Here's a summary of the facts in this case: [redacted] has been a patient since 7/and has been seen times at my clinic over the course of the past years to have her lips injected- results of which she was always happy with until now She was last seen on 7/30/and injected with cc Juvaderm XC Ultra but had very specific demands as to where/how she wanted the lips injected [redacted] called on 8/6/to state that while her lips 'swelled up' like usual, but now they looked no different We offered her return appointments so that we could address her concerns on 8/and 8/both of which she refused [redacted] called times on Tuesday 8/demanding to be seen that day and when told we would work her in the next day, she became angry and said she believes she 'was injected with water' I emailed [redacted] to explain that I had followed her instructions on where to inject rather than my usual pattern I also mentioned that if after all these years, she didn't trust that she was getting the requested filler (Juvederm in this case) perhaps this wasn't a good fit since I believe that trust is the foundation of any relationship including a physician-patient relationship Having said that, I would have happily showed her the packaging had she asked for it She also received Brilliant Distinction points with the Juvederm's serial number deposited in her account This is when she became more upset and requested a refund for the Juvederm We are unable to give a refund for the Juvederm as it can not be returned to us The definition of libel is a published statement that is damaging to a person's reputation such as 'I was injected with water...' and 'I heard rumors about ...' We deeply regret the path that this has taken as we always strive to make all our patients happy all of the time but realize that this isn't always possible such as in RJ's caseWe can not offer services to someone who doubts our integrity

Thank you for getting the written consent to allow us to discuss [redacted] 's complaint with you I'm sure that your legal counsel will review and edit her complaint since 'as written' it constitutes libel (a published statement that is damaging to a person's reputation; a written defamation) She repeatedly attacks my personal integrity as opposed to the service she's unhappy about Below is my response to her complaint: [redacted] has been a patient of mine since 7/ She has had her lips injected times by me during this period with Restylane or Juvederm and has always been very pleased with her results On 9/17/09, she asked to see the box of the filler being injected (Restylane at that visit) and I was happy to oblige and showed her the box I found her request odd at the time, as she has been the only patient I have ever had in years of practicing medicine, to request this and clearly showed lack of trust It was also puzzling as she had always been happy with her results The timing of this request seemed to coincide with her seeing a competitor for filler injection in her cheeks She was seen only once by me for a 'touch up' Botox which she wasn't charged for and reported the results as effective after that visit [redacted] came in on 7/30/for Juvederm injection into her lips I normally follow a set injection pattern for her lips but she requested that I 'even out' her lips (was last treated on 10/13) and had instructions for where she wanted to be injected I followed her instructions and she looked at her lips in the mirror when we were done and was pleased when she left the office She called on 8/6/to state that while her lips reacted the same way as usual (swelling and bruising), but she couldn't tell they looked different We offered her an appointment on Friday 8/9/to come in so I could see her- she refused the appointment We called her on Monday 8/and again offered her a late afternoon appointment- she didn't return our call She subsequently called the office times on Tuesday 8/12/requesting to be seen immediately My assistant explained that I was not available that day but we would do our best to accommodate her the next day Wednesday 8/14/ At this point, [redacted] became very angry and said that she lacked confidence in our services and believed that she was injected with water rather than Juvederm as she hadn't seen the box This despite receiving Brilliant Distinction points for her service which lists the serial number for her tube of Juvederm (verifying the product and batch authenticity) I emailed [redacted] to explain that I had followed her instructions on where to inject rather than my usual pattern I also mentioned that if after all these years, she didn't trust that she was getting the requested filler (Juvederm in this case) perhaps this wasn't a good fit since I believe that trust is the foundation of any relationship This is when she became more upset and requested a refund for the Juvederm We would normally have had her return for an appointment to ensure she achieved her desired result We are unable to give a refund for the Juvederm as it can not be returned to us We strive to make all our patients happy all of the time but realize that this isn't always possible Thanks, Dr [redacted] , M.D., M.P.H Ava Hair Restoration & Med Spa North County's Premier Clinic where you always see the Doctor! www.AvaMedSpa.com www.AvaHairRestoration.com CONFIDENTIALITY NOTICE The information in this email may be confidential and/or privilegedThis email is intended to be reviewed by only the individual or organization named above If you are not the intended recipient or an authorized representative of the intended recipient, you are hereby notified that any review, dissemination or copying of this email and its attachments, if any, or the information contained herein is prohibitedIf you have received this email in error, please immediately notify the sender by return email and delete this email from your systemThank you Thank you for getting the written consent to allow us to discuss [redacted] 's complaint with you I'm sure that your legal counsel will review and edit her complaint since 'as written' it constitutes libel (a published statement that is damaging to a person's reputation; Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Regards,
*** ***
I have sent a written letter to Ava Med Spa giving them permission to give the Revdex.com access to my medical record

To start with, [redacted] statement that my complaint “'as written' it constitutes libel (a
published false statement that is damaging to a person's reputation; a written defamation) is false
and threatening. Let me be clear ... I am not a client saying that I am not happy with the results
of a cosmetic procedure. I am a client who does not believe that I was injected with the product
that I paid for. I am led to believe this because I never saw the product nor did I get my normal
result. Usually when I have injectables done at a doctor's office, (other than [redacted])
they bring in the original packaging and open the product right in front of me. From then on, the
product never leaves my sight until it is injected. [redacted] never showed me the packing
of the product she was injecting.
As you can see from my medical record, I have had my lips injected many times and know what
to expect. However, this time as soon as the swelling started to subside around my mouth, I
knew something was wrong. I could see no difference in my lips which is shocking considering
an entire syringe of Juvederm was used. I always take before and after pictures of my lips and
on this occasion, there is no difference between my pre and post pictures. On my last visit I
requested that she inject a little more Juvederm into the left upper left lip to correct a mild
asymmetry. However, to reiterate, I see no difference in my lips.
[redacted] is the only person that has ever injected my lips. The reason I kept going to
her is because I had always been happy with the result. In retrospect, perhaps I would have
gotten a better result or an equally pleasing result with someone else. I had heard rumors that
[redacted] dilutes her injectables, but since I had been a long time client I decided to give
her the benefit of the doubt and returned for her services. However, being concerned with these
accusations I did ask her on one occasion to bring in the original packaging to show me. I felt
that if she was diluting her products or not using the agreed upon product on me, this request
would discourage her from doing so in the future.
The bottom line is that I have paid $500 for a product that I am not convinced I received. The
best case scenario to resolve my complaint is to be refunded the money I paid to [redacted] so I can
take my business elsewhere. At the very least, I would like her to reinject my lips with an entire
syringe of Juvederm at no cost to me since I don’t believe it was ever injected in the first place or
it was diluted.
I would like to thank you for your prompt attention to this matter.

Here's a summary of the facts in this case:
** has been a patient since 7/07 and has been seen 12 times at my clinic over the course of the past 7 years to have her lips injected- results of which she was always happy with until now
She was last seen on 7/30/14 and injected with 1 cc Juvaderm XC Ultra but had very specific demands as to where/how she wanted the lips injected
** called on 8/6/14 to state that while her lips 'swelled up' like usual, but now they looked no different
We offered her return appointments so that we could address her concerns on 8/8 and 8/11 both of which she refused
** called 3 times on Tuesday 8/12 demanding to be seen that day and when told we would work her in the next day, she became angry and said she believes she 'was injected with water'
I emailed ** to explain that I had followed her instructions on where to inject rather than my usual pattern.  I also mentioned that if after all these years, she didn't trust that she was getting the requested filler (Juvederm in this case) perhaps this wasn't a good fit since I believe that trust is the foundation of any relationship including a physician-patient relationship.  Having said that, I would have happily showed her the packaging had she asked for it.  She also received Brilliant Distinction points with the Juvederm's serial number deposited in her account.
This is when she became more upset and requested a refund for the Juvederm.

We are unable to give a refund for the Juvederm as it can not be returned to us.

The definition of libel is a published false statement that is damaging to a person's reputation such as  'I was injected with water...' and 'I heard rumors about ...'
We deeply regret the path that this has taken as we always strive to make all our patients happy all of the time but realize that this isn't always possible such as in RJ's case. We can not offer services to someone who doubts our integrity.

Thank you for getting the written consent to allow us to discuss [redacted]'s complaint with you.  I'm sure that your legal counsel will review and edit her complaint since 'as written' it constitutes libel (a published false statement that is damaging to a person's reputation; a written defamation).  She repeatedly attacks my personal integrity as opposed to the service she's unhappy about.
Below is my response to her complaint:
** has been a patient of mine since 7/2007.  She has had her lips injected 12 times by me during this period with Restylane or Juvederm and has always been very pleased with her results.  On 9/17/09, she asked to see the box of the filler being injected (Restylane at that visit) and I was happy to oblige and showed her the box.  I found her request odd at the time, as she has been the only patient I have ever had in 16 years of practicing medicine, to request this and clearly showed lack of trust.  It was also puzzling as she had always been happy with her results.  The timing of this request seemed to coincide with her seeing a competitor for filler injection in her cheeks.  She was seen only once by me for a 'touch up' Botox which she wasn't charged for and reported the results as effective after that visit.
** came in on 7/30/14 for Juvederm injection into her lips.  I normally follow a set injection pattern for her lips but she requested that I 'even out' her lips (was last treated on 10/13) and had instructions for where she wanted to be injected.  I followed her instructions and she looked at her lips in the mirror when we were done and was pleased when she left the office.  She called on 8/6/14 to state that while her lips reacted the same way as usual (swelling and bruising), but she couldn't tell they looked different.  We offered her an appointment on Friday 8/9/14 to come in so I could see her- she refused the appointment.  We called her on Monday 8/11 and again offered her a late afternoon appointment- she didn't return our call.  She subsequently called the office 3 times on Tuesday 8/12/14 requesting to be seen immediately.  My assistant explained that I was not available that day but we would do our best to accommodate her the next day Wednesday 8/14/14.  At this point, ** became very angry and said that she lacked confidence in our services and believed that she was injected with water rather than Juvederm as she hadn't seen the box.  This despite receiving Brilliant Distinction points for her service which lists the serial number for her tube of Juvederm (verifying the product and batch authenticity).
I emailed ** to explain that I had followed her instructions on where to inject rather than my usual pattern.  I also mentioned that if after all these years, she didn't trust that she was getting the requested filler (Juvederm in this case) perhaps this wasn't a good fit since I believe that trust is the foundation of any relationship.  This is when she became more upset and requested a refund for the Juvederm.
We would normally have had her return for an appointment to ensure she achieved her desired result.  We are unable to give a refund for the Juvederm as it can not be returned to us.  We strive to make all our patients happy all of the time but realize that this isn't always possible.

Review: I have been going to [redacted] for several years now to have my lips injected with a filler, usually Juvaderm. Obviously I have been happy as I keep going back. One time I did go to her for Botox but was unhappy and swore to never let her inject me with Botox again. As I mentioned, I have had Dr. [redacted] inject my lips on several occasions and know what to expect. I have heard rumors that she dilutes her botox or uses a different product than what you think. Because of this I had asked her on one of my visits to bring in the actual box that the product comes in and to open it in front of me. That was the only time I ever saw the Juvederm packaging. After that experience she went back to her standard method of not bringing the actual product into the room. On July 30th I went to [redacted]'s office to have my lips injected with Juvederm. Right after my procedure my lips were swollen as they always are. after having several injections made all around my lip line. A week went by and as the bruising and swelling subsided I couldn't even tell my lips had been injected. I went to my "before pictures" and compared them to my "post injection" lips and saw no difference. I asked my coworkers (all medical professionals) if they could see a difference and to their surprise they said no. Since I never saw the packaging of Juvederm and since I did not get the result that I normally do I am very suspicious of what was injected into my lips. All I can confirm is that a clear fluid in a syringe was injected into my lips.Desired Settlement: I do not trust Dr. [redacted] and at this point will never return to her office.I would like my money for the Juvederm refunded $479.00 because I'm not convinced that I got what I paid for.
