We appreciate the opportunity to respond to Mr [redacted] On or about October 25, 2017, Mr [redacted] submitted an on-line credit inquiry via LendingTree The on-line inquiry contained authorization for his credit information to be accessed in order to consider his inquiry related to the possible refinancing of an existing loan obligationI have attached a copy of the authorization which specifically authorizes the 'hard pull' which Mr [redacted] references in his complaint The authorization Mr [redacted] electronically signed states, " Upon submission of this request and verification of your information, LendingTree will provide your full Social Security Number, as well as other information provided by you, to up to Network partners as an application for credit or as a pre-qualification request These partners may perform a hard pull of your credit profile to provide you with a firm offer of credit." This last sentence actually appears in bold in the text of the disclosure Based upon the terms of the authorization, Auto Approve believes that the 'hard pull' that appears on Mr [redacted] ’s credit report is an accurate reflection of the actions taken and that we have no basis for requesting its removal We are sorry that MrJr [redacted] was not satisfied with his experience with Auto Approve and we hope that we will have an opportunity to work with him in the future

We are sorry that Mr [redacted] does not recollect providing his information to LendingTree, however, I have attached screen-shots received from LendingTree documenting Mr [redacted] 's entry of the specific information he provided regarding the existing motor vehicle credit obligation for which he was requesting refinancing pre-qualification information Again, the LendingTree Disclosure clearly states that by providing the last digits of his SSN and pressing the applicable button on the website, Mr [redacted] was providing 'express written consent' for his credit report to be reviewed by LendingTree's partners (see copy of Disclosure previously provided) The authorization was provided on October 25, and the credit report was pulled and reviewed at that time in response to Mr [redacted] 's consent and request for pre-qualification information Mr [redacted] references later conversations with an employee of Auto Approve but his approval to have his credit reviewed, including a hard pull of such credit, was granted on October 25, and any subsequent communications could not impact the express authorization Mr [redacted] provided (and the report that had already been pulled in response to his request and authorization)His acknowledgment that he did wish to refinance his existing loan, and communicated with Auto Approve regarding such refinancing, supports the fact that he did request such information via LendingTree (which necessitated the review of the customer's credit file)We are again sorry if Mr [redacted] did not fully review or understand the approval he provided via LendingTree but Auto Approve has no legal basis for requesting the removal of a the credit inqiury that was performed in response to his direct request and authorization for such review We appreciate the opportunity to respond to Mr [redacted] and hope that the supporting documents we have provided will answer his questions

We appreciate the opportunity to respond to Mr***. The on-line application that Mr*** submitted via LendingTree contained authorization for his credit information to be accessed in order to consider his application for credit. I have attached a copy of the authorization which
specifically authorizes the 'hard pull' which Mr*** references in his complaint. We appreciate the opportunity to respond to this comment/complaint.  The on-line inquiry that that the customer submitted to Auto Approve via Lending Tree contained very specific authorization language regarding the review of his credit in order to provide terms of the proposed refinance. I...

This last sentence appears in bold in the text of the disclosure.  Based upon the terms of the authorization, Auto Approve believes that the "hard pull" that appears on the customer's credit report is an accurate reflection of the action taken and that we have no basis, therefore, for requesting its removal.  We are sorry that the customer was not satisfied with his experience with Autp Approve but hope that we will have an opportunity to work with him in the future.

I am rejecting this response because:
I don't recall ever giving my social security number to lending tree. Furthermore, I spoke to your associate named Brad ( tel: [redacted]). I advised him of my credit situation and he told me that he wouldn't run my credit. I request that you provide the recorded call and provide a signed copy of the lending tree document you claim to have.

We at Auto Approve understand that the customer may not wish to acknowledge the Disclosures that were provided to him on the Lending Tree website regarding the steps that would be taken once he submitted his inquiry.  However, we simply have no legal basis for requesting the deletion of the credit inquiry that was made pursuant to the customer's express consent to have his credit reviewed in conjunction with a request to obtain proposed refinancing terms. Contracts and Agreements may be entered into electronically and the Disclosures provided to the customer, both at the outset and the end of the inquiry/application process, specifically allowed Lending Tree to forward the customer's information to Auto Approve and for Auto Approve to review the customer credit report.

I am rejecting this response because: A) You cannot demonstrate that I was responsible for the submission. B)entering a number and clicking a button does not indicate any such consent, acknowledgement, or agreement when I clearly do not now.
