complainants did not meet the credit qualifications to rent at Autumn Creek Apartments. Their application was denied on January 5, 2017 at 8:03am. EST. The complainant was informed of the denial and that reimbursement of her deposit would be processed within 10 to 14 days per our financial policy. Both complainants received Adverse Action Letters through our 3rd party screening agency, Resident Verify, explaining why they did not qualify. On January 16, 2017 Check Number [redacted] in the amount of $600 was processed and mailed to the complainants. Monday January 16th was a bank and postal holiday so the reimbursement check was processed by the post office on January 17th. The check was mailed from [redacted] New York to [redacted] Arizona. Even taking in to account weekends and the holiday, the deposit reimbursement was processed within 11 days of application denial. The complainants should have received the reimbursement by this point. If they have not, we have no knowledge of this. Autumn Creek Apartments has complied with all of our financial rules and practices and treated the applicants equitably and fairly. We are very sorry for the stress they have experienced but they did not meet our qualification guidelines. I am happy to have the opportunity to respond to the complaint (ID #[redacted]) received by your office.On March 22, 2015, the complainant came to tour Autumn Creek Apartments. At that time, she was aresident of a sister property and wished to transfer to Autumn Creek. During the time span of March...

22,2015 through April 3, 2015, she visited Autumn Creek several times to view different apartments withdifferent leasing agents. On April 2, 2015, the leasing agent showed her an apartment in error thatalready had been leased. As an alternative, she was shown the apartment known as 140G, which wasthe same floor plan and style. After viewing 140G, she decided she liked the apartment and proceededto start the paperwork necessary to lease that apartment. She entered into a Lease Agreement for thatapartment with a term of 4/6/15 through 5/31/16. At move in, she paid her security deposit and firstmonth's rent. Both checks were returned to us for non-sufficient funds and were never replaced. Inaddition, May Rent was never paid and the utilities were never put into her name as required under theLease Agreement.When the complainant took possession of her apartment, she made a few accommodation requeststhat including: requests for a handicap parking sign in front of her apartment, striping of the parkingspot alongside her parking spot to give her more room to get in and out of her vehicle, and to have hercarpet cleaned again. All requests were completed in a matter of days without asking or requiring anyproof of the necessities for any of her requests. When she asked if there was a pet in her apartmentprior to her occupancy, we did look at our records and let her know that there was. We are a 'PetFriendly' Community and publish this information in all our marketing material and on our website.In response to her complaint of an alleged fall at another property [redacted]), I have noinformation on that. This would be something that she would need to discuss with the management atthat property. It is my understanding that the management of Renaissance Place Apartments did askher to fill out an incident report, which she refused to do.On May 6, 2015, the Honorable [redacted] Amherst Justice Court in the County of Erie, awarded aWarrant of Eviction to remove the complainant from the premises known as [redacted]
