
