This merchant signed up to promote themselves to one of our clients, of which they signed an agreement which states any deposits received are considered firm and may not be refunded. ( agreement attached). The agreement also states that exclusivity is base upon the landing page not the database...

The client that they paid to be promoted to has a 41% registration rate and we see new registrations each month. This would not be the case if if was not distributed. Our client sends emails, posts the program on their intranet and even has done payroll stuffers about the program ( attached) which is above what the merchant has paid us to do. The welcome newsletter is attached to prove inclusion. The call in question was reviewed and the merchant was not told that the card would be plastic, they were told that the employees would be instructed to print off their new ID card. There is not another medical spa on the program and or page. They are a plastic surgeon that provides invasive surgical procedures. The merchant is live on the site and has never been removed. If they cant log in I don't know how they can say they are no longer on the site?  I will have their password reset so they can log in again, when this happens it is usually because the user is entering it he wrong password.

This merchant agreed to participate on the clients Perks Program on 4/13/2016. This participation included 1. An exclusive Logo placement position on the clients Perks program website- attached is proof of promotion2. A detail page including links to the merchants website- attached is proof of...

promotion3. Inclusion in the introductory newsletter - attached is proof of promotion4. Activation of the merchant dashboard- attached is proof of credentials sent  We do show correspondence with this merchant and our customer service department. On 5/24/2016, 10/26/2016 and 11/10/2017. Of which it is was explained that the promotion for which they paid was carried under the terms of the non refundable agreement they signed ( attached).At that point we discontinued the dashboard charge and allowed them access to take advantage of the dashboard free of charge which is tool provided to communicate and send additional offers. We also have record of this merchant speaking with the client and their questions were answered as per the client. Our platform is an advertisement and under no circumstance do we promise a return because we can not control the buying habits of the employees of our client. What we do contractually guarantee is that their ad and listing will be live and the program will be delivered to the client. These terms were carried out therefor services have been rendered and a refund is not warranted. Their ad was created, pushed live and delivered; I am not sure how the merchant can claim that we are a scam. The program itself is on the clients public website.

Childcare. They were given the exclusive for the [redacted] Heart & Lung program. No other childcare was pursued. The first communication we received from Albert once the sales transaction and proof were completed was on July 20, 2015. We responded by email on July 21, 2015. It showed his September "SIZZLER" Enrollment special. We sent the screen shots of the offer/listings. His next email was August 20 Stating he was not happy and wanted to know about how to go about getting a refund. We responded on Aug. 20th and explained the agreement states that the fees are firm and non-refundable. We did cancel the recurring monthly charge of $9.95 but allowed him to continue to use through the remainder of the program. We also offered to send out a one page flyer to the members of [redacted] Heart and Lung on his behalf, (this is not something that we do for all). We did receive a one page color flyer from [redacted] and sent it to the members of the [redacted] program. Flyer and signed agreement are attached. It is unfortunate that they have received no new business from there venture. We have met our contractual obligation and results is never a guarantee but it never sits well with us when a vendor isn't happy. We are more than willing to send another Flyer for the merchant and try to help him in getting an ROI on his investment.

announce the program. I am not sure who this merchant spoke to but this program is live with high registrations for usage.
I would suggest for this merchant to reach out to our customer service department to be shown how to utilize all the tools and possibly set up additional marketing for them free of charge.
A refund is not warranted for services have been rendered. Please feel free to contact me directly should you have any concerns that our customer service department can not address.

I still maintain that our company was mislead by the sales representative who told us there would be a print directory. When I called the phone numbers available I was just given the run around and my phone calls were never returned nor were emails responded to. I cannot attached these emails as they we done through their website but the respondent should have access to them. Also no numbers have been provided as to the actual enrollment of employees from this program. $700.00 is a large portion of the accounting budget for a small business like ours and we have not received any leads from this program. At the very least we would like half of the money back and our add removed from this website. I want to see registrations from West Chester University! I still maintain this is a scam and other online reviews reflect the same.

This merchant initially claims that we are a scam and are not working with said client. That was proven otherwise with physical proof.
This merchant signed an agreement stating the funds may not be refunded. His ad has been up and promoted as we were contractually obligated to do. Services were rendered.
We have no record of this merchant calling in. Please have this merchant call me directly.
This merchant now has new claims as to why he demands a refund which were not contractually or verbally guaranteed to them.
As a sign of good faith we can promote this merchant further in a variety of ways at no charge. Please have merchant contact me directly.

I am rejecting this response because:The plastic surgeon has and is promoting her med-spa (non-surgical face rejuvenation). On the documents submitted there is no mention of us being the exclusive med-spa, or the word Med-Spa or any variation of it. We were promised and our contract states we would be listed in the Med-Spa category (which, again, does not exist), there is no mention in the flyer that was uploaded. How can there be an exclusive category listing when that category doesn't exist? And it wasn't listed in the flyer uploaded by Augeo either.
