On September **, 2016, the complainant [redacted] entered into a 24 month service agreement with Avid Waste on Systems, Inc. to provide solid waste disposal and recycling services for the business located at [redacted]. Service was provided seven days per...

week or 365 days per year for solid waste collection and three days per week for recycling services. The cost for these services, as stated in the agreement, was based on the volume in pounds of waste generated at the restaurant and multiplied by the unit cost of 10 cents per pound. The initial cost of services was based on an estimate of the restaurant's waste volume from information provided by the complainant. On September **, 2016 Avid Waste Systems, Inc. commenced a two week survey to confirm the waste volume generated at the restaurant. The survey entailed Avid Waste Systems, Inc. weighing all of the waste collections from the restaurant from September **, thru October **. The results of this survey was shared with the complainant and it indicated that the initial volume estimate was significantly lower than the actual weight being generated. As a result and pursuant to the terms of the service agreement, Section IV "Effect of Volume Changes", Avid increased the monthly flat rate from $364.00 per month to $450.00 per month commencing December *, 2017.The complainant was fully aware and had previously acknowledged, by placing his initials on this section of the service agreement, that an increase in volume would result in a higher flat monthly rate Despite the fact that the agreement was for a 24 month period and Avid Waste Systems, Inc. has every right to enforce the terms of the agreement up to and including liquidating damages, we decided to let the customer terminate the service agreement without any further obligation to Avid Waste Systems, Inc.
