At the time that this complaint was filed and when *** & *** was submitted to our attorney for collections on the toner invoice *** the toner had not been returned. We received it via a carrier on June 19th. The invoice was removed from their account onthat same day and now their account is at zero. We have informed our attorney that we indeed received the toners and will no longer pursue them for said amount. In regards to the credit for a contract again we will not be refunding this. Our contracts are non-refundable as stated in our terms and conditions. As a courtesy to our loyal customers when they upgrade with us we will roll over the contract into their new contract or furnish a credit on their account to use when they purchase future items

We have sent [redacted] and [redacted] a contract to sign and send back to us for several years.  I have attached a copy of the latest contract.  Every contract is a 2 sided document with our Terms and Conditionsprinted on the back.  Please see our Terms wherein  #16 states that...

written or verbal cancellation does not warrant a cash refund or credit.    This  customer chose to upgrade their perfectly running copier in the middle of our contract. When I spoke to [redacted] she said they were trying to be “proactive” in upgrading the copier before it started having problems.   Our contracts have and always will be non-refundable.   It is clearly stated in the attached Terms & Conditions.  We have provided great service on this copier for 9 years (since they purchased the machine in 2006) and they decided to buya copier elsewhere.  That is their decision to make, however, the contract will not be refunded and the toner invoice totaling $213.79 has been sent to our Attorney for collections.  Our terms and conditions are clear and I am certain that small claims court will rule in our favor.Sincerely,[redacted]Office Manager

The terms of the service contract say that written or verbal cancellation of this agreement does not warrant cash refund or credits. This means it is at the discretion of Automated Business Solutions. Two people there informed me that the contract would have been credited IF we had purchased our new copier from them. Apparently they did not like losing a sale even though they had the opportunity to submit a quote but failed to be competitive with the vendor we chose to purchase the new machine from. We have returned the product that was not paid for to Automated to clear this invoice and resolve the issue. We have wasted enough time with this company that provides inferior customer service and believes that the court's time should be wasted on $213 disputes in which they are clearly in the wrong.
