AFTER CHECKING OUT THE VEHICLE I CAN SEE FRESH DAMAGE TO THE WHEELS AND UNDERCARRIAGE , SOMEONE RECENTLY HAS HIT SOMETHING IN THE VEHICLE . IT HAS FRESH SCRAPES UNDER CAR . PRIOR TO SELLING THE VEHICLE TO YOU WE PUT 2 BRAND NEW TIRES ON THE FRONT END OF THE VEHICLE NEITHER ARE ON THE VEHICLE NOW. . ALL OF OUR RECORDS AND CAR FAX SHOW NO PREVIOUS DAMAGE. SO I AM SORRY TO SAY WE CAN NOT HELP WITH YOUR REQUEST ALL PHOTOS AND DOCUMENTS PRIOR TO THE SALE SHOW THE VEHICLE IN PERFECT CONDITON. SEE ATTACHED PHOTOS CLEARLY SHOWING NEW DAMAGE. I AM CONCERNED WHY YOU WOULD ALLOW THEM TO INSTALL A MODULE THAT YOU WERE NOT HAPPY WITH MY UNDERSTANDING FROM THE VENDOR WAS YOU SPOKE TO HIM IN DEPTH ABOUT THIS MODULE AND YOU OPTED TO INSTALL ITONCE ITS BEEN INSTALL I HAVE NO OTHER RECORSE TO HELPI AM SORRY I HAVE GONE ABOVE AND BEYOND TO TRY TO RESOLVE THIS ISSUE WITHIN LEGAL LIMITS BY TX DOT I AM SORRY YOU AT THIS TIME ARE NOT HAPPY . I am sorry to hear that their was some confusion when *** *** was trying to buy a vehicle
Neither my General Sales manager nor I was aware there was a customer that felt he was getting the run around

reviewed the advertising and I verified that do in fact have the exact vehicle that is in the advertisementWe currently have the truck on our main lot
We are more than willing to sell *** *** the truck that is in the advertisement
*** *** (Our GSM) has tried several times today to reach *** *** to discuss this matter
I am not sure how our system referred *** *** to a Pre-Owned salespersonThe Pre-Owned salesperson is not an expert in the new vehicle department and I am sorry that you did not receive the correct information
Please feel free to contact *** ***.....***
Also after reviewing all of the documentation I noticed that nothing was ever signed nor was a sales contract completedWe hope that you will come in and agree to the terms of the sale and we then can complete a sales transaction
We also need to have your trade appraised so we can determine a value

This is a picture of the screen the truck had/has when we recived it I asked Mike *** the sales person and a representative of planet ford humbleif I could put a dvd into the the slot and it would playHis response was "yes"The window sticker was not on the truck it was in the glove compartment in shamblesIf you look at section chSec in the dmv dealer manual it readsDisclosures under Deceptive Trade Practices Act (DTPA)DTPA lawsuits are based on “misrepresentations” (or misleading statements)If a misrepresentation made to influence opinion or action was made to a consumer before the sale of the vehicle, the dealer is subject to DTPA actionThe representation can be written or oralContracts or other agreements cannot waive the consumer’s rights under the DTPAIt does not matter that the misrepresentation was made unknowingly, only that it was made Common areas where dealers have encountered DPTA problems include the following: Odometer replaced or is non-operative. True miles are unknown. Mileage exceeds mechanical limits. Mechanical deficiencies. Electrical equipment deficiencies. Vehicle is stolen recovered, flood damaged, hail damaged, a salvage vehicle, rebuilt or reconditioned, etc. The enforcement division does not sue dealers under the DTPA, but some business practices that in DTPA lawsuits by consumers will also trigger disciplinary action by the department under its statutory authoritySuch disciplinary actions can occur before, during, or after a DTPA lawsuit by the consumer.And the msrp sticker not being In place is in chsection 6. THANK YOU SO MUCH FOR TAKING THE TIME TO SPEAK WITH ME I AM SORRY IT TOOK A BIT FOR ME TO RESEARCH A OPTION AND GET BACK WITH YOU I AM GLAD WE ARE WORKING IN THE RIGHT DIRECTION. I HAVE SCHEDULED A APPT WITH LES AT CUSTOM VANS FOR MONDAY AT AM FOR HIM TO RE INSPECT THE
VEHICLE TO MAKE SURE THE MODULE WORKS. I AM SORRY YOU WERE MISIMFORMED ABOUT THE NAVAGAION BEING ABLE TO PLAY DVD'S THAT IS AGAINST THE LAW SO THE MANUFACTURES WONT INSTALL THAT OPTION AS WE DISCUSSED. THANK YOU AGAIN FOR YOUR PATIENCE

This holds true for the two models that I was interested in; both the *** *** *** *** and the *** *** *** *** ***.I am confident that we can work something out in the futureHowever, for now, the advertised prices were not honored and so I cannot count this complaint as resolved
