To Whom It May Concern,Your letter dated Thursday, May 11, 2017 was received by our office. We appreciate the feedback and willalways strive to resolve disputes in a fashion that is in the best interest of the client. Unfortunately, the TitleIndustry is a regulated business and our rates are filed... with the State of Washington. We are not permitted to,except under very specific circumstances, deviate from our filed rate schedule. See RCW below:RCW 48.29.193Escrow services-Schedule of fees filed with commissioner.(1) Each title insurer and title insurance agent shall immediately file with the commissioner a scheduleof its fees for providing escrow services.(2) The schedule shall:(a) Be dated to show the date the fees for providing escrow services are to become effective,which date shall be no earlier than fifteen days after the schedule has been filed with thecommissioner; and(b) Set forth the total fees for providing escrow services by clearly stating the amounts to becharged for the escrow services, the manner in which the fees for the escrow services are to bedetermined, and any charges that will be charged to the consumer that are not included in the totalescrow fee.Per Attorney's Title official rate filing for a $25,000 transaction including a 1031 Tax Deferred Exchange the feesshould have been as follows:Filed Escrow RatesTransaction Amount up toand includin100 000200 000$300,000$400,000$500 000$600,000800 0001 000 0002 000 0001 Above $2,000,000Table "A"Resident ial PurchaseEscrow Rate [redacted] *11501300$1600$1800$1900$200022002300$2500Quote•Alf fees are subject to Washington State Sales Tax, if applicable.All -inclusive Resident ialEscrow Rate450450~450$450$450$650650850$850Quote• Transaction Less Than $100,000: $575 plus sales tax per party.Because the customer was surprised by the 1031 Facilitation fee we did grant them a discount based upon ourknowledge of other rate schedules in our industry as allowed by the following paragraph in our filed rate schedulewith the State of Washington. The customer should have paid $275 plus sales tax but we granted them adiscounted rate of $100 plus sales tax as we do know that another Title Company in the area has such a rate.7. Additional Work Charges : Attorney's Title of Kitsap reserves the right tocharge additional fees to compensate for excessive work or increased liability.8. A mobile home with title elimination and/or title transfer will incur a minimumcharge of $200.9. If a second Settlement Statement (HUD! I ALTA Settlement Statement IRegular Settlement Statement) is required as an independent document Inthe transaction a $250 fee will be charged.10. Competitor Rates: Attorney's Title of Kitsap reserves the right to match anycompetitive title and or escrow company rate.11. Commercial Rates: Will be quoted based on the work and liability.12.
