Carnegie General Insurance Agency (“CGIA”) is a General Agent for Western General Automobile Insurance Company (“Western General”) and administers to your policy (Policy issuance, Billing, et al.) but does not process claims Western General, the underwriters of your policy, will not be making any payment for the loss that occurred on May 23, 2015, because your policy has been deemed null and void as of the renewal datePursuant to California Insurance Code Section 359, an insurance company may rescind the insurance policy if the applicant misrepresents or conceals a material fact to the insurerSection specifically states: “If a representation is in a material point, whether affirmative or promissory, the injured party is entitled to rescind the contract from the time the representation becomes false.” In addition, Section of the California Insurance Code states: “Concealment, whether intentional or unintentional, entitles the injured party to rescind insurance.” We have been advised that in the course of an claim investigation, Western General obtained a statement from you in wherein you disclosed that you and F [redacted] are not marriedYou advised that F [redacted] is possibly the person that recommended you to purchase the insurance policyYou also confirmed that you are single and never were marriedOn December 10, 2010, you signed the application for insurance which asked you to provide your marital statusYou falsely identified F [redacted] as your spouseYou designated your marital status as marriedSince policy inception you received and returned annual questionnaires which identified F [redacted] as an excluded driver on your policy and never requested him to be removed from the policy, but requested other changes to your policy to further reduce your premium through adjustments in your commute distance and annual mileage The “APPLICANT’S STATEMENT” section of the policy application reads as follows: “I hereby declare that the statements made in this application are true and complete and these statements are made as an inducement to the Company to issue the insurance policy for which I am applyingI understand my failure to disclose information necessary for the Company to determine the acceptability of the risk and/or the appropriate premium to be charged may void the policy or may preclude coverage for this loss.” Furthermore, we sent you documents in which you were notified and reminded of your continuing obligation to notify us or Western General of any important changesThe document entitled, “Renewal Offer”, contained the following language reminding you of your duty to notify CGIA or Western General of those changes: “IMPORTANT REMINDER: Please be advised that your premium is based on the representations made in your application and you have a continuing obligation to notify your insurance company or CGIA of any changes or updates to the information you provided in your applicationThe kinds of information that may require updating include but are not limited to, adding or excluding all household members years of age and older, new drivers, garaging locations, and your answers to the questions asked in the applicationWe renewed this policy based on the information that was submitted on your policy applicationIf you had disclosed that you were in fact single and not married, we would have rated your policy with the correct premiumYour failure to update Western General and us with important and required information is considered a material omission and/or misrepresentation, and is the grounds on which we rescind your policy retroactive to the date of renewal of December 11, On June 15, a refund of premium in the amount of $1,was sent to you

We are disappointed we weren’t able to work with you to resolve
the matter and continue to be the service provider for your personal auto
insurance
In your complaint, you state “The women didn’t explain to me
that it would be cancelled the next day.” Our records indicate
you called
Carnegie General Insurance Agency on 11/17/and requested cancellation of
your policy with Topa Insurance Company. We have reviewed the recording
of your phone call. During the phone call, our representative said, “The
cancellation will become effective 12:am November 17th, which is
midnight tonight.” You replied “Okay”. Our representative then
confirmed, “Is that okay?” You replied, “That’s fine.” Later in the
conversation, our representative again asked you to confirm that cancellation
would be effective 12:am November 17th, 2015. You replied
“Yes.” In a phone call the following day, our representative explained to
you that we could not reinstate the policy. At the direction of Topa
Insurance Company, we are not authorized to reinstate policies with a lapse in
coverage. We apologize for any inconvenience this may have caused you

I am rejecting this response because:The agency is being unfair and acting in bad faith. I have been paying my premiums for almost 5 years and the agency has collected almost  $ 10,000 from me but they refuse to even cover for anything. What happened to the premiums that I have been paying all these years? They have taken almost a month just to deny my claim and the mistake on the policy was not even my fault. I did not agree to sign any paperwork claiming that i'm married. How could I know there was a mistake on the policy when I myself did not even see or speak to the broker who made the mistake.
