discount off the published price and chose to use a three part installment payment plan which added a non-refundable service fee of $to his purchase price, making his total $He made the first payment of $that day with the remaining two payments set up for auto-charge on the same day of the two following monthsHe signed both the Services and Distribution Agreement and the Payment Plan Agreement on November 16, Mr***’s manuscript was received and subsequently endorsed to content evaluation on November 22, Content evaluation is the process in which Xlibris assesses an author’s manuscript to ensure that it meets our standards for publishingThe content of Mr***’s book was flagged due to possible libelous content and lack of permission on use excerpts from copyrighted materialsXlibris worked with Mr*** on the requirements to pass the content review process An updated manuscript was received from the author and was re-submitted to content evaluation on January 9, The second review of the manuscript upheld the initial results with some libelous and flagged statements remaining unchangedMr*** agreed to continue working on his manuscript and make the necessary revisions to meet our content standardsA third review was made after submission of a revised version from Mr*** but once the updated manuscript failed to pass our content reviewThe results were communicated to Mr*** in February and he again agreed to make revisions to his work We received a request from him to terminate our services agreement on March 1, All Xlibris refunds are processed within our committed timeline of days from the date of the termination request According to the Termination and Refunds Section of his Services and Distribution Agreement (copy attached), projects with manuscripts failing our content evaluation process, qualify for a refund of the amount paid for the publishing package less a $content review fee, the $account setup fee and, per the Payment Plan agreement (copy attached) the $non-refundable installment surchargeMr*** is due $less $or $649.50. On June 12, 2017, at her request, the trial period was cancelled On August 20, our records show a second one-month trial period for the Author Learning Center was initiated for the period of August thru September Because no cancellation notice was received the subscription was activated resulting in the $charge to her card for the month of September thru October On September 21, Ms*** contacted us contesting she had not authorized the $charge that appeared on her credit card for the Author Learning Center and requested a refundIn reviewing her account we were unable to find documentation of the circumstances surrounding the offering of the second trial, or its acceptance or refusal. In addition to attaching a copy of the agreement to our original response, the text of the clause governing refunds of services not included in Publishing Packages was quoted Upon receipt of his rebuttal, our Author Satisfaction Department contacted him to further discuss his concern. Dear Revdex.com, Thank you for the opportunity to investigate and resolve *** ***’s concerns regarding her request for a refund. Ms*** purchased an Essential Color Paperback publishing package from AuthorHouse on February 3, at the special price of $719. She opted to use a
payment plan splitting the cost into four monthly payments plus a $processing fee, making her total $749.00. Attached are the forms Ms***’s Publishing Consultant completed at the time of the phone order. In November 2009, Ms*** expressed her desire to publish a novel instead of the children’s book she had originally intended. She spoke with Publishing Consultant Karin Romani, who made arrangements to exchange the color publishing package for a black-and-white package more appropriate for a novel. The notes of that call are attached. To make this “trade” the original color package would need to be cancelled and the monies paid toward it transferred to the new black-and-white package. Ms*** states that she has been attempting to obtain a refund since 2010. As customer service is a high priority for us we initiated an investigation to determine what transpired with her account Our research found that Ms*** completed the payment plan installments for her color package totaling $749. We also found that, due to an administrative error, a new file for the black-and-white package had not been opened when the original color package file was cancelled. However, the monies Ms*** paid for her original package remained as a credit on her account awaiting allocation to the manuscript she had indicated she would be submitting A review of the notes, electronic communications and the inbound and outbound call data for the three phone numbers listed on Ms***’s account, 575-639-1513, 575-218, and 575-619.0131, found the absence of communication from Ms*** for the four (4) year period from December to December The file notes (copy attached) and phone records indicate that Ms*** called our office in December 2014, indicating that she was still editing her book but planned to move forward with publication. Ms*** was informed at that time of the error in exchanging her package. Prior to receiving that information, Ms*** appears to have been planning to move forward with her book. Refunding a package purchased six (6) years ago involves approval from multiple departments in the company. Upon receipt of this complaint, we expedited the process. The refund has now been approved, and a check for $(the full cost of the package, less the non-refundable payment plan processing fee) will be mailed to Ms***’s address within 7-business days. Dear Revdex.com, Thank you for the opportunity to provide clarification for Ms*** regarding the terms of her Services Agreement and her royalty and refund concernsOn January 10, 2014, Ms*** purchased the Essential publishing package for $and added on the Author Website for $and the
Bookselling Promotional Materials at no cost. Ms*** elected to pay for these using a three installment payment plan, adding a non-refundable $payment plan fee, totaling $1553. The same day, Ms*** returned the signed services agreement, copy attached. Sales and Royalties Ms*** writes “After finally publishing my book early this year, I have not received any royalties or an accurate sales receipt.” Ms***’s project was made available for purchase on March 29, 2017. In her signed services agreement, Schedule A, Section Royalties, (c) Royalty Payment, it states: “Royalties will be determined quarterly and paid to AUTHOR within sixty days after the quarter ends if the amount of the Royalty exceeds $dollarsIf the quarterly Royalty amount does not exceed $dollars, this Royalty amount will be added to the subsequent quarterly Royalty amount due (Cumulative Annual Royalty)The Cumulative Annual Royalty will be paid to AUTHOR within sixty days after the quarter end in which the Cumulative Annual Royalty first exceeds $Cumulative Annual Royalties that do not exceed $dollars at the end of the calendar year will be paid to AUTHOR within sixty days after year end.” Ms***’s royalty statement is attached. As evidenced from the statement, Ms***’s due royalties are $which is below the minimum threshold of $75. Therefore, Ms*** has not been paid. She will be paid either when her royalties exceed the minimum threshold (after tax withholding) or in the cleanout quarter, Q2017. If Ms*** would like to be paid each quarter regardless of amount, she can submit direct deposit information via her secure author center on the Abbott Press website. In this same author center, she can also submit her tax information to prevent tax withholding on any royalty payments. Ms*** claims she has not received an “accurate sales receipt” but does not indicate what is not accurate about the royalty report. An audit of her sales indicate that the royalty statement is reflecting all sales reported by retailers/printers thus farFulfillment of services Ms*** writes “ALL services I paid for were either not completed or not done fully, satisfactory, or in a reasonable manner.” Ms*** approved the book project for printing on March 28, by returning the galley, cover, and pricing agreement forms, thus completing the projectMs*** approved the Author Website on August 25, and the website was completed on August 30, 2017. Attached is the post fulfillment report she was sent that same day. The Bookselling Promotional Materials were fulfilled and delivered to Ms*** on May 15, 2017-UPS tracking number ***All services have been completed. Ms*** approved all services so we are unclear why she feels the completion is not satisfactory, as she does not elaborate. Summary of desired resolution Ms*** is requesting a full refund, all due royalties, and compensation for mental, emotional and financial trauma A full refundAll services have been fulfilled with Ms***’s approvalSubsequently, in accordance with Schedule A, Section of her Services Agreement, she is no longer eligible for refund.Due royaltiesAs explained above, Ms***’s royalties are below the minimum threshold and will not be paid until they exceed the threshold or if they do not, in the cleanout quarter which is QShould Ms*** desire to bypass the threshold requirement and receive royalty payments earned in the quarter regardless of amount, she may do so by enrolling in the Electronic Funds Transfer program (EFT) thru her secure author center. I do not except the response of the business for the following reasons:
Once again this company has not addressed the complaint and the pertinent issues at hand. Once again they are making an attempt to disclaim my allegations, yet although be it this time they have made more of an effort to disprove the credibility of my allegations, they have once again failed to provide any evidence what so ever support their claims. There is much involved in my claim and it is not just the intoxication issue. This claim involves also deceptive business practices on their behalf and gross misrepresentations of fact that were used to mislead and entice me into purchasing their services and or products. Not to mention the numerous harassing phone calls that I received fro their sales people who kept calling and bugging me for even more money despite numerous attempts by me to tell them not to keep calling me. And, they also had intentionally withheld valuable information from me that they actually had, and subsequently if I were given such information I would have never purchased anything from this company. (for example withholding info on prior sales success from previous authors etc.!) This information they had all along and it was intentionally withheld from me in what was an obvious maneuver to keep me uninformed and in the dark in such matters. As I stated earlier I was told no such sales figures were available prior to my sale, yet later (after the sale)I ask the same salesperson a question and she disclosed the exact type of info I was previously denied. Not to mention filling my head with grossly unrealistic sales expectations that were no way even remotely close to anything they knew they would ever realistically expect anyone to ever get. So why give those grossly over inflated quotes? Just one reason and one reason only. To make a sale! And I'm sorry but to deliberately misquote and mislead someone like that is not only down right unethical, but perhaps illegal too? Common, quoting me between 58,and 116,copies (I sold about copies, far less then 116,I would say!) when in reality they well knew that at best the most their authors who previously used reader's digest ads sold was probably only several dozen to perhaps several hundred for their most successful authors. The point is that they had no business denying me stat's on their prior sales figures when indeed they actually had such figures available.
And, it is not just the RD sale that such tactics were used. Look at my previous (initial) complaint there are numerous issue that are involved in this complaint and any one of these issues would be grounds for a complete and full refund to me due to the highly questionable tactics that were used. And as to the legality of such tactics, that too is highly questionable, and I leave it to you kind folks at the Revdex.com to determine such merits.
The Xlibris company has once again failed to provide and real or substantial proof on their behalf to disprove my allegations. They have only continued to provide a list of policies/procedures and the like, and they have still have not made any attempt to provide any type of real evidence to contrary. Why? Because they know that to provide you with a complete copy of ALL my phone correspondence and other correspondences would result in the revelation of my claim as being valid.
In light of the issues aforementioned, I respectfully request that the Revdex.com allow for a 100% refund to me by Xlibris in the amount specified in my complaint on the basis that Xlibris has failed to provide you any contrary evidence nor did they provide the Revdex.com with a complete copy of all my correspondences with Xlibris (including all phone calls) For certainly the merits of this claim lies in the evidence and in the Revdex.com having all of the evidence in hand. And I am confident that if the Revdex.com were given such evidence in its entirety to evaluate that a ruling might well be made in my favor
