Customer test drove vehicle prior to purchase and was given an opportunity to let independent repair facility check the vehicle outCustomer was pleased with the vehicle at the time of purchase customer also traded in a Toyota
Land-cruiserCustomer did not have the title at the time and promise to bring it back the following dayWe gave the customer *** for the trade and has made several attempts to reach customer regarding the titleAs of 09/30/we have not received the title for the trade which means we lost *** on the dealWe are in the process to take legal action against customer at this timeaccording to customer he has used the warranty for repairs which means he has a warranty on the car
Initial Consumer Rebuttal /* (3000, 7, 2016/10/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Of course the vehicle ran fine when I test drove itThe engine light came on within days of purchasing it and when I went to the dealership to let them know the response was "We must have forgotten to clear the codes"I believe they did whatever needed to be done for the vehicle to run efficiently for a few days(Put something in radiator to stop leak, made the temperature gauge not read properly, and got the engine light to go off until the vehicle was sold.)I found out the head gaskets were shot, so within days of purchase this *** vehicle needed a water pump, radiators, and a new engineWhen I called the manager and spoke to him to let him know I will most likely have to file bankruptcy and have been walking miles back and forth to work daily he thought it was funnyNot only has mine and my wives life been drastically changed, but my children have had to stop all after school activities as well all because we bought a vehicle from this dealershipIt is supposed to be a happy time when a family buys a new vehicle, but buying a vehicle from Absolute Motors has done the opposite and pretty much ruined our lives for the time beingThe warrantee that I bought is reviewing the damage and will let me know whether or not they will cover the repair workIn the meantime we do not have a vehicle and are walking even though a *** payment was made yesterdayI DO NOT WANT THIS VEHICLE, AS IT HAD MAJOR PROBLEMS THAT WERE COVERED UP SO IT COULD BE SOLDI was not given any money for the Land Cruiser after my issue is resolvedWithin days of purchase over *** worth of repair work was needed to that vehicleOn August 1st I had a man knock at my door and tell me to take that vehicle backHe had bought a Mercedes from Absolute and said that they got over on him as wellHe said that the Lexus had major problems and to take it back immediatelyI was surprised by the visit but I wish I would have gotten his nameI could have found out how he knew this vehicle had major problems, I am sure we are not the only ones that have been robbed by Absolute Motors, and as long as they are in business I'm sure we wont be the last!

Case #*** ***
To whom it may concern:
Customer *** *** did come to our dealership requesting to test drive our vehicleLike any other dealership we do have a policy, she then ask to test drive our carEither way we
did let her test drive our car and was companied by one of our employeeCustomer did bring in information about her job but we only request it if their financing through our company, she than stated she wanted to finance through her own personal bankWhich then we told her she would need a bill of sale which we did provide for her and in order for me to print her bill of sale the website that we use does require personal information like her SSNAnd she did motion many times the she didn't want her credit to be ranI myself *** did not run her credit but the website that we use NOWCOM does have a hold of her SSN when we did the bill of saleThen customer did contact us about the situation so we take it into our matter and contact the NOWCOM right away to dispute her inquirySo as of this point the situation has been dealt with and fixedWe did contact the customer after we spoke with the website to do her part on doing a dispute credit inquiry online through ExperianFor any further questions or concerns please feel free to contact usThank you

In response to the complaint filed against us by *** ***, his description of the incident was almost correct; however, he left out a few detailsThe deposit form that he signed has NON-REFUNDABLE DEPOSIT in all caps and bold fonts three
timesI enclosed a copy with responseThe advertising on the window of $down is based on approved creditThe customer was approved for the vehicle, but because of past credit history did not qualify for $down. It doesn't mean our advertisement is because a particular customer don't qualify for a particular loan programThe customer was approved with $downThe customer was aware of this when he gave the $depositThe deposit form that the customer says he didn't read is only a half page document that clearly states that we will take the vehicle off the market because of the non-refundable depositThe customer also served us a subpoena himself, as if he had filed a civil lawsuit against us, which turned out to be a fraudulent subpoenaWe have enclosed the fake subpoena with our response as wellThe customer was full aware that we could not show or sell our vehicle once we accepted his depositWe are still willing to sell the vehicle to the customerThe approval from the finance company is good for days; however, we are not willing to return a NON-REFUNDABLE DEPOSITThis customer has definitely proven that his word cannot be trusted based on the fact that he would deliver a fake court subpoena, which is fraudWe are willing to hold the vehicle for the customer until Friday 10/13/At that point, we will offer the vehicle for sell again
Initial Consumer Rebuttal /* (3000, 7, 2017/10/10) */
(The consumer indicated he/she DID NOT accept the response from the business.)
subpoena was not fake it was given to him to show intentwhich I still plan to filesecondly was told by salesman what I signed was to hold the carnever told it was non-refundablei only changed my mind after I thought about being denied a test drivewhich I was told was owner policyalso after the HPD spoke with both parties I was informed by the officer that I was no longer welcomed at the businessi never heard of a non-refundable contract before so I did not think I needed to read it when I signedhad I known what it was I would never have signedalso thought it was customary for a dealership to discuss something as important as that to make sure it is totally understood before accepting cash so an issue such as this would not arisein other words I cannot change my mindi can understand 10% as a fee but the full amount is robberywho does that with a clear conscienceif I was to consider getting the vehicle per the HPD they would have to be presentas requested by the ownerand furthermore this seems to me like a lot of hassle
and a strong-arm tactic to sell a vehicle by any means
Final Business Response /* (4000, 9, 2017/10/13) */
Once again, the customer's explanation for everything is suspectFirst of all, who ever heard of a person serving a subpoena himself to show intent? Secondly, not only is NON-REFUNDABLE written in bold three times on the document, which makes it impossible to miss it when you're signing, but common sense would suggest if you put money down on a product to block anyone else from buying it, if you then change your mind, you will lose your depositAs stated in our last response, in good faith we were willing to work with this customer, despite his constant dramaToday is 10/13/2017, the deadline for holding our vehicle for this customerWe no longer will deal with this customer or continue to respond to this nonsense

Final Consumer Response /* (3000, 11, 2017/10/16) */
after responding to the lots response I contacted them to find out if we could come pick up the vehicle on 10/since in their correspondence it was said they would hold the vehicle until 10/13/only to find out vehicle had been soldto which I then asked did that mean I could come pick up my depositsince the sale of the vehicle was sold for cash he has been paidand since the vehicle was sold on 10/11/the date he said was null and voidmeaning I should be afforded a full re- fundi was told by a salesman he would have the owner contact me which never happenedi have called the lot several times since then and been told he is in a meeting every time

Initial Business Response /* (1000, 5, 2015/10/14) */
In response to the complaint filed by customer *** ***, We at Absolute Motors, Incattempted to do everything possible to resolve the matter and satisfy the custamerOn the initial day, Saturday 9126/2015, *** was accompanied by his
brother, a small child, and an older gentleman, whom I assumed was his fatherI explained the process of financing a vehicle and explained to them that finance charges are high if a customer has bad or no credit without a co-signer, because it's considered a risky loan to the bankAt the time, the customer was considering paying cash for a car, or financingHe saw a Pontiac GGTPThe car had 136,miles and was equipped with alloy wheels, leather seats and a panoramic sunroofN.A.D.A official used car guide had the suggested retail value at $The
customer test drove the car with his brother, while the older gentleman and the young child stayed at the dealership with meWhen the customer came back, he said that the sunroof did not workI informed
the customer that we will not fix the sunroof and still sell the car for the amount we had listed on our website, which was $On Monday 9/28/2015, the customer returned accompanied by his
brotherWe sold the car to *** for $We also included a 2yr/ 24,mile pre-owned vehicle warranty, which was covered thru the bank that was financing the dealThe cost was $The warranty covered the engine, transmission, drive axle(s), transfer case,
ac/heating, water pump, engine cooling fan motor, radiator fan, radiator fan clutch, fuel delivery pump, fuel injectors, fuel pressure regulator, fuel sending unit, fuel gauge, metal fuel delivery lines, anti-lock brake system accumulator, control module, pump, motor,
reservoir, wheel speed sensors, master cylinder, power brake cylinder, vacuum assist booster, vacuum brake booster pump, compensating
valve, disc brake calibers, wheel cylinders, hydraulic lines, hydraulic line fittings, alternator, generator, voltage regulator, ignition module, ignition coil, starter motor, starter solenoid and wiring harnessIt also covered idle speed motor, manifold pressure, manifold temperature, throttle position, mass air flow, oxygen, coolant temperature, vehicle speed, camshaft, crankshaft angle sensors and primary fuel injector computerThe warranty had roadside assistance that paid up to $
per occurrence for towing, gasoline and assistance, flat tire assistance, lock-out assistance and battery jump start
Three days later the customer called and complained that the service engine light had come on, and the ignition had come out of placeSince the bank had not verified the customer's employment at the time, the deal had not funded, meaning we had not received payment from the
bank, so the deal was not completeWe informed *** that we would repair the items at our service departmentWhen *** returned to
the dealership, he was accompanied by his brother and mother*** was adamant that he did not want us to repair the vehicle and he wanted to cancel the dealWe explained to the customer that if he cancels the deal, he would incur fees for the cancelation and the timeframe that he had been driving the vehicleThese fees are explained at the time of purchase; however, the day *** purchased the vehicle, he was in a rushHe came mins before closing and
refused to sit down and go over the paperworkHe signed everything standing up, as if he was already familiar with the processHe then threw a bank envelope on the desk that contained his $
depositWe then offered to switch vehicles for the customer, using the entire $350tas the deposit for the next vehicleThe customer and his brother test drove a Buick Lucerne CXLThe price was higher than the Pontiac but we were willing to work with him to keep a satisfied customerWhen he came back from the test drive he said he
liked the vehicle and would do the deal the following dayHe drove the Pontiac back home with intentions of trading out of the carThe next day he called and said he was just going to cancel the deal altogether and pay the fees for the cancelationHe kept the Pontiac the entire day, and didn't return it until the following day minutes before we closed once againWe at Absolute Motors made every attempt to resolve this issue, To add additional miles to the vehicle, drive for days, remove our vehicle from inventory and allow no one else the
opportunity of buying it, fees will be incurredThese fees are in writing
Sincerely,
MrMarty ***

NO I DONT ACCEPT IT BECAUSE THE SAMPLE SHEET THAT HAS THE BREAK DOWN OF FEES IS NOT CLEAR ENOUGH AND IS VERY BLURRED AND HARD TO READ ALONG WITH NOT UNDERSTANDING WHY ANY COMPANY FOR THAT FACT WOULD BE ALLOWED TO MAKE UP SUCH HIGH COST ON PEOPLE WHOM ARE TRYING TO DO SOMETHING IN LIFE THE CORRECT WAY I WORKED FOR MY MONEY JUST LIKE THE NEXT MAN ONLY TO BE ROBBED OF IT BECAUSE I DECIDED THAT THIS WOULD NOT BE THE CORRECT AVENUE FOR MEITS NOT FARE AND I DONT UNDERSTAND HOW SUCH THINGS ARE ALLOWEDWE ARE SUPPOSE TO BE PROTECTED BY THE VERY SAME LAWS THAT WAS CREATED TO HELP US BUT YET THE SYSTEM HAS AND IS FAILING USIT IS NOT ACCEPTABLE UNDER ANY MEANS TO TREAT ME NOR ANYONE IN THIS WAY BECAUSE THEY CAN ALLOW THE COMPANY TO DO WHAT THEY WANTIT DOES NOT MAKE IT RIGHT.AND LET IT BE KNOWN I COULD RENT A CAR FOR WEEKS AND IT WOULD NOT COST ME $800.00.ITS NOT RIGHT AND IF THIS IS ALLOWED TO HAPPEN TO PEOPLE WHO DONT KNOW WHAT TO EXPECT WHEN TRYING TO PURCHASE A CAR THEN THESE BUSINESSES SHOULD NOT BE IN BUSINESS BECAUSE ITS A BIG RIP OFF

Once a vehicle is removed from a lot, unlike renting, the vehicle cannot be sold or showed to potential prospectsOnce additional miles are placed on a vehicle it could also have an adverse effect of re-sellingWhen a consumer purchases a vehicle from a dealership and drive the vehicle off the lot, the deal is finalIn this particular situation, we wanted to work with the customer and not let him lose any of his deposit by exchanging vehicles for himInitially the complainant agreed to exchange to another vehicleHe drove our vehicle for another days and then changed his mind againWe have went over and beyond to please the complainantHowever, at this point we are still willing to do an exchange so the customer will not lose any money
OFFER:
We will still allow the customer to exchange vehicles therefore not losing any of his money

In response to the complaint filed against us on 8/25/2017, we disclosed at the time of purchase (04/2016) that the vehicle only come with the key that we have when we purchased it from the auction. We also show the customer that they can purchase replacement keys from Amazon and get them programmed by a locksmith. We have enclosed a screenshot of the Amazon search for a 2004 Honda Pilot. Furthermore, the customer signed an AS/IS form at the time of purchase, meaning that he/she was satisfied with the condition of the vehicle, including the key situation. We are not willing to pay for things from a vehicle that was purchased more than 1 year ago. When the customer took the test drive and agreed to purchase the vehicle she was aware that we did not have a replacement key for the vehicle.
Thank you,
