Review: Avondale Painting did not paint our kitchen as we discussed -which was 2 walls of a rust color and 2 walls cream. He painted all 4 walls cream. He also did not do compounding work and paint cleanup work to our satisfaction. When we called and emailed to tell him that he made a mistake, he refused to come and paint the two walls correctly and wanted paid. The contract we made says that the customer will provide the paint, which we did. The contract states nothing about the colors. In a follow-up email we told him that we would pay him for half of the work, being that we both agreed on what he did do, but he did not accept this offer. In the same email I shared with him the receipt showing the paint purchased on the same day, the notes from my meeting with him which showed the amount of paint of each color I was to purchase, and reminded him that I had the rust color sampled on various parts of the one wall to make sure that we liked it. I also said that his contract stated that the rest of the payment was due when the customer was satisfied and we are not satisfied and have other pictures of the work that was done. The contract also said that the work was expected to begin and end at the end of August and it wasn't. When we called him about this (before the walls were painted) and told him we were disappointed that he was taking a day off instead of working on our kitchen and we thought it was to be done by the end of August, Ken Dion got angry and defensive, and I wonder if all of this trouble really stems from that. We are really disappointed and just want our kitchen finished correctly!Desired Settlement: 1. I want my kitchen painted correctly or,2. Our offer of paying half acceptedI do not want to have to worry about being sued months down the road and taking time out of our busy lives to plead our case.

Thank you for the opportunity to provide the other perspective regarding this complaint.

The issues with the complaint are: timeliness of work, color application, quality of workmanship.

Timing:

· July 23: Mrs. customer requested an in-home estimate

· July 25: met with Mrs customer to discuss multiple projects; there was urgency regarding kitchen work.

· July 26: provided initial prices to Mrs customer – via email – for each of the projects

· Aug 12: met with Mr and Mrs to narrow the scope of work and discuss potential logistics. Again, urgency was an issue

· Aug 14: formal contract mailed to customers with expectation of a quick turnaround.

· Aug 19: after not hearing from either Mr or Mrs customer, Mr customer calls to say “hope you don’t think I’ve forgotten about the contract…it’s coming.”

· Aug 21: Received requested deposit ($142 / 33%) to perform 2 projects: compound work in the dining room ($75) and compound repairs, prime coat and finish paint work to the kitchen walls and ceiling ($350). Total cost of contract $425.

· Aug 23: Emailed acknowledgement to Mrs customer of receipt of deposit payment. Her response was “Great. Feel free to begin Monday, August 26.”

· Aug 23: Due to other work in process, my reply was “earliest I can begin in Tues, August 27th.”

· Aug 27, 28 & 29: worked ½ day each at Mr and Mrs customer

· Aug 29: call from Mr customer: disappointed more work is not completed. I advised I would not work the following day, Aug 30. Disappointment by Mr. customer and would discuss with wife.

· Aug 29: Mrs customer calls to express disappointment that work would not be completed prior to the long holiday

weekend; wanted assurance work would be completed the following short work week (I did assure her)

· Aug 30 – Sept 2: did not work over Labor Day Weekend.

· Sept 3-5: worked ½ day each at Mr and Mrs customer’s home and completed the work on the fifth.

Duration of the relationship: July 25 – September 5 (roughly 41 days)

Worked performed: August 27 –

September 5 (6 partial days over 10 calendar days)

Color Application:

I have no notations nor recollection that 2 different colors were be used on the kitchen walls. My contract offer (and subsequent approval by the customers) makes no mention of the use of 2 colors. No other written, e.g. email, text, correspondence with the customers - to my knowledge – includes use of 2 colors.

There was nothing for me to gain not to paint as the customers desired; there would have been little extra effort at the time to do it as they wished, had I known.

Workmanship:

At no time during the first five days’ work nor immediately following the 6th and final day was anything critical communicated to me about my workmanship re either of the two projects. Only following the customers’ disappointment that two partial walls were not coated as they thought would be done has a quality issue been mentioned.

While Avondale Painting responded to the complaint, they did not provide an offer for resolution. They also failed to respond to our request for resolution. We disagree with his response factually.
