Review: We were sold a car that we were told had a clear car fax report and was safe to drive on the roads. After checking the car fax for ourselves, we found that the car was reported as totaled condition from the previous owner.Desired Settlement: We would like the amount of money we spent on the car returned to us from the dealership.

Review: I bought a 2007 Nissan Sentra. The first issue is I was told the car was only in a minor fender bender, which is not true. The car was in a major accident. 2nd-I was told the car had not been through the shop yet, and that several items would be taken care of prior to delivery of the car. I checked with the dealer as to what they were going to do to prepare the car. They said they needed time to make some repairs. They agreed to take $500 off. They were going to replace the bumper, because it's scratched and I said I was fine with a scratched bumper as long as it was re-attached. That was the agreement. The car was also to be cleaned. A tire pressure sensor to be fixed, struts replaced, and a noise I was told was power steering was to be fixed. With the exception of the car being cleaned, nothing had been repaired as agreed. The struts were still bad, noise was still present, bumper was still not attached, tire pressure gage was not fixed, and this car had definitely not "been through the shop." The windows were not working, the tires had not been replaced as required by NYS law. They were way below. In fact, one was completely bald. I brought these issues to the dealer's attention immediately. I also took the car to a Nissan dealer. It turns out the noise I was hearing was not power steering, but a faulty transmission. They verified the struts had not been done, all new tires were needed, and there was a tear in the rear bushing. The dealer took the car for a week with no replacement vehicle. He returned the car with 500 additional miles on it, and little work done. He did the breaks and rotors, and claimed he flushed the transmission. I realize now he did not replace the back tire, but only put it in the front. I had to go get a new front tire because it was down to the treads and the mechanic said all 4 need to be replaced. That mechanic and others, as well as the car fax said the car is in bad shape and was in a major accident. I took the car back to [redacted] after it was returned, they verified the issues with the car were still not fixed, and I would need a new transmission. 613 auto arranged for me to drop the car off in Newburgh, but I had to take time out of my day, again to do it. This time I was given a loaner. When I picked the car up, they informed me it's in poor condition, and also needed a new axle. The battery was completely dead, which I also had to replace at my own expense. I told [redacted] I wanted everything taken care of at the dealer, so I would not have to bring the car back to [redacted] again. He would not do it. I took more time off of work, went up to [redacted] to have the bumper reattached, the axle replaced, and the tire pressure gage fixed. [redacted] refused to fix the struts, though that was our original agreement. I have an e-mail about it before dropping the car off, and after two dealers agreed it needed new struts and bearings. I waited several hours. Again, the bumper was not re-attached properly and the tire pressure gage was not fixed. Only the axle was fixed. I contacted [redacted] again, but received no response. The car also had an issue with wiring of the rear lights which I just needed fixed, as well.Desired Settlement: I would like a refund for all the time I spent and the repairs. I want to be reimbursed $500 for my time and aggravation. $100 for the battery, $500 for new tires, $85 for the issues with the lights, $200 for the bumper, which I was told I would get, $100 to fix the tire pressure gage, $130 to properly fix the windows, (they still don't work correctly), and whatever the cost of replacing struts and bearings. Let's say approximately $500. I also want an additional $1000 off for the car's value since the accident was worse than disclosed to me. The total comes to $3115. $1615 of this are for repair items that were to be done prior to delivery of the car. At the very least, I want to amount for the repairs. NYS law requires a minimum amount of tread on tires before the sale of a car, and the struts, re-attached bumper, and tire pressure sensor (though not part of lemon law) were part of the initial price agreement.

this letter is in response to a complaint received from your offices. the vehicle was not in a major accident a car fax was run on the vehicle the car fax read as such vehicle involved in rear impact. the vehicle was driven away from the scene no tow truck involved. from that literature one can only assume the accident was minor if itb was driven away from the scene. no police officer will allow a vehicle to be driven away if even one light is broken. as for the rear bumper lisa was offered one we would replace the rear bumper on the vehicle if she was willing to pay full price of the vehicle or we would take 500.00 dollars off the price if rear bumper was sold with the vehicle in the same condition as it was. in regards to the tire pressure monitor it was replaced the two front tires were also replaced by us we had a brand new transmission installed by the dealer at no cost to the customer. the customer was provided with a loaner car while it was at the dealer and the custo mer was also provided with a loaner car from us which was a lot car with a dealer plate provided and that vehicle was delivered to her job at the [redacted] campus. miss ostrouch fails to tell all the details that when the car was purchased due to the fact she had no ride we delivered the vehicle to her job in [redacted] which is fourty five minutes away at no expense to her. we also delivered the rental and picked it back up at the same location. we go exactly by new york state law for what we are required to fix or repair on any used vehicle. in the case for miss ostrouch we went above and beyond those requirements. miss ostrouch purchased this vehicle four months ago ny state law for vehicles states any vehicle over 100,000 miles is sold as is and is not covered under any ny state lemon laws a vehicle from 80,000 to 100,000 is only covered for thirty days and or 1,000 miles none of miss ostrouch complaints are covered under any consumer lemon law as can be found on the new york state attorney generals web site.

I would also like to note I have had to replace all four tires on the car, despite their false claims of putting 2 new tires on the car.
