I am rejecting this response because: Dear Mrs [redacted] , In regards to Mr [redacted] , I found him to be a very manipulative and dishonest personFurthermore his response and claim is absolutely inaccurate I have decided to peruse a legal action against Mr [redacted] at the small claim court in Los ***es County municipal court to recover the money that was paid to him The court hearing is set for April 25th I have kept all conversations including emails, text, photos, and letters with Mr [redacted] and I would be happy to share them upon your requestAs stated before, Mr [redacted] had signed a “Landscaping Contract” for the amount of $30,and had falsified his position with the company as license Landscape contractor I have had many conversations with him via text and email asking Mr [redacted] to comply with his contractual obligations; however, he continuously claims family emergency has hinders his efforts to do his jobThis project is not even close to be done at 10% and Mr [redacted] claiming the weather condition is the cause of the delay and family emergencyThere is hardly any material delivered to our house with the exception of maybe $worth of PVC pipes; he further claims some of the material was delivered to his own house by mistake, (I have his text as proof) and also an email from him on Feb 2nd admitting his wrong doing and willingness to refund our money which he never did Mr [redacted] has collected $7,– Dec 30th $ , Jan 2nd $2, Jan 4th 2017, $3,Jan 9th $2,and I also paid him $when he first came to my house to measure the backyardI have proof of payments and as you can see within less than days he demanded payments of $7,He kept telling me he needs money for material and employees He once again showed up at our house on January , 2017, demanding additional $2,even though hardly any work had been doneAt that point we refused to pay any additional money to him until we see progress with the project I trust your judgment and expertise in these types of situations and respect your decision regarding this matter The main agenda for filing this complaint was to make sure this doesn’t happen to any other customer as we found out through online search (yelp) similar incident has happened with Mr [redacted] and another customer Like I stated before I would be happy to provide you with details of my conversation with Mr [redacted] (text, emails) so you can see the extent of his dishonestly and lack of his businessman ship I have obtained new bids from other contractors showing the damages he has done to the backyard and would be happy to share it with you tooAgain thank you for your time [redacted] ###-###-####

GOOD DAY,                   I have received a complaint letter from a customer Mr. [redacted]. I will like to reply to the claim, I fully understand my customers issue with frustration with weather  timing and...

communication. In response to the claim, As the work order and proposal given to Mr. [redacted] which he agreed on 2/4/16. The total amount of the project was $30,000 to  renovate his back yard. AVP landscape design group was originally contacted to do a complete design  for his property at 16160 Meadowcrest Road, Sherman Oaks Ca 91043. I brought in a contactor to accompany me to establish a understanding with Mr.  [redacted] that I was NOT  a contractor rather the a landscape design consultant who was getting his landscape project together.  I was only going to do the planting, removal, herbicide application, grading irrigation. The rest I was  going to give to my business associate who is a licensed contractor. He had not been part of project yet at the time of us doing first stage of project as we did not need him at the moment. All payments were done based upon him seeing work had been done according to the agreed work order and payment schedule.                    Per Agreed work order and payment schedule for which Mr. [redacted] agreed to in red bold there is a notice that states our policy on rain delays and our work days. The weather in Sherman Oaks and most of California was very rainy , and dangerous since the work we were doing was on a slope which seemed to be that could possibly erode if we worked to much, I told [redacted] that he should tell his neighbor with the falling fence as it was a very big liability.  In the claim he has provided with very little information,  in instances very inaccurate.   Customer claims a $7500 refund.  We will agree to $2000.00  refund. His deposit can not be returned because more than %10 of work has been rendered. We had provided our work per work order, customer changed the way he had agreed to work , customer did not want to continue with out payment schedule , nor would agree to pay us on our work order.  I had sent a text message asking him to meet me so we can revise the agreement, shortly after [redacted] told me and my workers not come back, he canceled the work order. My business had some issues, but I  was communicative with [redacted]. Also what caused us to ask [redacted] to sit down and try to put our work on hold was his wife’s aggression against me and my workers . She humiliated me and verbally abused me , saying she would not agree to the work order , and would not pay us until we did what She wanted (not what was on work order).                    I understand my customers  unsatisfaction, but I have proof that we worked as agreed to, up to the point where he had to stop and ask for Mr. [redacted] to sit down with us a make a mutual agreement in regards to work schedule and payment schedule. It really seemed we were not going to get paid or  that the customer would try to  change plans again.  I am willing to get this matter settled fairly. I have many pictures of work being done, invoice of material delivered, I have all my employees and contractor witnesses as well as the neighbors who saw us working. 2017 $2,000 and I also paid him $300.00 when he first came to my house to
measure the backyard. I have proof of payments and as you can see within less than
10 days he demanded payments of $7,500.00. He kept telling me he needs money
for material and employees. 
He once again showed up at our house on January 16 , 2017,
demanding additional $2,000.00 even though hardly any work had been done. At that point we refused to pay any additional money to him until
we see progress with the project.  I trust your judgment and expertise in these types of
situations and respect your decision regarding this matter.  The main
agenda for filing this complaint was to make sure this doesn’t happen to any
other customer as we found out through online search (yelp) similar incident
has happened with Mr. [redacted] and another customer.
Like I stated before I would be happy to provide you with
details of my conversation with Mr. [redacted] (text, emails) so you can see the extent
of his dishonestly and lack of his businessman ship. 
I have obtained new bids from other contractors showing the damages he has done to the backyard and would be happy to share it with you too. Again thank you for your time.
