Review: On May 27, 2012, [redacted] performed a comprehensive home inspection at [redacted] as part of our determining whether to place an offer at the property. [redacted] was professional and appeared to be thorough. We purchased the house in late August 2012. In mid-May 2013 we began a landscaping project during which we discovered that there was severe water damage around the foundation of our house. We consulted with several contractors as the result of this discovery and each one indicated that that the damage was unequivocally caused by the vinyl siding being submerged under the dirt and/or asphalt surrounding the house. This circumstance was in plain sight and was well within the scope of a general home inspection. On May 24, 2013, I spoke to [redacted] and explained the discovery. He was gracious and asked to come out to our home to see the damage. He met with me on May 29, 2013 at the property, reviewed the situation, and affirmed that he wanted to ‘make things right’ and that he valued his reputation. At his request, we provided pictures and progress reports on the repair work. All along, [redacted] maintained that he wanted to work with us to resolve the situation. He brought his own contractor to the property, asked for copies of the invoices for the work that was done and asked us to identify the work that was directly attributable to his oversight. During this time there were several instances in which [redacted] failed to respond to our communications, only to resurface and explain that business or personal circumstances got in the way and that we should just be patient with him. We, of course, readily accepted these statements in effort to advance a resolution. We always made ourselves available and promptly provided any requested information. [redacted]'s failures to respond got progressively lengthier and eventually he ceased responding to our communications all together. To-date we still have no resolution.Desired Settlement: We simply want to resolve this matter with a mutually agreed upon settlement.
