We hired Atlas Design and Build (Len Orsini - CFO) to repair a leak in our roof and repair/update the surrounding parapet in September 2018. The roof is/was a "green roof". In order to get to and repair the leak, the dirt covering the roof was hastily removed, resulting in 1 - damaged electrical wiring, 2 - foam insulation/trash pushed along with the dirt into the surrounding yard, 3 - damage to the surrounding yard due to vehicles and heavy machinery/equipment used by Atlas Design and Build. The initial roof completion by Atlas Design and Build did not replace the insulation, resulting in large amounts of home heat loss and our furnace requiring an early emergency heating oil fill (at our cost). We notified Atlas Design and Build (Len), requiring them to repeat the uncovering of the roof and then installing insulation (again, at additional cost). Atlas Design and Build were inconsistent in their showing up at scheduled times to complete their work. Thus, due to the changing season, Atlas Design and Build (Len) then stated that they would need to wait until spring to complete the electrical repair, yard clean up and repair, detail work of the parapet, and provision of final details listed in their contracts. We began to request finalization of the projects April 2019, and have had multiple issues with Atlas Design and Build (Len) not returning our emails, texts, and phone calls. When replies did occur, we would often be told that they "are planning to finish this job" and would "be there next week", but then would not show up or notify us that they would not be coming. Atlas Design and Build (Len) have since done minimal work to repair the electrical wiring, to finish cleaning/repair the yard, or complete the parapet ends. One attempt at spreading the dirt resulted in also spreading more of the garbage/debris that was in the dirt piles throughout our yard. The result is still a significantly uncompleted job as per their contracts/statements for proposed work.

Dear Mr. ***
I’m responding to the voice message and e-mail I received from Karen Cutler last week on 11/2/19. I will begin by saying that I have been monitoring the communication between you and Len regarding the ***. project and will do my best to clarify the misunderstandings that have arisen. In reference to your e-mail, I will go through each complaint listed in hopes we can reach an understanding and move on with our future endeavors.
First and foremost, I would like to talk about the “electrical job” that Atlas Design and Build was never contracted to do. At no time was there any form of electrical work stated within a contract between Atlas Design and Build and you, ***. I understand that a shallow and improperly installed electrical line was running over your underground roof, and it was mistakenly damaged when the roof was being replaced. We were not made aware of any potential shallow electrical lines by the homeowner before we pulled back the dirt in order to expose the roof. Repairing the electrical lines would fall under a change order with an estimated cost of $1,400.00.
At this time, I would also like to remind you about your claim that the air conditioning unit was not working. You implied to Atlas Design and Build that the electrical issue was due to something our company did. However, our electrician determined that your electrical issue was unrelated to anything our company did. Due to our excellent customer service we helped have the issue fixed for you anyway, and our company was invoiced $600.00 from our electrician for repairing the unit. Although Atlas paid the electrician for doing this work, we were never compensated by you for fixing the electrical issue. To my knowledge, Len mentioned this in your communication with him and it was not once acknowledged.
Next, I will address the installation of the parapet wall corners because I understand that you are unhappy with the work completed thus far. I would like to remind you that there is extra work which must be addressed and added to the contract in order to proceed with a proper installation. This additional work pertains to where the existing siding wall meets the cement parapet wall. The existing siding and sheathing that was installed by the previous contactors is installed incorrectly. Both the siding and sheathing are nailed into foam which is likely why it is failing in that specific location and other areas around the house. Unfortunately, this limits what we can and cannot achieve aesthetically. It is difficult to make something look perfect when there are other factors contingent on a proper outcome that are not listed in the contract.
To clarify the planter boxes complaint mentioned in your e-mail, I would like to remind you that there are no specific planter box dimensions stipulated in the contract. The number of boxes is the only numerical factor mentioned, and we delivered that for you by creating the correct amount of planter boxes you requested.
To further clear up the confusion, the contract between you and Atlas Design and Build makes absolutely no mention of grading land, weed removal, and/or reseeding. It states that we will remove the foam from piles of dirt and spread the dirt downhill. Grading land and spreading dirt downhill are two different actions. We were only contracted to spread dirt downhill. Upon our assessment of the finished pictures and being on the job site, we have completed all the work stated in the contracts. If there is any remaining foam, I believe it to be a minimal amount and I would be willing to relinquish the remaining balance owed for the dirt/foam portion of the contract. I suggest possibly using that remaining balance with the unpaid air conditioning unit repair cost that you currently owe Atlas Design and Build and hiring a landscaping company to achieve your desired results.
Finally, I would like to state that our company is also displeased with how the project transpired. We specialize in roofing, siding, and all phases of interior residential remodeling. Much of the displeasure stems from the excavating/landscaping aspects of our dealings, where we were only trying to help you as a client. We informed you when the foam was unearthed, that the two (2) quotes we received from landscaping companies were for $8,000.00 and $11,000.00, respectively. Although we had no obligation in the original roofing contract to remove any foam, we did our best to find a solution for you. We certainly did not leave you to fend for yourselves concerning the dirt and foam.
Currently, I request any further communication between Atlas Design and Build and the signatory to be conducted through e-mail.
