We have been members for a few years now but stopped going close to a year ago, we have been trying since then to cancel our memberships but to no avail. There is no written comittment however the center says we have to send a letter "certified mail" in order to cancel. I shouldn't have to go through the trouble and expense of doing this in order to cancel our membership. I would have thought an email would serve as proof on both sides that the request was requested and recieved but they do not post any emails on their website.The problem has grown worse as they auto debit out of our checking accounts and do so at various times of the month and have double charged on more than one occasion.Product_Or_Service: gym membershipDesired SettlementWe would like our membership cancelled immediately and our accounts debited the amounts charged since our first request as they should have proof that we haven't used the gym in quite some time by researching the scans to our membership card, as well as the double charges that occured to our accounts.We have accounts under the following names:[redacted]Business Response Per your letter dated December 8, 2014, Atoka Fitness Center responded to a complaint from[redacted] and[redacted].Based on instructions in the letter, we submitted our response to your website on December 14, 2014.Today we received a call regarding this same issue.As stated previously, page 2 of all Atoka Fitness Center agreements clearly states that cancellations must be sent via certified mail to our address 30 days in advance of the requested cancellation date. Wehave not received any certified letters from the [redacted] family. If the cancellation request had been sent via certified mail, the personsending the letter would also have a signed receipt notifying them that Atoka Fitness had received their request.Also, in the [redacted] family's complaint, they admit they have not followed the agreement they signed by sending us a certified letter to cancel.Attached please find signed agreements from[redacted] and[redacted] is a minor and would not have signed an agreement herself.We will gladly cancel the family's memberships as soon as soon as we receive their cancellation letter via certified mail, as they agreed to when signing their agreement.Since responses have not been received properly through your website, would you kindly respond via email that you have received this responsefrom Atoka Fitness Center.Thank you,[redacted]General ManagerAtoka Fitness Center901-840-4900Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Why is this not a proper and legal request to cancel our memberships? Everything is documented by a 3rd party so there should be no question as to the legality of the request.I do not believe I should spend any of my own money to let you know I don't want to continue my membership at your business.This is my final attempt to handle this then I will have to choice but to seek legal action to recover our lost fees over the last year of the memberships we were charged for but never attended the business in addition we will have our bank block any future charges.We have drafted a letter requesting cancellation of all of our memberships that my wife has agreed to meet the general manager with and to be signed in the presence of both parties to serve the same purpose as this certified letter would serve.If you would agree to this we can set a time and finally get this completed.Please respond asap so that we may settle this.[redacted]

Attempted to cancel 1 of 3 memberships, service personnel stated it was cancelled. Location (affiliate of [redacted]) continued to bill. Cancelled all 3 memberships due to incompetence, cancellation verified with [redacted] (parent company)on March 7th.Desired SettlementReturn of March charges for all 3 memberships.Business Response In February Mr. [redacted] came into the Atoka fitness center and demanded [redacted]'s account be cancelled. Our cancellation policy states that cancellation requests be submitted in writing either in person or by signature confirmation certified mail. On February 1st, 2016 Mr. [redacted] entered the fitness center and made a big scene yelling that he wanted his account cancelled. The girl at the front tried to have him fill out a cancellation form but he refused and continued demanding his account be cancelled. The girl asked what name the account was in and the only name he gave was [redacted]. Against our policy she cancelled [redacted]'s account anyway as the man stormed out of the building.The following month he returned making an even bigger scene saying that we were incompetent and that he was finished with us and that we were still billing him. The girl at front counter asked his name, he quickly named the other accounts for whom he was being billed. And yelled that he was finished with us and stormed out the door again. We cancelled his other accounts. Neither time did he fill out a cancellation form nor write a letter of cancellation. Neither time was he polite in any regard. I believe we handled his request in a timely manner and remained very polite in the face of such rudeness.The accounts are individual accounts and not on the same page. We cancelled the memberships as we got the names.
