Initial Business Response /* (1000, 5, 2015/09/11) */
ETHNYCITY
Mr*** purchased an ATM from us in May, He signed the standard year processing agreement that accompanies all ATM sales(see attachment # 2)
Mr*** received the required documents necessary to perform
Electronic Funds Transfer via e-mail These documents were sent using "Adobe EchoSign" which allows the recipient to digitally sign the document without the need to print sign and fax Mr*** digitally signed and returned the documents(See attachment # 1) "Adobe EchoSign" automatically generates a digital signature to populate the area of a standard signature Mr***, by the act of returning the e-mail, legally signed the attached documents
Mr*** was charged no fees to operate his ATM machine from May till May From January of through April the machine had Zero transaction, multiple calls to Mr*** regarding the lack of transactions went un-answered
In March, Cardtronics sent a letter to all merchants with transaction levels below a pre-determined threshold stating the company could no longer service their accounts without imposing a fee of $ Mr*** was charged this fee in the months of May, June and July of
Cardtronics, upon request, e-mails monthly statements to any of its merchants Additionally, we maintain a "Best in Class" web portal known as CAMP (Cardtronics Atm Management Portal) that allows the merchant complete access to every financial aspect of the ATM
Proposed Resolution:
Mr***'s claim of forgery is falseOne can see the confusion when their name appears in a digital format and not their unique mark Mr*** purchased and operated the machine for a number of years until the issue of the low Transaction fee surfaced Cardtronics will not refund Mr*** the purchase price of the machine Cardtronics will put Mr*** in touch with one of our local dealers who may be interested in purchasing the used machine from him Alternatively, Mr*** can post the machine for sale directly to e-bay, craigslist etc
Cardtronics will refund Mr*** the low Trans fee for the months in question $x month, a total of $
It's unfortunate that Mr***'s business did not succeed as it is a loss of revenue for both organizations Should Mr*** establish a new business in the future and need an ATM, Cardtronics will aid him in finding a dealer to test the viability of the location so as not to incur any unnecessary costs
