I purchased a 1954 ford from auction production that was described to have 24000 original miles garage stored and never seen a night out,the engine runs perfectly and purrs like a kitten.When the car was delivered it started hard ,blue smoke pouring out the exhaust,could barely make it up my driveway.The car was a mess ,nothing worked ,no lights at all,wipers didn't work,horn,radio,speedodometer,gas gadge,instrument lights and no brakes.ThE CAR WAS A Mess.Then to top it off ,the title says the car had 38000 miles on it back in 2010.I immediately called Bob Green the owner of AP and he told me he never checked the car out because he trusted the owner ,he was one his biggest and most trusted customer.He started out being sympathetic and cooperative then he gave me some story about the consigners of the car left for Alaska and if I was going to pursue this issue to sue him .Now he won't cooperate at all ,won't answer calls or Emails.I'm stuck with a 23000 dollar lawn orniment.This car can not be driven

Review: I purchased a 1954 ford from auction productions at their online auction that was severly misrepresented in their description of the vehicle.It was described as being garaged kept and never having a night out,having only 24000 original miles and purrs like a kitten.After speaking to the owner of the auction ,he told me the car was in such great condition I could fly out to [redacted] and drive the car home.When the car arrived to my home in **. I could see that the car had been poorly repainted ,the emblems on the car were all craked and weather beaten,The clear roof and hood panel were both weather beaten and fading ,the car would not run strong enough to get up my driveway there was blue smoke pouring out the exhaust,,there was rust and corrosion around the roof,the lights didn't work,the wipers didn't work,the radio doesn't work,the horn doesn't work ,the car has no brakes.The worst thing is the odometer was tampered with.Not only did the speedodometer not work but when I got the title ,it stated that the car had 37000 miles on it in 2010.I tried to come to some kind of settlemen with the owner of auction productions [redacted] but he became arrogant and told me to sue him.He told me he consigned the car for a friend and big consignor of his and he trusted their description and so on so he didn't bother to check the title and car out himself.I told him about the odometer and title issue and he told me the other car in his auction was advertised with the year being two years off and that buyer was suing him also.I haven't been able to drive this car since day and what I ended up with was a 23000 dollar lawn ornament. Pleas help me with this mater ,I am 63 years old and I told him this was going to be my retirement gift to my self and all he says is sue me like the other guyDesired Settlement: I would like to get my money back.,Between the price of the car, his auction fee and the shipping it comes to $23000 and I would even pay to have the car shipped back .Oh I also forgot ,he told me if I payed cash 0r bank check and not use my credit card he would refund me 3% so I got a bank check and then he told me I couldn't get my 3% rebait because I bid through [redacted]

Response:

Auction Productions Inc. has been in business since 1970 and

is in its 43rd year of professional service. We are writing in

reference to the above alleged complaint. Mr. [redacted] registered to bid

in our April Auction held in [redacted] through a Live Auction Simulcast

company, [redacted] simulcasts live auction all over the world. When

Mr. [redacted] registered with them he entered into a contractual agreement with

our company and also agreed to abide by our terms and conditions of sales. Please

see attached Terms, specifically, “1. All items are offered for sale as is,

where is and no special warranty or guarantee is made or implied as to

condition, authenticity or era of any described item. All items are offered for

sale to the highest bidder and the bidders must establish to there own

satisfaction the authenticity and condition before bidding. All sales are

final, no refunds, no exceptions.”

You will also see the entire “Terms and Conditions” which

are attached to this letter. Had Mr. [redacted] contacted us immediately after

the auction and up to 29 days after the auction it may have been possible to

remedy this situation. After 30 days we pay our consignors and that had

happened when we first received telephonic communications from the complainant.

I worked very hard trying to negotiate a settlement between him and the

consignor and was in contact with him multiple times a week. There were several

times that he was unreachable due to him misplacing his cell phone.

He opines that I made several statements about the vehicle

of which the following are true. I would not have been afraid to drive the car

to the [redacted] The car while in our

possession ran perfectly. I did not check out the turn signals, windshield

wipers or other equipment on the car. I had given an accurate mileage based on

an odometer reading and had no idea that there was a difference on the title.

At no time was I arrogant or did I tell the Complainant to sue me. After

exhausting all hope of a refund from the consignor I informed the complainant

that there was nothing else I could do for him and told him if he was

considering litigation he should contact an attorney in [redacted]. In doing so he would not have to spend extra

fund with an [redacted]attorney who would refer him to an attorney here

and charge him. He was told about the areas of rust on the car. He took the car

to his local inspection station without checking to see if all components were

working properly and failed inspection. He then went to a local Ford dealership

in his area and someone at that location embarrassed him about the car. At that

point he fell into “Buyers Remorse”. He could have had the car checked out here

by hiring someone reputable to do that for him prior to bidding. He did not. It

does not matter that I tried to help him as he has made his mind up and all who

disagree will only further plunge him deeper into remorse. After 43 years in

business and only one previous complaint which you proved was unfounded I am at

a loss as to what I can do. He commented that I was arrogant and stated “Sue

Me” again untrue and I have attached a copy of my last email to him at the end

of this letter.

Further the Complainant has contacted [redacted] and lodged a

complaint with them. He contacted me and told me they were going to void my

contract with them. [redacted] informed me that was not the case and that he,

the complainant, was suffering from buyer’s remorse.
