Mrand Mrs*** did rent one of our properties located at *** ** *** *** *** ** ***The moved in on August 1st, and did pay a “Security Deposit” in the amount of $Mrand Mrs*** also signed a Lease Agreement with Atlas Residential, LLC agreeing to all of the
terms and conditions associated with leasing a premises in accordance with Arizona State Law including the following:Tenant Obligations upon Vacating Premises which specifically states that Tenant promises to surrender the Premises to Landlord in the same condition as when the Agreement commenced, reasonable wear and tear expected.This was hardly the caseI noticed in their complaint the ***’s state that they returned the property in “excellent shape.” This is a stark contradiction to the amount of repairs required to return this property not just to a rentable condition but to a habitable condition.Upon entering the property it was discovered that virtually every electrical out cover was either broken or had been removedDoors to the house had been severely damaged and needed to be replaced including the hardware and locks for both exterior and interior doors.The kitchen was filthy and required extensive clean up as well as refurbishing of the cabinets.The entire home required repainting not for the usual scratches and scuffs that one anticipates after a few years of living in a home but for actual damages.The simple fact is that we discussing the rehab of a home, we are not simply discussing a few gallons of paint and cleaning materials, we are discussing paint, cleaning as well as materials, hardware, man power and man hours to complete these repairs as well as the thorough cleaning of the interior and maintenance along with the rehab of the exterior as well.We can place a dollar amount on this because Atlas Residential, LLC incurred the actual damages caused by the ***’sAlthough I am not sure who Mr*** claims gave him a figure of $the actual damages did come to $Now, there was some work done that admittedly was not the responsibility of the ***’s that came to about $However, let me just base this on an average rehab of homes returned in excellent condition with what one might consider wear and tear where we might spend $to $That would still leave us with a difference of $that we can justifiably call damage.Subtract the ***’s deposit and Atlas Residential, LLC is still out $in hard money costsBased on the length of time the ***’s stayed with us, the fact they complied with the proper notice being provided prior to moving and the fact that overall we found the ***’s to be good tenants the management of Atlas Residential, LLC decided not to pursue any claims against them for the damage going so far as to, on 03/16/we issued a check to Mr*** in the amount of $which we felt, under the conditions was a fair amount.I feel that Atlas Residential, LLC has in this matter indeed gone above and beyond in their efforts to be both fair and equitable to the ***’s.*** *** ***General Managing MemberAtlas Residential, LLC

Now, there was some work done that admittedly was not the responsibility of the [redacted]’s that came to about $350.00. However, let me just base this on an average rehab of homes returned in excellent condition with what one might consider normal wear and tear where we might spend $1400 to $2000.00. That would still leave us with a difference of $2592.18 that we can justifiably call damage.Subtract the [redacted]’s deposit and Atlas Residential, LLC is still out $1667.18 in hard money costs.
