Initial Business Response / [redacted] (1000, 13, 2017/07/28) */ This Atlas Construction Services response to [redacted] 's disproportionate complaint First off, we at Atlas are very disappointed and frankly hurt by Mrs [redacted] 's comments and we feel terrible that she felt this wayHowever, we at Atlas still pride ourselves on doing the best quality work we possibly can in a timely manner and we feel compelled to express our side of the storyNow she is not wrong in that we were behind schedule but I immediately sprung to action and took matters into my own hands once we found out her concerns and got right to work for the [redacted] 's The following is a list of all the work that was accomplished as well as many items that were completed that were above and beyond the original scope of workI have attached the signed scope of work as well to this response [redacted] and [redacted] showed up at Atlas office April 11th saying that no one showed up, they spoke to me, ***, the GM and I assured them we will take care of it promptly Myself and ***, Atlas Construction Manager, went to [redacted] 's house on April 12th at AM to do a take off and make a plan for materials and workers to arrive the following dayAt this time we asked for a [redacted] phase of payment as typical in all projects [redacted] 's had already given us [redacted] to secure our services as down payment April 13th, [redacted] and crew of guys went to [redacted] 's house and began work We explained that we were busy and had several other jobs occurring at the same time and that over the next week we would dedicate to getting kitchen and interior structural moves made or PHASE Here is what Atlas completed: Took up all flooring in kitchen to set aside to relay later Removed back exterior window Took out old exterior back door removed walls and repositioned the rooms to make a wapantry Used the door removed for pantry door Installed brand new customer spec'd, Atlas purchase exterior steel back door Moved window over Moved cabinets in place as specified by customer Atlas ran dedicate electric outlet in basement to make it code as it was not code Ran water line in basement to their new refrigerator for built in ice and water dispenser Ran electric for new range repositioned across on exterior wall under cabinets aligned and installed all upper and lower cabinets properly and to spec Atlas purchased and installed brand new formica countertops that customer picks out Atlas cut and installed new sink Atlas ran electric and installed dishwasher Atlas moved and repositioned washer and dryer to customer preferred area Atlas ran the water lines and electric for washer and dryer and made a box for the water lines and drain Atlas framed out new back wall with window and new door Atlas built and drywalled new 6xwapantry Atlas sealed, Tyveced and re-paneled exterior wall where changes were made, roughly 20' x 12' of exterior wall space several minor adjustments and minor work occurred during in and after that phase but this is a list of the bulk of the work done Worth mentioning as well, [redacted] one of the Atlas workers at the house one day even took it upon himself to repair the [redacted] 's dilapidated front entrance stairsThey were rotten and way unloved and even unsafe, [redacted] took some deck boards left over from another Atlas job, tore out the old steps and rebuilt brand new, level and safe steps in the front entrance PHASE On or around the first part of May Atlas asked for Phase payment for [redacted] that Mrs [redacted] graciously provided Atlas began Phase which by the [redacted] 's own words was their dream shower Atlas designed and recommend the best way to build the large fully tiled shower they dreamed of having Atlas told the [redacted] 's the tile needed base on square footage of the overall shower including the floor over the weekend [redacted] went and purchased said tile at one point I, ***, had mentioned a linear drain, but it would not work due to the state of the foundation of the home and unleveled it was, which by the way was all disclosed to the [redacted] 's prior to Atlas beginning any work ***, [redacted] and crew began building the [redacted] 's new shower tore out old walls and floor They had put in several layers of subfloor to level the area for the shower up to almost 2" Once cleared, Atlas poured and shaped a custom cement shower pan with drain and this was not easy considering the dilapidated state of the house foundation Atlas purchased over sf of backer board for walls and floor of the new shower prior to tiling Atlas purchased and supplied all the mortar and grout for the tile in the over sf size shower with main walls and a step in Atlas beautifully tiled and installed all new plumbing for the shower Atlas even took photos of the shower to put on website because it looked amazing [redacted] said they loved it but we did have one area that pooled, but [redacted] said it wasn't that bad and she could live with it as they loved the new shower Now, this custom built, custom poured and tiled waDream shower was never on the original scope of work, I, ***, agreed to make the dream shower because they were so excited about itI told [redacted] I would do time and materials to install this shower and we would check it against the budget of [redacted] at the end and go from there Additionally worth mentioning is a list of a few things that occurred during the project that caused Atlas many delays On several days, Atlas Crew showed up a day in early morning ready to work and both of the [redacted] cars were there and doors were lockedMy guys pounded on both doors [redacted] claimed we never came to work I, ***, sent [redacted] several text messages to approve items as I was purchasing for [redacted] for over weeks, all while I was in the Lowes or MenardsSo when no reply after waiting in stores for hours, I purchased what I thought was best option based on her description in conversations prior and photos she provided At a time period in May, we all called [redacted] numerous times with no reply, and evidently her cell phone wasn't working as we found out from her later or I believe it was turned off for reasons she couldn't explainI don't know exactly how long we couldn't even get a hold of her at one point We ordered all the materials to finish [redacted] house awaiting the final and PHASE payment which was materials to repair a severely rotten and damaged floor and wall under cast iron tub that Atlas removed, including lumber, drywall, compound, caulk etcWe purchased plumbing to change the tub position, plumbing to fix the gurgling, a new window above the tub (which was not in original plan), new vanity (not in original plan), light fixtures with fans for your bathrooms (only was listed in original scope), and trim to finish entire bathroom Atlas has numerous documentations of communication to Ferriers via text, email etc Ferriers only paid Atlas [redacted] for Phase and 2, the total estimate was for [redacted] Ferriers refused to make the final Phase payment after we proceeded any way with demolition in the bathroom and had already purchase all materials to fix the bathroom as agreed in original scope, but also all of the additional items or punch list items [redacted] and I went over that I even took pictures of as the punch list No one from Atlas ever heard back from [redacted] as [redacted] was calling to try and schedule guys to complete Phase and punch-list items, not until we saw this complaint on Revdex.com We are well over the [redacted] on labor and materials already, and I asked for the final phase payment of [redacted] to install all afore mentioned items and cover some of the change orders that occurred and she never replied for over a week, then we saw this complaint Furthermore, considering the condition of the entire home at the onset of the work and as we informed the Ferriers, the work we would be doing was like putting a band-aid on a hemorrhage, the entire home needs redone in our professional opinion and therefore, we believe not many other contractors in the area would do any of the work requested, but we felt like they had no where to turn so we helped them out and almost completed things for them until this complaint was made Atlas has all the receipts and all the labor hours and everything needed in tact to seek indemnification if necessaryIt is well more than [redacted] Atlas to this day, would still do our best to complete the project but only upon getting the payment for the work we deserve Initial Consumer Rebuttal / [redacted] (3000, 17, 2017/08/07) */ See attachment of consumer's rebuttal

Atlas Construction solicited my business through a mass mailing after tornadoes struck our area in October The project manager Matt *** was extremely personable and it was a pleasure to work with him throughout the process He spearheaded the interface with *** as we filed a claim for a new roof, and the claim was immediately approvedThe roofing crew did a great job on the roof, which has not leaked in several recent torrential downpours They protected our pool and the landscaping around our house during the work, and they cleaned up well The crew did use a couple of our personal items as ramps for wheelbarrows, which was slightly disconcertingThere were a couple of bumps and bruises--broken window pane (which Matt had replaced to factory specs by [redacted] ) and damage to our gutters and gutter covers After some negotiation, Atlas compensated me appropriately for my time and expense to have the gutters repairedAll told, I am pleased and would recommend Atlas to a friend

Atlas still pride ourselves on doing the best quality work we possibly can in a timely manner and we feel compelled to express our side of the story. Now she is not wrong in that we were behind schedule but I immediately sprung to action and took matters into my own hands once we found out her concerns and got right to work for the [redacted]'s.

The following is a list of all the work that was accomplished as well as many items that were completed that were above and beyond the original scope of work. I have attached the signed scope of work as well to this response.
[redacted] and [redacted] showed up at Atlas office April 11th saying that no one showed up, they spoke to me, [redacted], the GM and I assured them we will take care of it promptly.

At this time we asked for a [redacted] phase 1 of 3 payment as typical in all projects. [redacted]'s had already given us [redacted] to secure our services as down payment.
April 13th, [redacted] and crew of 4 guys went to [redacted]'s house and began work
We explained that we were busy and had several other jobs occurring at the same time and that over the next week we would dedicate to getting kitchen and interior structural moves made or PHASE 1
Here is what Atlas completed:
Took up all flooring in kitchen to set aside to relay later

Atlas framed out new back wall with window and new door
Atlas built and drywalled new 6x6 walk-in pantry
Atlas sealed, Tyveced and re-paneled exterior wall where changes were made, roughly 20' x 12' of exterior wall space
several minor adjustments and minor work occurred during in and after that phase but this is a list of the bulk of the work done
Worth mentioning as well, [redacted] one of the Atlas workers at the house one day even took it upon himself to repair the [redacted]'s dilapidated front entrance stairs. They were rotten and way unloved and even unsafe, [redacted] took some deck boards left over from another Atlas job, tore out the old steps and rebuilt brand new, level and safe steps in the front entrance.
PHASE 2
On or around the first part of May Atlas asked for Phase 2 payment for [redacted] that Mrs. [redacted] graciously provided
Atlas began Phase 2 which by the [redacted]'s own words was their dream shower
Atlas designed and recommend the best way to build the large fully tiled shower they dreamed of having
Atlas told the [redacted]'s the tile needed base on square footage of the overall shower including the floor
over the weekend [redacted] went and purchased said tile
at one point I, [redacted], had mentioned a linear drain, but it would not work due to the state of the foundation of the home and unleveled it was, which by the way was all disclosed to the [redacted]'s prior to Atlas beginning any work
[redacted] and crew began building the [redacted]'s new shower
tore out old walls and floor
They had put in several layers of subfloor to level the area for the shower up to almost 2"
Once cleared, Atlas poured and shaped a custom cement shower pan with drain and this was not easy considering the dilapidated state of the house foundation
Atlas purchased over 180 sf of backer board for walls and floor of the new shower prior to tiling
Atlas purchased and supplied all the mortar and grout for the tile in the over 180 sf size shower with 3 main walls and a step in
Atlas beautifully tiled and installed all new plumbing for the shower
Atlas even took photos of the shower to put on website because it looked amazing
[redacted] said they loved it but we did have one area that pooled, but [redacted] said it wasn't that bad and she could live with it as they loved the new shower
Now, this custom built, custom poured and tiled walk-in Dream shower was never on the original scope of work, I, [redacted], agreed to make the dream shower because they were so excited about it. I told [redacted] I would do time and materials to install this shower and we would check it against the budget of [redacted] at the end and go from there.

Atlas has numerous documentations of communication to Ferriers via text, email etc.
Ferriers only paid Atlas [redacted] for Phase 1 and 2, the total estimate was for [redacted]
Ferriers refused to make the final Phase 3 payment after we proceeded any way with demolition in the bathroom and had already purchase all materials to fix the bathroom as agreed in original scope, but also all of the additional items or punch list items [redacted] and I went over that I even took pictures of as the punch list

Atlas replaced my roof this year. Burt the owner was very professional and friendly. He worked with my insurance company to cover the claim. He personally met with the insurance adjuster. The work was completed on time and the roof looks great. Burt showed up every day to insure I was happy while the work was being completed. I highly recommend him.
