Re: ID # [redacted] Dear Ms [redacted] ***, This is a response to the complaint made by [redacted] against Avon Creek Apartments regarding the refund of the application fee Ms [redacted] completed the online application and paid the application fee on 7/27/of $and her application was then processed on 7/28/(Credit and Criminal Background screening completed)Avon Creek Apartments Resident Selection Criteria states our application processing policy which specifies an application fee is non-refundableAll applicants must accept the provisions of our criteria to continue completing the online application which Ms [redacted] didMs [redacted] let Avon Creek Management know via email she was no longer interested in the apartment at Avon Creek on 7/29/as she was approved somewhere elseMs [redacted] asked via email to Katy D***, Assistant Manager of Avon Creek, about the application fee being returned since her application was not completed and was told it was a non-refundable fee however, had she paid a deposit or hold fee; that would have been refunded but since she did not pay a deposit or hold fee there was nothing to be refundedNo refund will be given as the application fee is non-refundable Should you have any further questions, please feel free to give my office a call at 317-663- Best Regards, Melissa B [redacted] , CAM, CAPS, AHM, HCCP Regional Property Manager

In response to the compliant dated, February 4, 2014, regarding an advertising issue with our apartment communityBelow please find our rental application and qualifying standards criteria as stated on our rental application that was signed by [redacted] on January 25, Rental Applications: An application for occupancy must be completed and maintained for each legal adult prospective resident who will be living in the apartment or contributing to the payment of rent Any information will constitute grounds for rejection of application and the lease will be nullified We require a non-refundable $application fee at the time of the applicationAn additional $is required for each adult application unless there is joint credit and then only one application fee will be collected Qualifying Standards: · Rental History: Up to months of positive rental history may be verified on present and previous residenceA positive record of prompt monthly payments, sufficient notice, and no damages are expectedFor applicants who are homeowners, permission must be granted to verify payment history with the bank or lending institutionAn unsatisfactory rental history or mortgage history can disqualify an applicant from renting an apartment home at this communityUnsatisfactory rental history or mortgage history can disqualify an applicant from renting an apartment home at this community · Credit Report: An unsatisfactory credit report can disqualify an applicant from renting an apartment home at this communityAn unsatisfactory credit report is one which reflects past or current bad debts, late payments or unpaid bills, liens, judgments, or bankruptciesIf an applicant is rejected for poor credit history, the applicant will be given the name, address, and telephone number of the credit reporting agency that provided the credit report (but not told the content of the credit report)An applicant rejected for unsatisfactory credit is encouraged to obtain a copy of the report from the credit reporting agency, correct any erroneous information that may be on the report, and resubmit an application to this communityThe following are criteria that we look for on the credit report Applicants who have filed bankruptcy must provide proof of discharge in order to be consideredAdditional deposit may be required and re-established credit should be present Applicants with unpaid collections/write-offs are required to pay off these debts before consideration will be givenMedical bills and student loans are not considered unpaid collections or write-offs Applicants with recent history of late/slow-pays may be required to pay an additional deposit of up to one month's rent n Employment: Stable employment record and income verification may be requiredIn order for an application to be approved, he/she must generally earn on a gross monthly basis a minimum of three times the gross monthly rentAcceptable income verification if required may include: most recent pay stubs, a letter from the employer, the most recent Wform; or, for self-employed applicants, a copy of the most recent tax return or certified verification from his/her company accountant or bank n Criminal History: An applicant will be disqualified if the criminal history shows one or more of the following: Convictions of the applicant or a member of the applicant's household of a felony in any state or federal court Arrest of the applicant or a member of the applicant's household within the last month period or conviction of the applicant or a member of the applicants household within the prior sixty months for drug related activity or violent criminal activityDrug related activity defined as the manufacture, sale, distribution, use or possession with the intent to manufacture, sell, distribute, or use of a controlled substance(As defined in the Controlled Substance Act) As stated above in the rental application section the application fee is a non­refundable feeAlso, the said customer did not meet the above listed qualifying standards Very truly, Jennifer W [redacted] Property Manager for Avon Creek Apartments

Rental Applications:

We require a non-refundable $40.00 application fee at the time of the application. An additional $40.00 is required for each adult application unless there is joint credit and then only one application fee will be collected.
Qualifying Standards:
·            Rental History: Up to 24 months of positive rental history may be verified on present and previous residence. A positive record of prompt monthly payments, sufficient notice, and no damages are expected. For applicants who are homeowners, permission must be granted to verify payment history with the bank or lending institution. An unsatisfactory rental history or mortgage history can disqualify an applicant from renting an apartment home at this community. As stated above in the rental application section the application fee is a non­refundable fee. Also, the said customer did not meet the above listed qualifying standards.
