I signed a misleading contract for a year lease at the Avenue Willow in the Highlands August 2019, the property manager *** explained they were running a “ special” in which consisted of a credit , the advertisement on Zillow said rent was 1099 a month with a 50 dollar flat fee for water. The first 3 months were that way until all tenants received a letter exploding we would be responsible of taking care of our “ credit” and after having the October month free the rent started being 1300 a month! Guess what, the special was being spread out to make you sound like you saved money but you were actually paying it all back and the water was not a flat fee anymore. The apartment surely did not worth that but I understand you pay for the location but it was a very misleading contract. As if that was not enough upsetting, in September I found the first mouse inside of my trash can in the kitchen, I called the office and maintainance Came over to patch holes and put a weather strip under the door. By then I thought maybe it did come thru under the door from outside but again end of November on I started having an infestation. I would call the office hysterical every morning when I would wake up to a mouse walking on my living room and I spent my own money to buy traps because *** did not do a good job, they came a few times to set traps but everyday I had at least one or two in my kitchen I kept trying to tell them the mice were coming from underneath the kitchen sink there was holes and droppings to evidence that I also suggested there must have been a way in thru the basement as well the ceilings were falling apart, there was past history of flooding I’m sure there was a nest somewhere there too. I killed 5 mice myself! In a period of 1-2 weeks. I spent money eating out everyday because I had all boxed. I have evidence of the emails and pics. I was also accused of harassing the office with my nice pics! I know at least 2 other tenants with mice too
Please see attachments for proof *** was made aware of her special and her lease rates. The welcome home sent to her prior to signing the lease and before move in, shows her monthly rate and shows “about $50” for her water (never a set rate or was told it was a set rate.) I have also included the first page of the lease that shows her monthly rate and have included the utilities section showing a “flat fee” was not check and it shows it varies monthly. I also included her termination section showing to terminate her lease, the lease requires 60 day notice, 2 month’s term fee, and to repay any concessions. The special she received was a total of $1800 in free rent given on the first 3 month’s rent. If the credit was divided over the lease term, the net effective rent would be $1099 (1800 divided by 12 would be $150 off monthly) *** received her credit and her ledger (I have also attached) shows she received 3 $600 credits.
*** was aware that after she informed the office od seeing mice, we sent pest control to her home twice a week, had bait stations installed on the property, had all holes in her home as advised by *** and also had *** Pest Control come out for a second opinion. *** was not willing to wait for the bait stations and bait set out to start working and told me she had to move and she knew we were addressing the issue but she could not wait. She had an unauthorized occupant in the apartment, and said he had heart issues and it was stressing him out, so I agreed after her 5-8 emails daily sending pictures to the office and emails, that she could leave with a 30 day notice and I would waive her termination fee of $2498.00. Management has waved $3747.00 in fees and only asked for reimbursement of the free rent she received and believe *** has already been compensated for her issues. We will not waive her concession charge back and her payment arrangement still stands.
