Furey Chrysler has been in contact with [redacted] ***y regarding this complaintPlease see the attached documents supporting the “AS IS” condition of this vehicle along with the customers acknowledgement and acceptanceSumming up the ongoing conversations with [redacted] Furey Chrysler cannot help, assist, diagnose or repair her vehicle because then we would be implying there is a warranty and there is notWhen we sell an “AS IS” vehicle we do not inspect or service them before they are soldThis is communicated to the customer and then disclosed in our finance officeOur deliveries are done the same way every time, we clearly went above our legal obligation disclosing the fact that this vehicle was sold “AS IS” with different formsUnfortunately we have to take a hard line on any vehicle that is sold this wayWe did however offer to give them a 40% discount on the repair, and we offered the parts at a discounted priceTheir vehicle is currently in our shop awaiting a quote, the customer was into our facility last night on 9/15/and fully understands our positionWe did provide them with a courtesy loaner vehicle while we await the quote for repairsWe alsodiscussed the possibility of them trading the vehicle in for the full purchase price value excluding the taxes and fees that were paidThese options were discussed in great length with the customer and we are exploring which option makes the most senseThis is and will be the only options I can provide to the customer.Please call me with any questions[redacted] Vice PresidentUpdate: We traded the customer out of the vehicle on Saturday ***

I will wait until for the business to perform this action and, if it does, will consider this complaint resolved.But for future reference I would like to cite court precedentOhio courts have held that even when a dealer sells a used vehicle “as is,” the dealer has a duty to exercise reasonable care in examining the vehicle to discover defects which would make the vehicle dangerous to users or those who might come in contact with them, and upon discovery, to correct those defects or at least give warning to the purchaser* *** ** *** *** *** *** *** ** *** ***6 ** *** *** *** *** ** *** *** *** *** *** *** *** *** *** ***.I lost quite a bit of money in this transaction due to immediate repairs, and repairs as a result of safety issues, in the future I hope you consider a safety inspection and auctioning vehicles in need of significant repairs if you choose not to repair them

Thank you for the contact.  Unfortunately this is not a covered repair, at the time of sale we offer all consumers an opportunity to protect their investment with an extended warranty.  This customer declined, we do have supporting documents to show they declined the additional...

warranty.  Their purchase came with a 30 day or 1,000 mile 25% parts and labor warranty on engine and transmission only, which was also signed off on by the consumer.  We are not willing to cover any of this repair.  In liue of the situation I will offer the consumer a $200 credit to be used in my service garage at their convenience.  Otherwise we are fully compliant with our obligations and no other concessions will be made.Please let me know if the consumer would like the credit and I will ensure it gets posted to their account.  Upon request we can provide any supporting documents.   Thanks for your time and consideration.[redacted]Vice PresidentFurey Chrysler
