ATS Diesel did in fact do all the work that Mr [redacted] has listed , Shortly after the work was done he developed a driveabilty issue, a miss while the engine is running , He took the vehicle to a shop on his side of town , they diagnosed it as bad injectors at that point the vehicle was returned to ATS After ATS diagnosed the vehicle we found that it had excessive blow by from the crank case , ATS did a compression check and found that the #cylinder has psi of compression cylinders 1,3,4,5,all had between 350-psi which is in the cummins specNext we removed the head to look for any damage that might have been caused by faulty injectors, after the head was removed we found all piston tops to be in excellent condition , thus eliminating and possible injector issues, After contacting the customer and going over our findings it was agreed that we would remove the engine and inspect the rings , we found that the #piston had a broken compression ring causing no compression and the engine missThe customer has not been charged any labor to this point ,there was nothing that ATS could have done to cause this issue or predict a failure like this in the future, after looking at the rest of the engine and cylinder walls this issue appears to a high mileage failure the vehicle has 190,miles on it .Mr [redacted] and ATS have come up with a very fair agreement to rebuild the engine and get him back on the road as fast as possible.ATS Is covering all the labor for the build and the customer is only paying for parts

Complaint: [redacted] I am rejecting this response because:ATS admits to not completing the job on timeThe reasons for failure are not my concernIt is ATS's responsibility to manage it's own vendors, ordering of parts and schedulingThe fact that the IPR failed so quickly after the truck was picked up indicates they didn't do a thorough or effective check of there work to ensure everything was working.There were no problems with the coolant tank prior to the truck being brought to ATSThis part was removed and reinstalled during the engine replacement and any problems with it afterward are 100% directly caused by the work ATS didI never declined to replace the tank, ATS said they couldn't replace itStruggling to install a part is one thing but install of screws is another thing all togetherThe fact that ATS's response is akin to "It was hard so we didn't do it" is not professional or even close to reasonable response from an automative shop charging $10,for the jobWhat else was hard that they didn't do that I haven't discovered yet?Attached are invoices from [redacted] detailing the AC being reinstalled incorrectly, an excel doc with an estimate from [redacted] documenting the radiator hose that ATS referred to as "Satisfactory Condition" needing replacementAlthough the estimate doesn't specify the damage the technician at [redacted] called them badly damagedATS doesn't seem to know the difference between badly damaged and satisfactoryThe truck has returned to [redacted] several time for continued problems with the Engine.ATS instructed me to take the truck to [redacted] after they failed to resolve the issues over the first three daysThey said to send them the invoices and they would reimburse for the diagnostic and any work needed Sincerely, [redacted]

ATS Diesel has removed our transmission and reinstalled a correct core transmission for his vehicle as per the customers request He has the vehicle back in his possesion and ATS is mailing him a refund check on 2/17/for his full original purchase pricePlease let me know if I can help in any other way Thank you [redacted]

ATS hereby submits its response regarding the Complainant's narrative ATS apologizes for its delayed response to the Complaint, as it was under the impression it had reached a resolution with the Complainant and the Complaint would be withdrawn It seems this was not the case.The transmission in this matter was built by an ATS employe who had stolen parts from ATS and was subsequently terminated for theft When he built this transmission, which was not sold by ATS and was not built on-site at ATS's facility, he did so incorrectly and the transmission failed almost immediately The Complainant then brought the transmission to another shop, AC Transmission, for repair AC Transmission determined there were ATS parts inside the transmission, specifically an ATS valve body which was stolen from ATS, and rebuilt the transmission around the ATS valve body an additional time.At this time, the transmission was reinstalled in the Complainant's Dodge truck, and it failed an additional time Complainant then came on-site to ATS's facility, and demanded that ATS refund his money Because ATS had never sold Complainant the parts, and had never built the transmission, and never rebuilt the transmission, ATS refused to refund any monies It should be noted that Complainant was particularly combative with ATS's staff and caused a tremendous commotion at ATS's shop Complainant then took the Dodge vehicle back to AC Transmission, who also refused to repair the vehicle This caused Complainant to fly into a rage and come back to ATS, demanding a new valve body for his transmission Clint [redacted] , ATS's Owner, refused and requested that Complainant leave the premises Complainant then screamed at Mr [redacted] and [redacted] ATS's salesperson, stating that he would picket the premises if he were not provided a new valve body and other parts Mr [redacted] again demanded Complainant leave the premises, and Complainant finally left.ATS believes the root cause of this dispute is that Complainant was trying to get an "ATS Transmission" at a cost far less than it could be purchased at retail Therefore, he purchased the illicit transmission with its illicit parts at a discounted price, yet expected that the transmission would perform the same as a standard ATS Transmission Unfortunately, Complainant's plot blew up (literally), and it is ATS's position that it will be willing to address this matter in court Comes back again demanding parts again, calling [redacted] wants a valve body

On 6/16/ATS did ship the incorrect transmission back to Mr [redacted] , After he received the unit on 6/21/it was found that it was the wrong bellhousing for his vehicle,ATS expedited him the corrrect transmission on 6/we are generally a 2-week turn around time [redacted] in our warranty department is working with Mr [redacted] on reimbursment for the additional labor that he incured

ATS could not start the engine install until the remanufactured engine arrived at its Arvada facility from ***ATS received the engine from the [redacted] dealership several days later than scheduled; this delayed the engine's installationAlthough ATS received the engine later than scheduled, it was able to spend additional overtime installing the engine to minimize the delay timeThe additional overtime paid to ATS's technician was not charged to [redacted] by ATS.There is no argument that the engine quit running fourteen miles after [redacted] picked it up from ATSATS immediately called a tow service to go pick up the truck and bring it back to ATSAs soon as the truck arrived at ATS, it diagnosed the no start issue with the engine and found that the Injector Pressure Regulator ("IPR") failed, causing the engine to stop runningThe IPR that failed was a new part on the engine assembly, purchased from ***ATS immediately contacted [redacted] to get a new one under warranty [redacted] replaced the failed part, but did not reimburse ATS for the tow or labor to replace the [redacted] defective partATS installed the new [redacted] part, and the engine ran fine; ATS road tested the truck again, and let [redacted] know he could come pick up the truckAs soon as [redacted] informed ATS that the truck was leaking coolant, ATS again located a tow service and towed the truck to its facilityWhen the truck arrived, ATS diagnosed it and found that the leak was coming from the coolant tank capThe cap would not tighten into the tank securely After examining the issue deeper, ATS found that the coolant tank had been replaced with an aftermarket unit that is of a much lesser quality than the factory [redacted] coolant bottleATS's Service Writer, [redacted] ("***") explained this to ***, and recommended replacing the unit with a[redacted] OEM coolant tank [redacted] did not like this answer [redacted] declined the recommended fix of replacing the old coolant tank with a [redacted] unit; ATS's technician road-tested the truck again and parked it at ATS's facilityATS then told [redacted] he could come pick up the truckATS did not charge [redacted] for this tow, eitherATS cannot explain how or why the grill popped out when the hood was shutATS can tell you that its technician commented about the overall fitment of the (aftermarket, non-original equipment part) grillATS's technician told management that he was having a bit of a difficulty getting the aftermarket grill to "locate into the main support" because it did not appear to be cut into the support structure to get all of the screws to line upThe technician indicated that he did his best to get to the grill to stay inThe manner in which the aftermarket grill is secured into the front of the truck is far less durable than the factory [redacted] grill; it is problematic by design.ATS has attached the [redacted] dealership's invoice, showing all details that the ATS technician found to be wrong with the vehicleThere are no comments about any install issues associated with the work ATS did when installing the engineAccording to the diagnosis [redacted] provided, and the invoice to the customer, ATS performed a quality job installing the [redacted] engine in ***’s vehicle [redacted] requested that [redacted] replace the upper and lower radiator hoses; again, there is no reference by [redacted] that the radiator hoses were faultyThe original radiator hoses were in satisfactory condition when ATS installed the new engine, and ATS did not recommend replacement of these hoses or many other external components in an effort to save the customer moneyATS does its best to only recommend replacement of parts that have failed or close to failingATS did not charge [redacted] for any parts that were not replacedAdditionally, based on all of the documentation that ATS has been presented, there is no evidence that ATS installed any of the parts improperlyAll of the failures were a result of a defective part that was purchased from [redacted] and other parts that were original to the vehicleThere is no evidence of wrongdoingThere are several charges that ATS should of charged the customer for, but did not, in order to keep the customer happyATS is not offering any reimbursements based on the evidence provided

I never declined to replace the tank, ATS said they couldn't replace it. Struggling to install a part is one thing but install 0 of 3 screws is another thing all together. The fact that ATS's response is akin to "It was hard so we didn't do it" is not professional or even close to reasonable response from an automative shop charging $10,590 for the job. After ATS diagnosed the vehicle we found that it had excessive blow by from the crank case , ATS did a compression check and found that the #2 cylinder has 20 psi of compression cylinders 1,3,4,5,6 all had between 350-400 psi which is in the cummins spec. Next we removed the head to look for any damage that might have been caused by faulty injectors, after the head was removed we found all piston tops to be in excellent condition , thus eliminating and possible injector issues, After contacting the customer and going over our findings it was agreed that we would remove the engine and inspect the rings , we found that the #2 piston had a broken compression ring causing no compression and the engine miss. The customer has not been charged any labor to this point ,there was nothing that ATS could have done to cause this issue or predict a failure like this in the future, after looking at the rest of the engine and cylinder walls this issue appears to a high mileage failure the vehicle has 190,000 miles on it .Mr [redacted] and ATS have come up with a very fair agreement to rebuild the engine and get him back on the road as fast as possible.ATS Is covering all the labor for the build and the customer is only paying for parts .
