Again we at Autonote can not speak or speculate on anything that transpired with First Place Auto We can only speak for Autonote the financing institution used to purchase the vehicle(personal loan with collateral for customer) In response to the customers statement not having the opportunity to get her belongings and mentioning that she had a wallet we can only respond with that the agent already had the vehicle on the tow unit when the customer was asked to surrender keys(after knocking on the customers door) At that time the agent would have given the customer opportunity to get what ever she wanted from the unit Why the customer elected not to do so we(Autonote) can not speak for that We again can only forward her to the tow company Tarrant County Lien Enforcement for information regarding her complaint The reviews the customer is reading on line are that of First Place Auto, not Autonote First Place Auto is a dealership and uses several places for financing needs, depending on the customers credit situation I can only wrap up this complaint with what the customer continues to refer back to, and that is the contract The contract is very clear on the due dates, the customer initials in several locations regarding the down payments that are due as well as the first payment and last payments due dates The customer also on that very page the paragraph above the right to redeem can read the default clause of the contract and what remedies we have available to us as the lien holder Finally I will say that while we did make calls regarding the welcome, a courtesy reminder at the time that the dealership had not received the down payment as agreed, it is not our position to call a customer multiple times a day regarding a past due bill We unlike most customer experiences with Buy Here Pay Here dealerships are not such and are a stand alone OCCC governed financial Institution that will not call a customer multiple times in a day several days a week violating the FDCPA We want all our satisfied customers to establish and protect their credit history as part of our commitment to lending to those whom need not a 2nd chance but a 3rd or 4th chance, when other financial institutions say NO. In closing I would recommend the following1) Complaint about the mechanics of the car need to be addressed with the selling dealership(First Place Auto), however from what I understand this vehicle was sold as is no warranty.2) Complaint about the money missing from the car needs to be addressed with the tow company Tarrant County Lien Enforcement, they carry insurance to protect them for these very reasons.3) Complaint about not getting calls and Autonote redeeming the vehicle Autonote will refer the customer back to the contract Specifically the followingMotor Vehicle Retail Installment Sales ContractPage of the contract Federal Truth In Lending DisclosuresAPR/Finance Charge/Amount Financed/Total of Payments/Total Sales PriceMy Payment Schedule will be:Number of payments, Amount of payments , When payments are due/Deferred Down PaymentsPage -Repossession/Default/Right to redeem(in its entirety)Motor Vehicle Purchase Agreement-Page Section#and #7There is also a personalized calendar given at the time of sale that was initialed by customer showing due dates

The information is false and in accurate statements. I did not receive calls from AutoNote LLC at any given time. There was no attempts made in contacting me once I was able to get the car back and off the lot. I did not have the opportunity to retrieve my things and I even mentioned that I may have my wallet in there and I needed to retrieve my belongings with AutoNote. I however, did not say they may have taken my belongings however. SOMEWHERE from the car being towed to arriving at AutoNote my money was taken from the vehicle. Is there not security camera's during towing and or the finance location?? The money doesn't walk off and disappear on its own. I have read many reviews online and apparently this is not the first time theft has taken place during the same situation of a repo.  Per Contract it is stated I have the right to redeem the vehicle and that is null and void verbally per the business. I did not again at any point and time receive any calls or voicemail's since the car was in my possession.

In response to customer [redacted]'s complaint.  Customer is correct in that the purchase date is that of original contract date 3/23/2016.  As far as not having the car in her possession until 5/2/2016 Autonote can not speak for that or respond to that or the statements that the...

vehicle was not working and that a trade had occurred and that rentals broke down.  Autonote is a financial institution and are not part of the sales process with First Place Auto other than that we extend financing to customers who go to First Place Auto to purchase a vehicle.  Unfortunately we at Autonote can not address the complaints about not having the vehicle due to mechanical issues or rental/loaner car problems or having to be traded out into another vehicle.  We only finance the requested amount for the vehicle listed on the loan documents.  In regards to this customer and her contractual obligation, the customer did receive a call on 4/5/2016 to welcome her to the Autonote family and remind her that the dealership First Place Auto had called us and advised us that she has yet to pay her down payment that was past due at the time of the call 4 days.  We at that time also discussed all payment options and reviewed contract and payment expectations.  Customer had her first contractual payment due on 4/15/2016 due bi weekly @ 225.00.  The customer at time of repossession had not paid the down payment pick up payment due on 4/1/2016 and was 34 days past due on it and was 20 days past due on 1st and 2nd payments due on 4/15/2016 and 4/29/2016.  Total past due was 450.00 in contractual payments plus the down payment pick up due to the dealership 34 days late at time of repossession.  Notes will support normal collection calls to customer as well as welcome calls, discussing and reminding customer of down payment pick ups.  To address the customers complaint that someone stole $800.00 from her money left in the car it would be important to describe the repossession chain of events.  Once Tarrant County Lien Enforcement was contacted to recover the vehicle, the gps(on car device) is activated and located.  The agent on high end vehicles(Mercedes Benz) is instructed to recover keys as well.  For this reason the agent uses a follow/spotter car.  This vehicle was picked up and driven about 50 yards from the customers home.  Still  visible the spotter/follow agent knocked on the customers door asking for keys.  The driver never once entered the vehicle while towing, the customer had opportunity to retrieve any and all belongings prior to providing key to the following agent.  Once the vehicle arrived the agent placed the vehicle in our secured lot and arriving 3-5 minutes later the follow agent arrived with keys.  The customer arrived about the same time the follow agent arrived and it was not until then that the vehicle was unlocked by the customer to get her personal belongings.  The customer was left to get her personal belongings by her self and shortly after doing so came in to our office stating that the agent stole her money.  We advised the customer that we don't own the recovery company and if she had a complaint she would need to call them directly.  We gave her the number to Tarrant County Lien Enforcement to contact and explained to her they have insurance for those purposes.  Customer after leaving called in stating that she had called the agent but got no answer.  We explained to the customer once again she would have to discuss this concern with the agent Tarrant County Lien Enforcement. Regarding the customers complaint about not having the car 30 days, I will refer back to the contract date and reiterate we are only the financial institution and don't know or are we aware of any mechanical issues or concerns the customer may have discussed with the selling car lot.  Because the customer never completed the down payment and then became due for 2 payments and had not paid we as the lender decided that we did not want to extend financing to this customer, thus the reason we denied redemption.                                                                                    Should you have any questions or need supporting documentation please feel free to contact our office at the number listed below.
