AuctionsInternational.com is an online auction site.  We list surplus items, from municipal agencies and others, to be sold.  These items for sale are located with the consignor.  We post the information as it is provided to us.  Although every attempt is made to provide bidders...

with correct information, we cannot verify the accuracy of information as we never take possession of these items.  This is the reason that we strongly encourage bidders to inspect the items personally and why we have the applicable disclaimers in our Terms & Conditions. Please refer to our auction terms, which the complainant agreed to when he registered to bid, and the listing for the vehicle in question.  Please note that the listing has a contact name and phone number that could have been used to schedule an appointment or to ask any questions about the vehicle, prior to bidding on it.  This listing was on our website for 14 days, allowing the bidder ample time to inspect the vehicle and/or call the contact to inquire about it.  The complainant never inspected the vehicle prior to bidding, yet still placed bids and was the successful high bidder. We do not believe that the truck was misrepresented, nor do we feel that the complainant is entitled to a refund.  The truck was sold “as is”. Sincerely, Amy W. Auctions International

We have been unsuccessful in obtaining the pertinent information from Mr. [redacted]. Phone calls have been unanswered, certified letters have been mailed with no response. He had originally mentioned that he wished to have the property deeded in his sister's name. We need to know the name and address...

of his sister before we file the deed. Once we have that information, we can proceed with the transfer. The property taxes were paid up until the time of purchase. Once Mr. [redacted] purchased the property, the taxes became his responsibility. We do not feel that Mr. [redacted] is entitled to a refund. We have been and are still awaiting his instruction as to whom he wants listed as the buyer (name and address) so that we may file the deed. Respectfully submitted, Russ S. Senior auctioneer

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
In the response from auctions international they stated "Although every attempt is made to provide bidders with correct information, we cannot verify the accuracy of information as we never take possession of these items." if they cannot verify the information they should not advertise it as anything and refuse to auction said equipment from uncertain sources. Thier terms are unfair and totally stacked against the consumer, where are the terms for their clients to provide accurate information regarding the condition of equipment for auction. Where is the obligation on auctions international to only put verified information in their online auctions? The vehicle location was over an hour away from me, if I had inspected it I would have been very unhappy in inspecting a vehicle that was misrepresented in the vehicle description. "Starts, runs and drives" should mean just that, not "we had to jump start it and don't stall it because it will not start again" by the town employee who was the contact person for the town. The town employee was a very senior employee who really was less than happy to help, was very unpleasant to deal with and gave me the impression he really didn't want to be bothered in assisting me, his boss was more helpful. Why did auctions international not respond to the two letters I wrote them in an attempt to resolve this matter. Why doesn't auctions international hold the owner/seller responsible for inaccurate and misleading information on the sale item and give the consumer a fair chance? Why was their no attempt to resolve this matter prior to the complaints I had to file? Why would auctions international not be concerned with their reputation and offer a refund, partial refund or offer to re-auction the vehicle due to maybe a less than accurate description by the seller? What NYS general business laws are being violated by thier terms?
