I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.First of all, the allegations made by [redacted] are humorous to say the least. Can you ask him to provide a recording or some type of proof of the so called threats that were made to his manager that I never spoke to? This is slander and I will be adding this to the lawsuit. He is putting words in my mouth once again to shift his responsibility to the damage of my vehicle. I never told him anything about topping off fluids. These are blatant lies used to avoid responsibility of fixing my vehicle that his shop created. [redacted] is most certainly providing me with documentation and pictures for my lawsuit that specifically state the transmission failed due to no transmission fluid. You can call [redacted] (714) [redacted] and request this documentation as well. I should have the report within the next couple of business days. There was no quantification of transmission fluid on the invoice created by Autobahn Autobody which makes me doubt the fluid was added at all. Also, the transmission cooler was replaced and there was no test drive and a recheck of fluids? This is not standard practice for work done that affect a transmission. This can be proven by the mismatched odometer readings by Autobahn, [redacted], and A[redacted]. I will forward the documents and pictures from [redacted] ASAP.

the name [redacted].Mr. [redacted] had his vehicle towed in to our shop and already disassembled on 2-9-15.When his vehicle arrived the battery was dead and his mileage in-op because of this. OnMr. [redacted]'s signed work-order mileage was noted battery in-op no mileage, and abovethis the mileage is listed at 115,117 which is the reading we were able to get once thebattery was changed and before it left our shop. When this vehicle came in it was notdrivable and was pushed around to our back alley which is where the work was done. On3-10-15 at about 7:45am Mr. [redacted] called and stated we had damaged histransmission and was insisting to speak with myself and was instructed by myreceptionist I was not in yet and I would call him back shortly once I got in the office. Icalled Mr. [redacted] on 3-10-15 and after discussing his concerns and the problems Ifmally got approval on 3-11-15 to tow his vehicle into our shop to inspect it. Mr.[redacted] would not give me approval until he knew his brother was going to be there at[redacted] which is the shop where the vehicle was located and his brother works at.Once I received approval Mr. [redacted] informed me that his brother had already toppedoff the fluid in the transmission and it was no longer low. This to me is dis-concerning. Iam now being blamed for fluid levels being low, and can't confirm this now. On 3-11-15 Mr. [redacted]'s vehicle was towed in and once again his mileage was in-op as noted onthe no charge inspection work-order. We made an apt to take up this vehicle to CoastTransmission to have it insp.ecteclon_J.,J2-15. About 9:30am-we-took Mr:-[redacted].!s--------------~;- truck for a test drive to [redacted] which is about 4.5 miles away. The vehiclewas inspected the same day and towed back from [redacted] to AutobahnAutobody also same day. I will be including tow bills along with a copy of the findingsfrom [redacted]. When inspected [redacted] at [redacted] found that therear seal of the transmission has a leak and possible cause for the internal damage is itbeing run on very low fluid prior to installing the trans cooler. There were 2 codespresent at the time of inspection. Both are documented with his findings. Also as statedby adding new fluid this can accelerate any existing problems already there. After beingtowed back I once again called [redacted] and explained I had only changed thetranscooler and added 4 quarts of transmission fluid which I will provide with a copy ofmy invoice. I explained to Mr. [redacted] what was found and that this is an existingproblem that was there prior to repairs. I also explained that our shop is not liable due tothis being an existing problem. Mr. [redacted] was not happy and once again was yellingand stating he had documents that he had just had his transmission serviced and I politelyasked him to send me all the paperwork he had showing this. Once I received thispaperwork I found that the last time he had this serviced or inspected was Jan. 24, 2014.Also as noted on Mr. [redacted]'s [redacted] paperwork he was due for his annual inspectionin January 2015 which was not done. I have confirmed this with his service tech [redacted] at[redacted] in Santa Ana. Had he brought in his vehicle for his annual inspection this problemcould have been caught and or diagnosed then. Once again I spoke to Mr. [redacted] afterreviewing the documents forwarded to me and explained that our shop is still not liable.Later in the evening on 3-11-15 Mr. [redacted] called and requested that his vehicle betowed to [redacted] on that following day. I agreed to send it and called my AAA on 3-13-15 to have it towed to Aamco. I assisted AAA with loading this vehicle and was able toget an odometer reading of 115,209. On 3-16-15 at 9:45am I spoke to [redacted] at Aamcowho informed me that the transmission was slipping and had no leaks. I informed him ofwhat [redacted] at [redacted] had said and found and [redacted] stated he would call [redacted]and confirm. At 11 :OSam [redacted] called back to say he spoke to [redacted] and had found andseen the leak [redacted] was talking about and would call and notify [redacted] of theexisting problem. At 11 :30 am [redacted] called loud and once again yelling and wasnotified that I am not responsible due to wear and tear on an existing problem. After allthis there was no communication until the day I received the letter from your office on 3-25-15 with the complaint attached. My office manager [redacted] called to [redacted] toget a copy of their findings on paper and she was informed of what the status was on Mr.[redacted]'s vehicle and was told they were unable to produce or put anything in writingfor my office to have on Mr. [redacted]'s vehicle. On 3-25-15 about 25 minutes afterspeaking with [redacted] Mr. [redacted] called my office in a loud and threatening mannerwhich is when my office manager asked him_to_not_do_so.-[redacted]-stated-that if-he------wouldlike to call and resolve this amicably he may do so but please do not call our officethreatening this would be our last chance to pay him, or he will get his money from usone way or another. Mr. [redacted] kept repeating himself that this is not a threat it's apromise he will get his money one way or another. Megan advised Mr. [redacted] we werepreparing our response to your office and still are not liable at this point. I am includingtow bill invoices, battery invoice, work-order copies, Mr. [redacted]'s [redacted] paperworkwhich shows vehicle was due on January 2015 and no other documents for that monthuntil this problem had arisen.
