I am rejecting this response because:
Although what they said was true, I do not have nearly as much an issue about their policies as I do the misleading advertising they continue to put outI understand that there is nothing I can do about he situation I am currently in as I signed documents that relieved the company from any obligationHowever, I filed this complaint to address the advertising, not anything else, and until they quit claiming of the hot tub and pool that do not exist I will not be satisfiedThis company has attempted to appease me with saying when projects will be done before, just to not have them done thenSo I have no reason to believe their claims that what they say will be done and therefore should not be advertising services that they do not offer

To clarify:Avidity Financial LLC has nothing to do with this project. A related company, Avidity Real Estate Services, LLC is the property manager. The lease the tenant signed is not with Avidity Real Estate Services, LLC, but with the owner, Devonshire II, LLC. The only
amenities that are not completed are the hot tub and swimming pool. The volleyball courts, basketball courts, fire pits, dog park, workout areas (2) and tenant lounge are all completed. The pool was held up and subsequently replaced due to problems with the contractor that required the City of Mankato to intervene. The pool was torn out as a result. Weather pending, the new contractor is intending on starting the pool around June1. The ventilation system for the hot tub is just about completed.We are sorry that the tenant feels this way, but in real life certain difficulties arise that need to be dealt with. When the tenant moved in she signed a liability waiver-amenities. Point of this waiver states that the tenant "...understand(s) that the Premises reserve the right to change or cancel the continued availability of the Amenities without liability to me." The tenant also signed a receipt acknowledging that she had received a copy of the lease and related documents and that she understood all of the terms and provisions. Therefore, while we understand her frustration, she should know that there was no obligation to provide the pool or hot tub. We were held up in completing them due to State of Minnesota, City of Mankato, and contractor issues that arose after the pools where originally installed last November. In any event, we believe the new facility will be open by mid-July
